insurance company operating in Pennsylvania with offices at 2674 Monroeville,
Pennsylvania 15146.
3. On or about October 24, 1991, Robert Pendelton was involved in a motor
vehicle accident.
4. Prior to October 24, 1991, Defendant issued a policy of automobile insurance
to Robert Pendelton. Said policy was in effect on the date of the accident.
5. As a result of the accident, Plaintiff suffered various injuries, including low
back injuries.
6. As a further result of the aforementioned accident, Robert Pendelton has
been obliged to receive and undergo medical attention and care and to expend various
sums of money or to incur various expenses for which medical benefits are payable.
7. Following the accident Robert Pendelton incurred reasonable and necessary
treatment from, among others, Plaintiff, for his low back condition and accident related
injuries. The fair and reasonable charges for this treatment are 510,770.27 as set forth on
a copy of the bill which is allached h~reto, made a part hereofand marked as Exhibit "Alt.
8. The bills for Plaintiffs services were submilled to Defendant for payment
on December 12, 1991.
9. Defendant, pursuant to Section 1797(b)(I) of the Pennsylvania Motor
Vehicle Financial Responsibility Law, as amended, attempted to contract with a peer
review organization, for the purpose of allegedly confirming that such treatment, products,
services or accommodations conform to the professional standards of performance and are
medically necessary. The name of the aforesaid peer review organization is CorVel
Corporation (formerly known as Fortis). A copy of the peer review report is attsched
hereto as Exhibit "B".
10. It is believed and therefore averred that the Peer Review process was not
initiated within thirty (30) days from the receipt of the medical bills by Defendant and that
proper notice was not given to Plaintiff.
II. By letter dated June 29, 1992, a copy of which is attached hereto as Exhibit
'C", the Defendant refused payment for the medical treatment provided by the Plaintiff,
based on the conclusions provided in said peer review report dated April 6, 1992 and
received by the Defendant on April 13, 1992.
12. By letter dated July 16, 1992, the Plaintiff responded to the Defendant,
advising Defendant of the impropriety of its peer review. A copy of this letter is attached
hereto as Exhibit "0" and incorporated herein by reference.
13. The Defendant, through the peer review process it utilized, did not provide
notice to the Plaintiff as required by Regulation 69.S2(c) of the Insurance Department
Regulations, did not provide the Plaintiff with an opportunity to discuss the case with the
reviewer and to submit any information to the reviewer prior to a final determination as
required by Regulation 69.S2(d), and did not mail written notice of the determination by
the PRO within five days from receipt of the review.
14. A "reconsideration" of the Peer Review decision was not requested as the
initial peer review was ineffective but a reconsideration report was provided to Defendant
by CorVel Corporation. On or about September 9, 1992, Defendant provided a copy of
the reconsideration report to Plaintiff. The reconsideration report and Defendant's letter
are attached hereto as Exhibit "E".
I S. It is averred that all medical bills incurred are fair and reasonable and that
said treatment was medically necessary and related to the accident. Moreover, pursuant
to Section 1797 (a), all bills were to be paid unless submitted to peer review within 30
days.
16. Defendant has refused to pay the balance due under the terms and conditions
of the policy of insurance and the Pa.MVFRL. As a result of the aforesaid, Plaintiff was
required to hire the services of an attorney to collect the medical bills due.
17. It is averred that the Defendant has acted in an unreasonable maMer by
refusing payment of Plaintiffs invoices. Pursuant to Section 1716 of the Pa.MVFRL,
Plaintiff is entitled to attorney's fees plus interest at the rate of twelve percent.
18. Robert Pendelton assigned to MRS the right to receive monies otherwise to
be paid to the patient under any insurance plan and to pursue his claims for such monies.
19. It is further averred that the Defendant has acted with no reasonable
foundation. Pursuant to Section 1798 ofthe Pa.MVFRL, Defendant is liable for attorney's
fees for such actions.
20. Defendant has undertaken a course of action which has been designed to
unilaterally, and without justification, refuse claims for medical benefits arising out of
motor vehicle accidents and for which the Defendant has contracted to provide insurance
coverage.
WHEREFORE, Plaintiff demands payment of the full medical bills due in th~
amount of S 10,770.27 plus reasonable altomey's fees, costs and interest on said overdue

COUNT II . BAD FAITH
.nd INTERFERENCE WITH CONTRACTUAL RELATIONS
21. The foregoing paragraphs are incorporated herein by reference as thouah set
forth in full.
22. 0\11 treatment was provided to Plaintiff after the effective date of Section
8371 of the Judicial Code, 42 P.S. Section 8371, effective July I, 1990.
23. It is believed and, therefore, averred that the Defendant has employed said
peer review organization in bad faith in that said peer review organization does a
substantial amount of peer review work for Defendant and has a financial interest in
provident to Defendant a biased peer review report.
24. Moreover, said peer review organization has, or may have, continuously been
providing negative peer review reports to this Defendant and other insurance companies
repeating the same language for the purpose of maintaining a steady source of business,
thereby showing a pattern of abuse of the peer review process.
25. It is believed and therefore averred that the Defendant regularly refers claims
to peer review organizations for review without a basis to do so.
26. In addition, said peer review organization gave its opinion that the injuries
were not related to the accident, instead of determining "medical necessity" or
"conformance to standards", all in violation of Section I 797(b)(1 ).
27. In addition, it is believed tilat the Defendant had no reason to believe that
Plaintiff~ treatment was not medically necessary, but instead was intentionally trying to
simply .cut oft" medical coverage for which Plaintiff paid a significant premium.
28. It is believed and, therefore, averred that based on the allegations set forth
above, Defendant is guilty of bad faith.
29. Defendant's unlawful, malicious, unreasonable and unjustified conduct has
interfered with Plaintirrs contractual relations with its patients by making it more
expensive and burdensome for Plaintiff to perform its contractual obligations and has
deprived Plaintiff of the benefit of its contracts, thereby causing losses to Plaintiff.
WHEREFORE, Plaintiff demands judgment in its favor in an amount representing
appropriate damages pursuant to Section 8371, including interest, punitive damages, court
costs and attorney's fees.

