"
The defendant is enjoined from harassing and stalking the
plaintiff and from harassing the plaintiff's relatives, or the
minor children.
The defendant is enjoined from entering the plaintiff's
place of employment schools of the minor children.
The defendant is enjoined from removing, damaging,
destroying or selling any propert~ owned Jointly by the parties
or owned solely by the plaintiff.
A vinll\tion of this Order may subject the defendant to: i)
arrest under 23 Pa.C.S. g6113; ii) a private criminal co.plaint
under 23 Pa.C.S. 06113.1; iii) a char~e of indirect criminal
contempt under 23 Pa.C.S. 06114. punishable by imprison.ent up to
six months aDd a fine of $100.00-$1,000.00; and iv) civil
cuntempt under 23 Pa.C.S. g6114.1. Resumption of co-residencu on
the part of the plaintiff and dAfendant shall not nullify the
provisions of the court order.
This Order shall remain in effect until modified or
terminated by the Court and can be extended beyond its original
expiration date if the Court finds that the defendant has
committed another act of abuse or has engaged in a pattern or
practice that indicatea continued risk of harm to the plaintiff.
The Custody Order dated December 1, 1994, was entered by
Judge Kevin A, Hess in the Court of Common Pleas of Cumberland
County, Pennsylvania, No. 94-6647, attached hereto, remains in
full force and effect.
A hearing shall be held on this mat ter on the ;),:;{ lie( day of
April, 1997, at 1~:"(l.-fL.m., in Courtroom NO.~, Cumberland
County Courthouse, Carlisle, Pennsylvania.
The plaintiff may proceed without pre-payment of fees
pending further order of court.
The Cumberland County Sheriff's Department shall attempt to
make service at th~ plaintiff's request and without pre-payment
of fees, but service may be accomplished IInder any applicable
rule of uivil Procedure.
This Order shall be docketed in the office of the
Prothonotary and forwarded to the Sheriff for service. The
Prothonotary shall not send a copy of this Order to the defendant
by mail.
Tile Carlisle and East Pennsboro police Departments will be
provided with certified copies of this Order by the plaintiff's
attorney. This Order shall be enforced by any law enforcement
agency where a violation occurs by arrest for indirect ~riminal
contempt without warrant upon probable caUSd that this Ord~r has
been violated, whether or not the violation is committed in the
presence of the police officer. In the event that dn arrest is
made under this section, the defendant shall be taken without
unnecessary delay before the court that issued the order. When
that court is unavailable, the defendant shall be taken before
the appropriate district justice. (23 Pa.C.S. g 6113).

The Court of Common Pleas of Cumberland County is required by law

injury. This hos included, but is not limited to, the following
specific instances of abuse:
a, On or about April 4, 1997, the defendant grabbed
the plaintiff by the throat, threw her against a wall,
and repeatedly banged her head against the wall with
such force that he caused her to collapse to the floor
on her knees in pain. The defendant repeatedly kicked
the plaintiff, When the plaintiff got up and tried to
leave the room, the defendant stood in front of the
door blocking it. As the plaintiff backed away from
the defendant, he came toward her and repeatedly pushed
her across the room and then shoved her onto the bed.
The defendant picked up an iron and repeatedly hit the
plaintiff on the back with the cord and twisted her
fingers causing swelling, As the plaintiff struggled
to get away from the defendant, she told her three year
old son (who was witnessing this incident) to run to
his grandmother and get help. The defendant continued
to kick and hit the plaintiff with the iron cord until
he heard the plaintiff'S mother come into the house.
During this incident the defendant also slapped the
plaintiff across the face. As a result of this abuse,
the plaintiff was treated at Carlisle Hospital for
injuries including, but not limited to, the following:
scratches on her back, a laceration on the side of her

head, and swelling on her hand and the back of her
neck. The defendant was arrested for simple assault and
has a preliminary hearing scheduled for April 16, 1997,
at 11:00 a.m. at District Justice Paula Correal's
office,
b. In or about April, 1997, the defendant threatened
tho plaintiff saying that if she ever had a guy in the
house, he would do what thA guy did to Tara Hodge,
including going after her family, and that the police
would never find out about it ceusing the plaintiff to
fear for her life.
c. On or about February 1997, the defendant grabbed
the plaintiff by her thront causing the plaintiff pain.
d, In or about January 1997, during an argument with
the plaintiff, the defendant grabbed a knife and sliced
two of her fingers. As a result of this incident, the
plaintiff received several stitches at Holy Spirit
Hospital,
e, On several different occasions from January, 1997,
through April 4, 1997, the defendant followed tho
plaintiff causing her to fear for her safety, On one
occasion in or about March 19U7, when the plaintiff
returned to her parked car after leaving it for a brief
period of time, she found the defendant sitting inside
the vehicle. On another occasion, the defendant had

