AND NOW, this
day of November, 1994, comes the
Plaintiff, Thomas F. Moran, by his attorney, DIANE G.
RADCLIFF, ESQUIRE, and files this Complaint in Divorce of
which the following is a statement:
COURT II DIVORCB
1. The Plaintiff, Thomas F. Moran, is an adult
individual residing at 516 North Third Street, Apartment 2,
Wormleysburg, Cumberland County, Pennsylvania.
2. The Defendant, Barbara A. Moran, is an adult
individual residing at 49 Drexel Place, New Cumberland,
Cumberland County, Pennsylvania.
3. Plaintiff and/or Defendant have been bona fide
residents of the Commonwealth for at least six (6) months
previous to the filing of this Complaint.
4. Plaintiff and Defendant were married on September
25, 1981 at Pittsburgh, Pennsylvania.
5. There have been no prior actions of divorce or
annulment between the parties.

6. Plaintiff has been advised of the availability of
counseling and the right to request that the Court require the
parties to participate in counseling.
7. The Defendant is not a me~her of the Armed Services
of the United States or any of its Allies.
8. The Plaintiff avers that the grounds on which the
action is based are:
(a) That the marriage is irretrievably broken.
Or in the alternative,
(b) That the parties are now living separate and
apart, and at the appropriate time, Plaintiff will submit an
Affidavit alleging that the parties have lived separate and
apart for at least two (2) years and that the marriage is
irretrievably broken.
WHEREFORE, Plaintiff requests this Honorable Court to
enter a decree in divorce, divorcing the Plaintiff and
Defendant.

dated August 16, 1996, the appointment of the Master is vacated

3. Husband covenants and agrees to convey to Wife, as her sole and separate
property, the real estate presently owned by the parties hereto as tsnants by the entireties
and being known as 49 Drexsl Place, New Cumberland, Pennsylvania, subject, however, to
all liens, encumbrancss, easements, and restrictions presently existing thereon. In
furtherance of this Agreement, Husband represents that he has, as of the date of this
Agrsement, executed, acknowledged, end delivered to her attorney, a deed to said reel
estete, conveying the same as ebovs dsscribed to Wife, and agrees that said deed shell be
held in escrow by her attorney pending ths filing by both parties of tho consents and other
documents necessary to conclude tho:! divorcs action bstween the parties, at which time
Wife's attorney shall, without further dirsction or authorization from Husbend, deliver the
dssd for recordation.
4. Wits shell, at her option, eithsr formelly assums the existing mortgage which
encumbers the rssidence at 49 Drexel Place so that Husband is relieved from further
liability under that mortgage, or refinance the existing mortgage to pay it off in full so that
Husband is relieved from liability, within 90 days of the date of this agreement or, if she
cannot arrange su;:h assumption or refinancing within that time, as soon as thereafter as
she can arrange such assumption or refinancing. Wife shall apply for such assumption or
refinancing at least once svery ninety (90) days until such time as she obtains the
refinancing or assumption necsssary to satisfy the terms of this agrsement.

5, Wife shall deposit the sum of Two Thowiand Two Hundrsd Ninety.Two and
501100 (2,292.50) Dollars with her attorney, to be held in escrow and paid to Husband
promptly upon the release of the deed to the residence at 49 Drexel Place for recordation in
accordancs with the preceding paragraph. At the time that Wife's attorney records the
deed, hs shall immediately rslaase and pay to Husband, or his design!lted repressntative,
the $2,292.50, without further authorization or direction from Wifs.
6. Husband does hereby grant, convey, transfer, assign, and delivsr and sst-over
unto Wife the following assets, which said assets shall bs and remain the sole and separate
propsrty of Wifs hereaftsr, freo of any claim by or intersst of Husband, regardless of
whether such assets were deemed by either of ths parties to be marital property or non-
marital property befors:
A. Wife's individual retirement account with PNC Bank, N.A,;
B. Wifs's profit-sharing plan with Brown & Williams Tobacco Company;
and
C. Wife's policy of insurance with Mutual of New York.
And further, Husband does hsreby waive, release, relinquish, and surrender forevsr any and
all claim to or interest in said assets, which shall bs and rsmain the sole and separats
property of Wifs hereafter.
7. Wife does hereby grant, convey, transfsr, assign, and deliver and set-over unto
Husband the following assets, which said assets shall be and remain the sole and separate
, property of Husband hereafter, free of any claim by 01 interest of Wifs, regardless of

