COMPLAINT IN MORTGAGE FORECLOSURE AND NOW, comes the Plaintiff, PNC Bank, National Association, a national banking association, by their counsel, Joel B. Gold, Esquire, and files this Complaint In Mortgage Foreclosure, alleging as follows: 1. Plaintiff, PNC Bank, National Association, formerly The First Bank and Trust Company ("PNCB"), is a national banking association organized under the laws of the United states and a citizen of the Commonwealth of Pennsylvania, with its main office located at Fifth Avenue and Wood street, Pittsburgh, Pennsylvania 15222. 2. Defendant Richard J. Magaro is an individual with a residence address of 41 Beechcliff Drive, CarliSle, Cumberland County, Pennsylvania 17013. 3. Defendants Melissa A. Potteiger and Ronald E. Potteiger are individuals with a residence address of 41 Beechcliff Drive, CarliSle, Cumberland County, Pennsylvania 17013. 4. On or about April 22, 1991, as security for payment of a Loan and Security Agreement ("Note") dated April 22, 1991, Defendant Richard J. Magaro executed and delivered to Plaintiff a Mortgage in the amount of $42,300.00 for the premises known as 41 Beechcliff Drive, Silver Spring Township, Cumberland County, Pennsylvania. True and correct copies of the Note and Mortgage are attached hereto, incorporated herein and labeled Exhibit "A" and Exhiblt "B", respectively. ""'-:. 5. The Mortgage, Exhibit "B" hereto, was recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania on April 26, 1991, in Mortgage Book Volume 1009, page 1054. 6. The real property which is subject to the Mortgage, Exhibit "B" hereto, is: ALL THAT CERTAIN tract of land in the Township of Silver spring, county of cumberland, and State of Pennsylvania, more particularly bounded and describe in a map by Gerrit J. Betz, R.S., on June 14, 1974, as follows, to wit: Described in detail in that instrument recorded in the Office of Recorder of Deeds in and for Cumberland county, Pennsylvania in Deed Book U, Volume 30, Page 463. Property is known and numbered as 41 Beechcliff Drive, Carlisle, Pennsylvania, and containing 19.014 acres, more or less ("Property"). 7 . Defendant Richard J. Magaro is a record owner of the described mortgaged premises. 8. Defendants Melissa A. potteiger and Ronald E. potteiger took title to a portion of Property, as set forth in greater detail in that instrument of record in the Office of Recorder of Deeds of Cumberland county, pennsylvania at Deed Book Volume 102, page 119. 9. Defendant Richard J. Magaro has defaulted under the terms and conditions of the Note and Mortgage, Exhibits "A" and "B" hereto, by failing to make periodic payments of principal and interest as required by the Note and Mortgage, said failure to make payments has rendered the obligation due for May, 1994. ''''"- 10. As of November 4, 1994, due to aforesaid default, the amount due and owing to Plaintiff is computed as follows: principal interest attorney fees other total amount due $39,015.77 $ 2,352.53 $ 150.00 $ 75.00 $41,593.30 Plus interest from November 5, 1994 at $11.75 per diem. 11. The Notice of Homeowner's Emergency Mortgage Assistance Act ("Act 91") required by 35 P.S. SS1680.401c, et seq., was mailed to Defendant Richard J. Magaro on July 18, 1994. A true and correct copy of the Notice is attached hereto, incorporated herein and marked Exhibit "c". 12. The Notice of Intention to Foreclose Mortgage required by Section 403 of Act No.6 of 1974, 41 P.S.S403, was mailed certified mail, return receipt requested, to Defendant Richard J. Magaro on July 18, 1994. A true and correct copy of the Notice with proof of certified mailing is attached hereto, incorporated herein Ilnd marked on Exhibits "0" and "E". 13. Defendants Melissa A. Potteiger and Ronald E. Potteiger are a successive owner of record of a portion of the Property who have not given notice to PNCB of their ownership. 14. The Mortgage described above and attached hereto and marked as Exhibit "B" has not been satisfied, released or assigned. 15. Under the terms of the Mortgage and the Note, there is due to PNCB, for attorneys fees for collection, to date of the filing of this Complaint; attorney's fees in the sum of $150.00, Plaintiff does not wai\'e its rights to collect additional attorney's fees for services rendered after the filing of this '. . Complaint not to exceed the amount agreed upon in the Mortgage and Note or as allowed by law. WHEREFORE, Plaintiff demands judgment of foreclosure and sale of the mortgaged property in the amount of $41,593.30, together with interest thereon at the rate of $11. 75, per day plus attorneys' fees, costs, and costs of suit.
