NO. 94- CIVIL TERM SHAFFER TRUCKING, INC., and JOHN P. WOMELSDORF, Defendants JURY TRIAL DEMANDED COMPLAINT AND NOW, come the plaintiffs, Jeffrey D. and Charise M. Kauffman, by their attorneys, Fowler, Addams, Shughart & Rundle, and make the following complaint: 1. The plaintiffs are Jeffrey D. Kauffman and Charise M. Kauffman, adult individuals residing at 329 Weet Penn street, Carlisle, Cumberland County, PA 17013. 2. The defendant, Shaffer Trucking, Inc., is a corporation with its offices and principal place of business on Route 11 in New Kingstown, Cumberland County, Pennsylvania. 3. Defendant John P. Womelsdorf is an adult individual residing at 21 Lake Meade Drive, East Berlin, Adams County, PA 17316. 4. On December B, 1992 at about 7:00 a.m. Plaintiff Jeffrey D. Kauffman was operating his automobile in the right hand lane of eastbound traffic of the Carlisle Pike in Hampden Township about 200 yards east of the intersection with Kevin Road. 5. At said time and place Defendant Womelsdorf was operating a tractor trailer unit owned by Defendant Shaffer Trucking, Inc. bearing Nebraska registration No. 13861 in the left hand lane of eastbound traffic. 6. Defendant Womelsdorf attempted to enter the right hand lane and negligently and carelessly collided with the left rear of the plaintiff's automobile which caused it to go to the left and off the north side of the highway where it collided with a steel pole resulting in the injuries and damages hereinafter set forth. 7. Defendant Womelsdorf was negligent and careless in: A. Attempting to change lanes when said movement could not be made in safety. B. Failing to yield the right of way to the plaintiff's vehicle. C. Failing to observe the plaintiff's vehicle in time to avoid a collision. 8. At all times relevant hereto Defendant Womelsdorf was operating the tractor trailer unit as the agent, servant and employee of Defendant Shaffer Trucking, Inc. COUNT I JEFFREY D. KAUFFMAN v. DEFENDANTS 9. Paragraphs 1-8 are incorporated herein by reference. 10. As a result of the negligence and carelessness of the defendants, the plaintiff sustained two large lacerations of the forehead, a severe laceration and contusion of the left knee and a laceration of the left elbow. 11. The pleintiff has undergone great pain and SUffering, has incurred medical expsnse and loss of earnings, and has been left with a serious permanent disfigurement as a result of his injuries. 12. The plaintiff may have to undergo rsconstructive surgery in the future to attempt to lessen the effects of the scarring. WHEREFORE, the defendant demands damages against the defendants for an amount in excess of $25,000 plus delay damages and costs of suit. COUNT II CHARtS! M. KAUFFMAN v. DEFENDANTS 13. The allegations of Paragraphs 1-12 are incorporated herein by reference. 14. As a result of the injuries to her husband, the plaintiff claims damages for loss of consortium. WHEREFORE, the plaintiff demands judgment against the defendants in an amount in excess of $25,000 plus delay damages and costs of suit.
