CALDW.LL, ..C_L.. , .GAII, IIIC., COlltl'aotol' STIPULATION AGAINST LIZNS WHEREAS, CHARLES D. GRANITO and KATHRYN A. GRANITO, husband and wife, of 1012 W. Foxcroft Drive, Camp Hill, Cumberland County, Pennsylvania, hereinafter called "Owners" are about to execute contemporaneously herewith a contract with CALDWELL, HECKLES , EGAN, INC. of 443 North Mulberry Street, Lancaster, Pennsylvania, hereinafter called "Contractor" for the erection and construction of a buildinq and other improvements upon the property and real eytate known as Lot No. 16, Plan of White Oaks, alkla 4 White Oak CirCle, Lemoyne, Cumberland County, Pennsylvania, more particularly described in a Deed dated October 16, 1990 and recorded November 7, 1990 in Deed Book 34-V, Page 1139, Cumberland County records. AND NOW, this 11th day of November, 1994 Caldwell, Heckles' Egan, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners to the said Contractor to commence work on the said buildinq, or purchase materials for the same in consideration of the making of the said contract with Owners and the further consideration of ONE DOLLAR ($1.00) to Contractor paid by Owners, it is agreed that no mechanics' lien or claim shall be filed or maintained against the real estate or improvements by the Contractor, or any sub-contractor nor by any of the materialmen or workmen or any other person on account of any work done or materials furnished under the Contract or any supplemental contract, oral or written for any e:<tra work done or extra materials furnished for the performance of any supplemental work, the right to file any such lien or claim being expressly waived. Contractor warrants and represents that no work of any kind has been done and no material. have been furnished, delivered or ordered in connection with the Contract or any supplemental contract for extra work. Contractor further agrees to indemnify Owners from any and all damages, costs and expenses, including reasonable attorney's fees suffered by Owners as ~ result of any lien filed or claim assert.ed against the property by contractor, or any subcontractor, materialmen, workmen or any other person in violation of this stipulation. . . . - WITNESS our hands and Ileal. the day and year afore.aid, intendinq to be leqally bound.