Dear Ms. JagielSki:
This patient is a 63-year-old black gentleman who has had two
rehabilitation hospital admissions--one eight years ago following
a back injury from an MVA. Apparently he suffered another MVA on
10/24/91. Approximately one month later, he was admitted to a
rehabilitation hospital in Mechanicsburg, PA (11/20/91). He
remained in the hospital tor approximately ten days and was dis-
charged on 11/30/91. He remained under the care of Dr. Goodman
prior to the admission and also after the admission, at least
through 12/13/91.
During this time frame, there was negative SLR, negative
weakness, and negative distinct neurologic compromise except for
some variable findings on DTRs. At no time was there identitied
any .pecitic neurologic dysfunction.
He was treated primarily with passive modalities in physical
therapy while at Mechanicsburg Hospital.

peer review. Based on this review, Fortis Corporation'. conclusions are as
follows'
...nICAL SUMMARY
Claimant was involved in a motor vehicle accident on October 24, 1991. Initial
treatment for this injury began on November 15, 1991 with B. Goodman, M.D. who
diagnosed back pain which is appropriate. No specific neurological dysfunction
was identified. Therefore, the suggestion of radiculitis is not an appropriate
diagnosis.
There was no reasonable need for admission to Rehab Hospital in Mechaniosburg.
All treatment, including pallive modalities and physical therapy, could have been
given as an outpatient.
The soft tissue injury should have improved sufficiently by December, 1991. Bis
back pain due to his previous motor vehicle accident in 1984 may affect his
rscovery and complete absence of pain may not be realistic.
The following is a description of recommended adjustments with explAnation for
same.

Dear Ms. YanOVl
In reviewing your denial letter dated June 29, 1992, I have found
the denial to be invalid for the tOllowinq reasons:
1) During the inital determination, a PRO shall request, in
writtinq, all records and documents necessary to undertake
its review. Regulation Section 69.52(C). I received a
request trom Fortis requesting medical records to assist
with the processinq ot the insurance claim. No written
notice of a Peer Review was given.
2) The PRO must afford the provider an opportunity to discuss
the case with the reviewer and to submit any information to
the reviewer prior to a final determination. Regulation
Section 69.52(d). This was not provided.
3) Written notice of all determinations by a PRO must bQ mailed
to the insurer within three (3) working days of the
conclusion of the review. This deadline was missed.
4) 'ailure of the observe time deadlines causes the entire PRO
process to become tlawed, requirinq immediate payment to the
client.
5) The insurer must, within five (5) day. of receipt of the
written analysis, give copies to providers and the insureds.
You failed to meet the deadline.
Due to the tailure to compl.y with the PRO Regulations, you have
forfeited your right to a Peer Review, there tor we respectfully
request payment ot the out!tanding balance remaining on this
account within seven (7) days.

July 16, 1992, it is denied that there was any impropriety whatsoever In the peer

were followed by Motorist Mutual, and the plaintiff was given the opportunity to
discuss this case with the reviewer.

15. Denied. It is denied that the medical bills in question were
required to be paid by Motorists Insurance Companies, and that i$ exactly why
the peer review process was instituted.

17. Denied. It is denied that the Motorists Insurance Companies
acted In an unreasonable manner in refusing to pay the plaintiff's invoices, and,
therefore, there was no attorney's fees or 12% Interest due to the plaintiff.
18. Denied. After reasonable investigation, the defendant is
without knowledge as to what assignment was made by Robert Pendelton to
MRS.
19. Denied. The defendant properly followed the peer review
process, and the plaintiff is not entitled to attorney's fees in this action.
20. Denied. It is specifically denied that the defendant
unilaterally, and without justification, refuses to pay claims arising out of motor
vehicle accidents, and, on the contrary, carefully screens cases that are sent for
peer review consideration.
WHEREFORE, it is prayed that the plaintiff's complaint should be

Corporation, or any other peer review organization out of bad faith, or that
Motorists lJu.urance Companies has any financial interests whatsoever in Cor Vel
Corporation, or that the defendant sought a biased peer review report from Cor

24. Denied. It is denied that the plaintiff has any basis for the
allegations set forth in paragraph 24. The answer to paragraph 23 is incorporated

25. Denied. The defendant has a careful process of review before
making a decision of whether to refer a particular r.1aim for medical bills to a peer
review organization.
26. Denied. The peer review organization was asked to determine
medical necessity or conformance to standards, all in compliance with the peer