been in her attic listening to her conversations
causing her to fear for her safety.
f, In or about November of 1994, a Protection from
Abuse Order was entered under the above captioned
number, The plaintiff's fear of abuse is exacerbated
because of the defendant's history of abuse which
included the following: kicking the plaintiff about
her buttocks and leg, repeatedly punching her, grabbing
her arm and twisting it causing her to fall to her
knees in pain, pushing the plaintiff, shoving her to
the ground causing her to hit her head on the sidewalk,
shoving the plaintiff against a wall and butting his
head into her nose causing a fractured nose, and
punching the plaintiff in the eye causing swelling and
bruising about her eye.
5. The plaintiff believes and therefore avers that she is
in immediate and present danger of abuse from the defendan~
should she remain in the home without the defendant's exclusion
and that she is in need of protection from such abuse.
6. The plaintiff desires that the defendant be prohibited
from having any direct or indirect contact with the plaintiff
including, but not limited to, telephone and written
communications, except for the limited purpose of facilitating
custody arrangements which shall be done through written
communication by the defendant.

7, The plaintiff desires that the defendant be enjoined
from harassing and stalking the plaintiff, and from harassing the
plaintiff's relatives, or the minor children.
8. The plaintiff desires that the defendant be restrained
from entering her place of employment the schools of the minor
children.
9, The plaintiff desires that the defendant be enjoined
from removing, damaging, destroying or selling any property owned
jointly by the parties or owned solely by the plaintiff.
>>. EXCLUSIVE POSSESSION
10. The home from which the plaintiff is asking the Court
to exclude the defendant is rented in the names of the plaintiff
and the defendant.
11. The defendant has recently moved into his father's
residence which is located at 3024 Bel-Pre Road, Apartment 101,
Silver Springs, Maryland.
12. The plaintiff currently has no place to stay with her
children except the marital home, and the defendant can continue
to live with his father.
13. The plaintiff desires possession of the home so as to
give the greatest degree of continuity to the lives of the
children.
C. I.OSSES AND REIMBURSEMENT FOR COST OF CASE
14. The plsintiff has suffered losses as a result of the
abuse by the defendant. The los~es are listed on Exhibit A

attached,
15, The plaintiff asks that the defendant be ordered to pay
$250.00 to reimburse one of Legal Services, Inc. 's funding
sources for the cost of litigating this case.
WHEREFORE, pursuant to the provisions of the "Protection
from Abuse Act" of October 7, 1976, 23 Pa.C,S. ~ 6101 ~ ~., as
amended, the plaintiff prays this Honorable Court to grant the
following relief:
A, Grant a Temporary Order pursuant to the
"Protection from Abuse Act:"
1. Ordering the defendant to refrain from
abusing the plaintiff or placing her in fear of
abuse.
2. Ordering the defendant to refrain from having
any direct or indirect contact with the plaintiff
including, but not limited to, telephone and
written communications, except to facilitate
custody arrangements which shall be done through
written communication by the defendent.
3, Ordering the defendant to refrain from
harassing and stalking the plaintiff and from
harassing the plaintiff's relatives and the minor
children.
4, Prohibiting the defendant from entering the
plaintiff's place of employment or the day care

facility of the minor children.
5. Prohibiting the defendant from removing,
damaging, destroying or selling property Jointly
owned by the parties or owned solely by the
plaintiff.
6, Granting possession of the home located at 57
E. Penn Street, Carlisle, Cumberland County,
Pennsylvania, to the plaintiff to the exclusion of
the defendant pending a finel order in this
matter,
7, Ordering the defendant to stay away from any
other residence the plaintiff may establish.
8. Confirming that the Custody Order entered on
December 1, 1994, remains in full force and
effect.
B. Schedule a hearing in accordance with the provisions of
the "Protection from Abuse Act," and, after such hearing, enter
an order to be in effect for a period of one year:
1. Ordering the defendant to refrain from
abusing the plaintiff or placing her in fear of
abuse.
2, Ordering the defendant to refrain from heving
any direct or indirect contact with the plaintiff
including, but not limited to, telephone and
written communications, except to facilitate

custody arrangements which shall be done through
written communication by the defendant,
3, Ordering the defendant to refrain from
harassing and stalking the plaintiff and from
harassing the plaintiff's relatives and the minor
children.
4. Prohibiting the defendant from entering the

5, Prohibiting the defendant from removing,
damaging, destroying or selling property jointly
owned by the parties or owned solely by the
plaintiff.
6, Granting possession of the home located at 57
E, Penn street, Carlisle, Cumberland County,
Pennsylvania, to the plaintiff to the exclusion of
the defendant.
7, Ordering the defendant to stay away from any
other residence the plaintiff may establish.

