COIIPLAIMT
1. The Plaintiff Dauphin Deposit Bank and Trust Company
("Dauphin Deposit"), is a Pennsylvania Corporation licensed under
the banking laws of the Commonwealth of Pennsylvania with an office
located at 3607 Derry street, Harrisburg, Dauphin County,
Pennsylvania.
2. The Defendant, Thomas E. Hoon, is an individual and was
last known to reside at 7 Maryland Drive, Carlisle, PI. 17033.
3. In connection with a car loan for the purpose of
financing the purchase of a 1991 Ford Ranger Pickup Truck,
Defendant executed a "Pennsylvania Motor Vehicle Installment Sale
Contract" in favor of Dauphin Deposit (Exhibit "1.").
4. Pursuant to Exhibit "1." Defendant agreed to make payments
in monthly installments of $211.83 to Dauphin Deposit for a term of
60 months payable on the 24th of each month.
5. The Defendant has defaulted under the teras and
condition. of said agreGment, in that he failed to make sufficient
and conai.tent paY3ents in accordance with the term..
6. Defendant was given notice that the car was sold at a
public sale by Dauphin Deposit on April 8, 1993. (The Notice of
Sale is attached hereto a. Exhibit "B").
7. Total proceeds generated by the public sale were
$5,850.00. Costs ot sale were $275.00. The net amount applied to
the principal owed on the Detendant's account was $5,575.00.
6. Demand ot Detendant has been made by Dauphin Oepo.it and
Dauphin Deposit's coun.el tor the principal balance ot $3,683.57,
plus accrued interest.
7. Detendant ha. retused to pay the deficiency balance owed
and is theretore liable tor intereat, attorney's fee. and co.ts of
suit.

1. The Plaintiff Dauphin Deposit Bank and Trust Company
("Dauphin Deposit"), is a Pennsylvania Corporation licensed under
the bankinq laws of ttle Commonwealth of Pennsylvania with an oftice

located at 3607 Derry street, Harrisburg, Dauphin County,
Pennsylvania.
2. The Defendant, Thomas E. Hoon, is an individual and was
last known to reside at 7 Maryland Drive, CarliSle, PA 17033.
3. In connection with a car loan for the purpose of
financinq the purchase of a 1991 Ford Ranger PiCkup Truck,
Defendant executed II "Pennsylvania Motor Vehicle Installment Sale
Contract" in favor of Dauphin DepOsit (EXhibit "A").
4. Pursuant to Exhibit "A" Defendant agreed to make payments
in mon~h1y installments of $211.83 to Dauphin Deposit for a term of
60 mon~hs payable on the 24th of each month.
5. The Defendant has defaulted under the terms and
conditions of said agreement, in that he failed to make sufficient
and consistent payments in accordance with the terms.
15. Defendant was given notice that the car was sold at a
public sale by Dauphin Deposit on April 8, 1993. (The Notice of
Sale is attached hereto as Exhibit "B").

7. Total proceeds generated by the public sale were
$5,850.00. Costs of sale were $275.00. The net amount applied to
the principal owed on the Defendant's account was $5,575.00.

15. Demand of Defendant has been made by Dauphin Deposit and
Dauphin Deposit's counsel for the principal balance of $3,1583.57,
plus accrued interest.
7. Defendant has refused to pay the def iciency balance owed
and is therefore liable for interest, attorney's fees and costs of
suit.
8. The following amounts are due on the loan:
(a) Unpaid Principal Balance $ 3,1583.57
(b) Interest through 11/10/94 944.154
(0) Attorney's 15' Collection 694.23

TOTAL DUI $ 5,322.44
WHEREFORE, Plaintiff demands jUdgment against Defendant in the
amount of $S,322.44, consisting of the principal due in the amount
of $3,683.57, interest through November 10, 1994 in the amount of
$944.64, and attorney's tees for collection in the amount of
$694.23, and Plaintiff further demands judgment against Defendant
for all interest accruing after November 10, 1994 at the rate of
$1.4118 per diem, and costs of suit.