whether such assets were deemed by either 01 the pllrtiss to be marital property or non-
marital property belore:
A. Husband's individual retirement account with PNC Bank, N.A.;
B. Husband's incentive savings plan with Astna Lile and Casualty
Company; and
C. Husband's policies 01 life insurance with Metropolitan Insurance and
with Mutual of New York.
And further, Wife does hereby waive, release, rslinquish, and surrsnder forever any and all
claim to or intersst in said asssts, which shall be and remain ths sole and ssparate property
of Husband hereafter,
B. Wife covenants and agrees to transfer and assign to Husband, all of her right,
title, and intersst in and to a certain 1992 Nissan Stanza automobile, or to release and
waive any further claim to, in, or against said vehicle, said automobiles to be the sole and
separate property of Husband.
9. The parties hereto mutually agrss that they havs effected a satisfactory
division of the furniturs, household furnishings, appliances, and other household and
personal property betwesn them and they mutually agree that each party shall, from and
after the date hsreof, be the sole and ssparate owner of all such tangible personal property
presently in his or hsr possession, whether said property was heretofore owned jointly or
individually by the parties hereto, and this agrsement shall have the effsct of an assignment
or receipt from each party to ths othsr for such property as may be in ths individual

possessions of each of the perties hsreto, the effectivo dato of said bill of sale 10 bo
contemporaneous with the final decrso in divorce entered in the action contemplated to be
filed herein.
10. The ,Jar ties acknowledge that they are aware of the income, education,
income potential, and assets and holdings of the other or have hlld full and ample
opportunity to bscome familiar with such items. Both parties acknowledge that they are
able to support and maintain themselvss comfortably, without contribution from the other
beyond that as provided for in this Property Ssttlement Agrsement, upon the income and
assets owned by each of them. The partiss hereby accept the mutual covenants and terms
of this Agreement and the benefits and properties passed to them herounder in lieu of any
and all further rights to support or alimony for themself, counsel fess, and alimony
pendente lite at this time and during any and all further or future actions of divorce brought
by either of the parties hereto and the partiss do hsreby rsmlse, release, quit claim; and
relinquish forsver any and all right to support, alimony, alimony psndente Iits, counsel fees
and expenses beyond those provided for hsrsln, during the pendency of or as a result of
any such actions, as provided by the Divorcs Code of Pennsylvania or any other applicable
statute, at this time and at any time in the future.
11. Tho parties acknowledge that each of them havo had a full and ample
opportunity to consult with counsel of their choics regarding their claims arising out of the
marriage and divorce and that they have specifically rsviowod their rights to the equitable
distribution of marital property, including rights of discovory, tho right to compel ths filing

of an Inventory end Appraisement, and the right to have the court review ths essets and
claims of the parties and decide them as port of the divorce action. Being aware of those
rights, and being aware of the marital property owned by each of the parties, ths parties
hereto, in consideration of the other terms and provisions of this agreement, do hereby
weive, release and quitclaim any further right to have this court or any other tribunal
equitably distribute or divide their marital property and do hereby further waive, release and
quitclaim any and all claim against or interest in asssts now currently in the possession or
held in the name of the othsr, it bsing their intention to accept the terms and provisions of
this agreement in full satisfaction of all of their claims to ths marital property of the partiss
and the equita:Jle distribution of the sams.
12. Except as herein otherwise provided, each party hereto may dispose of his or
her property in any way, and each party hereby expressly waives and relinquishes any and
all rights he or she may now have or herealtsr acquirs, under the present or future laws of
any jurisdiction, to share In the propsrty or the estate of the othsr as a result of the marital
relationship, including, without limitation, the right to squitable division of marital property,
alimony, alimony pendsnte lite, and counsel fees, sxcept as provided for otherwise in this
Agreement, dower, courtesy, statutory allowanco, widow's allowancs, right to take in
intestacy, right to take against the will of ths other, and right to act as administrator or
exscutor of the othsr's sstate, and eoch will, at the request of the other, execute,
acknowledge, and deiiver any and all instrumsnts which may be necessary or advisable to

