WHEREAS, CHARLES D. GRANITO and KATHRYN A. GRANITO, hu.band
and wite, ot 1012 W. Foxcroft Drive, Camp Hill, Cumberland county,
Pennsylvania, hereinatter called "Owners" are about to execute
contemporaneously herewith a contract with CALDWELL, HECKLES , EGAN,
INC. of 443 North Mulberry Street, Lancaster, Pennsylvania, hereinatter
called "Contractor" tor the erection and construction ot a building and
other improvements upon the property and real estate known as Lot No.
15, Plan of White Oaks, a/k/a 4 White Oak Circle, Lemoyne, Cumberland
County, Pennsylvania, more particularly described in a Deed dated April
9, 1990 and recorded April 10, 1990 in Deed Book 34-M, Page 777,
Cumberland County records.
AND NOW, this 11th day of November, 1994 Caldwell, Heckle. ,
Egan, at the time of and immediately before the execution of the
principal contract, and betore any authority has been given by the said
Owners to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the making ot the
said contract with Ownera and the further consideration ot ONE DOLLAR
($1.00) to Contractor paid by Owners, it is agreed that no mechanics'
lien or claim shall be filed or maintained against the real estate or
improvements by the Contractor, or any sub-contractor nor by any ot the
materialmen or workmen or any other person on account ot any work done
or materials furnished under the Contract or any supplemental contract,
oral or written tor any extra work done or extra materials turnished tor
the pertormance of any supplemental work, the right to tile any Buch
lien or claim being expressly waived. Contractor warrant. and
represents that no work ot any kind has been done and no materials haVe
been turnished, delivered or ordered in connection with the Contract or
any supplemental contract tor extra work. Contractor turther agree. to
indemnity Owners trom any and all damages, costs and expenses, including
reasonable attorney's fees suffered by Owners as a result ot any lien
tiled or claim asserted against the property by Contractor, or any
subcontractor, materialmen, workmen or any other person in violation ot
thiB stipulation.
