STATUS OUO AGREEMENT
THIS AGREEMENT, made this J if! day of November, 19514, by
and between MICHAEL L. CRESSLER, (hereinatter "HuSband") and
JACQUELINE B. CRESSLER, (hereinafter "Wite"), WITNESSETH:
WHEREAS, the Wife has filed the above captioned divorce
action and has tiled a Petition tor Special Relief; and
WHEREAS, a hearing on the Petition for Special Relief i.
scheduled tor 8:45 a.m. on Tuesday, November 29, 1994 betore
Honorable Edgar B. Bayley; and
WHEREAS, the parties wiSh to enter a Status Quo Agreement to
be legally binding upon them.
NOW, THEREFORE, the parties hereto, intending to be legally
bound hereby, do cov.na~t and agree as tollow.:
1. Neither party shall sell, give away, change the current
ownership of jointly owned property, or otherwise alienate or
dispose ot any of the partie. marital personal property, either
tangible or intangible, except upon further written agreement of
the parties. Thi. Agreement shall not impair the ability of the
partie. to dispo.e of non-marital property in the form ot
tangible personal property owned by them individually prior to
their .arriage.

2. The Husband shall provide tile Wile an opportunity to
inventory the contents ot two (2) sate depo.it boxes rented in
the na.e of the Husband alone. The inventory shall be conducted
in the presence ot a designated power ot attorney who has
authority to obtain access to the sate deposit boxe.. The Wite
agree. to remove no item trom the sate deposit boxe.. The Husband
warrants and represents that no items have been removed trom the
safe depo.it box since hiB being served with the wite's Petition
and Order ot court, which he received on November 17, 1994.
Husband agrses to remove nothing trom the sate deposit box
pending completion ot the Wite's inventory of the contents
thereot.
3. Neither party shall remove any turther tangible or
intangible personal property trom the parties marital home at
254 Newbur9 Road, Newburg, Pennsylvania except upon written
agreement which may be contirmed by exchange ot letters by the
parties respective attorneys. This Agreement shall not preclude
either party from removing clothing and other clearly personal
and individual ettects and non-marital property (i.e. property
owned prior to the marriage ot the parties) from the marital
ho.e. The Wife agree. not to remove any item whatsoever trom the
.arital home except upon advance notice and with a designated
representative ot the Husband being present at the time ot such
re.oval.

v.hiol.. It .hall be the wite'. r.spon.ibility to notify the

5. Either party shall have the right to pre.ent this
written Agr..ment to the Court and to have the Agre.m.nt .ntered
as an Ord.r at Court. Further, the parties agre. that the h..ring

Dear Judge Bayley:
I have received notice of your scheduling of the APL hearing in
the above captioned matter for 8:45 a.m. on Friday, April 28.
While I was away my secretary hopefully worked things out with
Attorney Yunis and your secretary.
The purpose of this letter is to confirm my understanding of the
arrangements made. I will be conducting judicial reviews for
Cumberland county Children and Youth Services commencing at
9:45 a.m. on April 28, 1995. These reviews involve the
coordination of a whole series of attorneys and parties and are
arranged months in advance.
Sharon assured my secretary, Bonnie, that the time allotted for
this hearing on Friday morning April 28 would not exceed one
hour. My secretary also coordinated this information with
Attorney Yunis.
It is there my understanding that it is not necessary tor Mr.
Cressler, who remains in intermediate care at Leader Nursing
Home, to attend the proceeding next Friday morning. It he wishes
to come and his doctor says it is okay, he will be there. If
not, he will not be present.
Attorney Yunis and I will endeavor to reach as many stipulations
a. possible, in writing, and might therefore be able to present
the case on stipulation. If we are not able to do so, I will
have a number of oxpert witnesses to present, including an
attorney Medicaid specialist, the Leader Nursing Home Medicaid
specialist, and possibly Mr. Cressler's physician.

To date, we have not reached an agreement and my client has not

Dear JUdge Bayley:
This will confirm my telephone me..age to your office
indicating that opposing counsel, Dale F. Shughart, Jr., and I
have agreed to continue the alimony pendente lite conterence
presently scheduled tor Monday, August 14, 1995 at 10130 a.m. in
your courtroom. This was continued based upon the tact that we
believe in the next week or two we will be able to reach a
comprehensive tinancial and economic resolution ot this case.
At the same time, however, we also believe that we need to
have this matter rescheduled so that there is a date certain in
ths tuture when we know the matter will be heard if it is not
resolved through appropriate written documents. With that in
mind, I prepared the enclosed Order that aimply continues the
case from Monday, July 14, 1995 at 10:30 a.m. to a later date.
Also, plea.e note that the intormation Mr. Shughart has
provided to me indicates it is likely we will need at least one-
half day for this hearing. That wae another reason why the
continuance was necessitated. It seems that it we proceed with
this matter, Mr. Shughart will be calling at least two experts
related to the cost of nursing home care and how one pays for
that cost.
Your attention in rescheduling this matter is appreciated.

Dear Judge Bayley:
I have recently taken over the Cressler case from Dale F. Shughart Jr" Esquire.
The alimony hearing has been scheduled on several occasions and, each time, postponed
in hopes of a settlement. This last occurred in late summer. Attorney Griffie asked that
the hearing be set down for a date certain so the parties would be pressured to act.
An agreement is still very possible, and even likely. However, we first must receive
a decision from the Pennsylvama Department of Public Welfare on a resource assessment
so that the parties may know the effect of the division of assets on Mr. Cressler's Medicaid
application, and so the parties can also know what their share of the combined household
income will be after Mr. Cres..ler goes on Medicaid. Though this resource assessment was
submitted in April, DPW responded in late August with questions rather than with a
decision. I believe both parties agree that this information is vital to an agreement or to
a court decision on the marital claims.
1 ask that the hearing be rescheduled in appr<111imately 60 days so that the parties
will have adequate time to answer DPW's questions and to resolve this matter by
agreement, if possible.
Attorney Brad Griffie has taken this case over from Barbara Yunis, Esquire. who
previously handled it within his office. Attorney Griffie knows that I am making this
request, and I believe he wants to state his position directly to your office by phone or by
a responding letter.

I am aware that the Defendant in the above-captioned action
has recently switched counsel trom Attorney Dale r. Shughart,
Jr., Esquire to Attorney Taylor Andrews, Esquire. I am aware by
copy ot correspondence that: Mr. Andrews has requested that the
APL hearing and support hearing scheduled for Monday, October 16,
1995, be continued. As you are aware, this matter has been
continued on repeated occasions and my client cannot consent to
the continuance that is requested.
While I acknowledge Mr. Andrews and I had a very productive