carry into effect this mutual waiver and relinquishment of all such interests, rights, and
claims.
13, Husband releases his inchoate Intestate rights in the estate of Wife and Wife
relsasss her inchoate intestate rights In the estate of Husband, and each of the parties
hereto by these presents for himself or helself, his or her heirs, sxecutors, administrators,
or assigns, does remise, release, quit claim, and forever discharge the other party hereto,
his or her heirs, executors, administrators, or assigns, or any of them, of any and all claims,
demands, damages, actions, causes of action or suits of law or in equity, of whatsoever
kind or natura, for or because of any matter or thing done, omitted, or suffersd to be dons
by such other party prior to the date hereof; sxcept that this relsase shall in no way
exonerate or discharge either party hsreto from the obligations and promisss made and
imposed by reason of this agresment and shall in no way affect any cause of action in
absoluta divorcs which either party may have against ths othsr,
14. The parties hereto mutually represent to the other than neither of them has
incurred any debts in the name of the other not prsviously disclosed or provided for In this
agreement, Each of the parties hereby represents to ths other that nelthsr one of thsm
have incurred or contracted for debts in the name of the other or for which the other is or
would be legally liable from and after the dats of the parties' ssparation. Both parties
hereto mutually agree and promise that neither will contract or otherwise incur debts in the
othsr's or joint names without the prior permission and consent of the othsr party hereto.

Both parties hereto represent and warrant to the other party that they have not so
contracted any debts unbeknownst to the other up to the time and date of this Agreement.
16. Both of the partiss hereto represent to thl;l other that they have made full
disclosure of the assets and income and income sources owned, controlled, or enjoyed by
either of them and that neither party hereto has withheld any financial information from the
other, Each of the parties represents that they have reviewed this information with an
attorney of their choice, or had the opportunity to review this information with an attorney
of their choice and voluntarily decided not to do so,
16. The parties agree that they shall, contemporaneously with the execution of this
agreement, make, execute, acknowledge, and deliver unto Husband's attornsy, conssnts
pursuant to Section 3301(c) of the Pennsylvania Divorcs Code and eny and all other
documents reasonably nscessary to concluda a divorce action, The parties agree that thay
shall take any and all action necessary to concludA a divorce pursuant to Section 3301(c)
prom~;ly after ths execution of this agreement.
17, In the event that any of the provisions of this agreement are breachsd or
violated by either of the parties, the othsr party shall bs entitlsd to snforcs this agreement
by an appropriate action in law or in squity or to take any other action to which thoy are
lawfully entitled to enforce this agreement or othsrwise protect thsir rights, In the event
that such action is commsnced by one of the parties and the othor party is found to havs
breached or violatsd any of the terms and provisions of this agreement, the party having so
violated or breachsd the agreemont, shall be responsible for and shall promptly pay upon

10. Defendant lacks sufficient property to provide for her

hersslf during the pendency of this action.
16. Plaintiff enjoys a substantial income and is well able to
contribute to the support and maintenance of Defendant during the course
of this action and to bear the expense of Defendant's attorney and the
expenses of this litigation.
WHBRBFORE. Defendant prays this Honorable Court to order Plaintiff
to pay her reasonable alimony pendente lite during the pendency of this
action and to order Plaintiff to pay the legal fees and expenses incurred

RE: Pre-Hearing Conference Memorandum
DATE: Tuesday, May 21, 1996
Present for the Plaintiff, Thomas F. Moran, was
attorney Diane G. Radcliff, and present for the Defendant,
Barbara A. Moran, was attorney Samuel L. Andes.
A divorce complaint was filed on November 22, 1994,
raising grounds for divorce of irretrievable breakdown of the
marriage. The parties will sign and file affidavits of consent
prior to the hearing to be scheduled in these proceedings so the
divorce can be concluded under section 3301(c) of the Domestic
Relations Code.
An answer and counterclaim were filed in response
to the divorce complaint on October 19, 1995. The counterclaim
raised the economic issues of equitable distribution, alimony,
alimony psndente lite, and counsel fees and expenses. The
counterclaim also raised a count of indignities; however, as
indicated, the parties will conclude the divorce under the no
fault provisions of the Divorce Code.
The parties were married on September 2ti, 1981, and
separated on April 30, 1994. They are the natural parents of
Erin Moran, born October 19, 1983. Husband is paying on account
of support for the child the sum of $350.00 per month through
the Cumberland County Domestic Relations Office.
with respect to the factor of marital misconduct as
that factor relates to wife's alimony claim, counsel will let
the Master know ana vpposing counsel within two weeks of today's
date whether or not any testimony will be offered on the factor
of marital misconduct as that factor relates to the alimony
issue.
Husband is 49 years of age and resides at 514 Kevin
Court, Camp Hill, Pennsylvania, where he lives with his son to a
prior marriage. He is an administrator with Keystone Health
Plan. He has a Bachelor of Arts Degree. His gross income per
year is around $42,000.00. Although husband had Buffered two
strokes in the past apparently his hsalth is improved to the
extent that he is able to conduct his employment activities
satisfactorily. Husband has two children of a prior marriage.
Both of those childrsn are emancipated.
Wife is 47 years of age and resides at 49 Drexel
Place, New Cumberland, Pennsylvania. She lives with the
daughter Erin. Wife is a high school graduate and has an
Associates Degree. She is a sales representative with Brown and
Williamson Corporation and her income on a bimonthly basis is
$1,355.00. Her 1994 income tax return showed income from wages
at $33,449.00 and dividend income of $3,729.00. Wife has not
raised any health issues.
The parties own a property at 49 Drexel Place, New
Cumberland, Pennsylvania, where wife is living with the minor
daughter of the marriags. Husband has placed a value on the
home at $75,000.00 and wife has stated a value of $68,000.00.
The figure that wife has provided is based on an appraisal.
Attorney Radcliff has indicated that she will probably have the
property appraised for her client. The appraisal will also
include a monthly rental value. The property is subject to a
mortgage in favor of Citfod Mortgage Company and the estimatsd
balance on that mortgage is around $53,600.00. One of the
issues in this case is whether or not wife should be compelled
to refinance the property to remove husband's name from the
obligation of the mortgage. Wife claims that the costs of
refinancing is not a cost which she should have to assume
inasmuch as she is willing to provide husband with an
indemnification and further will agree to assume the payments
for the balance due on the mortgage. The Mastsr has indicated
to both parties and co~nsel that he will hear whatever testimony
they wish to present from various lenders regarding the issue
and the costs of refinancing. Further, the Master will be
interested to know husband's reasons for believing that he
should have the Court direct, under the circumstances of the
facts presented, that wife incur the expense of the refinancing.
Wife has an IRA at PNC with a balance of around
$1,952.00. Also, wife is a participant in a profit Sharing
plan with Brown and Williamson and the balance shown on the
pre-trial statement is in the amount of $5,575.57. Husband has
an IRA with PNC with a balance of around $6,115.00.00. He also
has an incentive savings plan with Aetna with a balance of
around $6,270.00.
Counsel have provided information regarding the
various insurance policies showing a cash value with
Metropolitan of $3,068.00, a cash balance with Mutual of New

5. INCOME STATEMENT. Defendant is paid $I,J55.00 twice each month
by her employer. the Brown & Williamson Tobacco corporation. Enclosed
are copies of Defendant's paycheck stubs showing her gross and net income
from that company (Exhibit DJ. Attached. within Exhibit C provided
herewith, is a copy of Defendant's 1994 income tax return, which also
shows her income from other sources.
6. EXPENSE STATF~ENT.
Defendant will provide a current expense
statement at the time of the hearing.
7. PENSION INFORMATION. At the present time the retirement assets
of the parties that are marital property can be valued by review of
periodic statements. Unless the evidence indicates otherwise, it appears
that neither party has a defined benefit plan which would require
actuarial valuation.
6. COUNSEl. FEES. Defendant has incurred counsel fees up to the
present time of approximately $2,000.00 and will produce detailed
evidence at the hearing of the amount and calculation of those fees.
9. PERIlONAI. PROPERTY. Defendant intends to call an appraiser to
establish the value of the tangible household personal property if the
parties do not reach agreement on such assets.

This Agreement constitutes the entire underatondinll of the parties and
supersedes sny and oil prior sgreements and negotiations between them, There
pre no representations or warranties ~ther than those expressly set forth

Wife and Husbsnd covenant and agree that they will forthwith execute
any and all written instruments, assignments, releases, sstisfsctions, deeds,
notes or auch other writings as may be necessary or desirable for the proper
effectuation of' this Agreement, and as their respective counsel shall mutually
agree should be so executed in order to carry out fully snd effectively the
terms of this Agreement.
26. NO WAIVER OR DEFAULT
This Agreement shall remain in full force and effect unless and until
terminated under and pursuant to the terms of thiw Agreement. The failure of
either party to insist upon strict performance of any of the provioions of
this Agreement sholl in no way affect the right of such party hereafter to