9. Ordering the defendant to reimburse the
plaintiff's out-of-pocket losses suffered es a
result of the abuse including but not limited to

reimburse one of Legal Services, Ino.'s funding
sources for the cost of litigating this case.
The plaintiff further asks that this Petition be filed and
served without payment of fees and costs by the plaintiff,
pending a further order at the hearing, and that certified copies
of this Petition and Order be delivered to the Carlisle and East
Pennsboro Police Departments which have jurisdiction to enforce
this Order,

AFFIDAVIT RIDER CONTAINING PROBABLE CAUU FOR THE ISSUANCE OF A WARRANT OF ARREST

On 6 Jur. 95 at 0620 hrs I(Ptlm David B, SMith) along with PIt Cohick & Cpl Griest
were dispatched to 524 First St. for a domestic dispute. Upon arrival we observed a James
Nyreo standing outside of the residence.
Cpl Griest spoke with James who stated he was cut with a kitchen knife on the
Left hand.He also sustained scratches under both eyes and a scratch on his left chest
area.He stated he was assualted by his wife Tamara Nyero.
I spoke with Tamara Nyero who stated while they were arguing James had struck her
in her stomach area twice.He then l~nched her in her chest.She stated she had recently
had surgery to her chest area.She then was taken things onto the front porch for James to load
in the car.At this time he then turned around and grabbed her and struck her in the mouth
area.She was bleeding from her mouth.
On 1 Dec 94 a Protection From Abuse Order was placed into effect by the Honarable
Kevin A Hess.Stated James shall not Abu~e Trunara.Copy Attached.
Filed on Information recieved ~rom James & Tamara Nyero & Marlene Palmer(witness).
I feel this is sufficent Probable Cause for a warrant of Arrest for the Accused for
Simple Assualt Domestic Violence violation of Pa Crimes Code 2701 a1.
Also Violation of the Protection From Abuse Order enacted by Honarable
Kevin A. Hess.

1, The defendant, James A, Nyero, is enjoined from physically abusing
the plaintiff, Tamara N, Nyero, and/or from placing her in fear of abuse.
2. The dcfendant Is ordered to refrain from harassing and stalking the
plaintiff.
3, This Order shall remain in effect for a period of one year.
4, The East Pennsboro Township and carlisle Police Departments shall be
provided with certified copies of this Order by the plaintiff's attorney and may
enforce this Order by arrest for Indirect criminal contempt without warrant upon
probable cause that this Order has been violated, whether or not the violation
is committed in the prcsence of the police officer. In the event that an arrest
is made under this sect ion, the defendant shail be taken wi thout unnecessary
delay before the court that issued the order. When that court is unavailable,
the defendant shall be taken before the appropriate district justice, (23 P.S,

result of this incident. The plnintiff contllcted the carlisle
Police Depnrtment.
b. In or about Illte october, 1994, the defendant pushed the
plaint Iff nbout und shoved her to the ground causing her to hit her
head on the sldewnlk. The plaint Iff experienced severe headaches
for approximately one week.
c. In or about mid-October, 1994, the defendant shoved the
plaintiff agllinst the wall and butted his he lid into her n08e. The
plaintiff sought medlcul treutment at the carlisle Hospital. The
plaintiff sustuined a fractured nose us a result of this incident.
d. In or about April, 1993, the defendant punched the pluintiff
In the eye. The plaintiff sustained swelling and bruising about her
eye as u result of this incident.
5. The plaintiff believes und therefore avers thnt she is In Immediate
and present danger of abuse from the defendant and that she is In need of
protection from such abuse.
6. The plaintiff desires thut the defendant be enjoined from harassing
and stalking the plaintiff.

phyaically abusing the plaintiff, Tamara N. Nyero, or from
placing her in fear of abuse.
2. The defendant is enjoined from having any direct or
indirect cont.act. wit.h the plaintiff including, but not limited
to, telephone and written communications, except for the limited
purpose of facilitating custody arrangements which shall be done
through written communication by the defendant.
3. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff's
relatives and t.he minor children.
4. The defendant is prohibited from entering the
plaint.iff's place of employment or the day care facilit.y of the
minor children.
5. The defendant. is prohibit.ed from removing, damaging,
destroying or selling any property owned by the plaint.iff or
joint.ly owned by the parties.
6. The defendant. Is excluded from the plaintiff's

residence located at 57 E. Penn Street, Carllsle, Cumberland
County, Pennsylvania I and any other residence the plaintiff may
establish.
7. Confirming that the Custody Order entered on December
I, 1994, remains In full force and effect.
8. The defendant is ordered to reimburse the plaintiff's
out-of-pocket losses suffered as a result of the abuse including
but not limited to the losses listed on the attached Exhibit A,
The total amount of losses shall be reimbursed to the plaintiff
within 60 days after she preaentD the bill to the defendant, An
award under this chapter shall not constitute a bar to litigation
for civil damages for other injuries sustained from the acts of
abuse giving rise to this award.
9. The court costs and fees are waived.
10. This Order shall remain in effect for a period of one
year or until modified or terminated by the Court. The Order can
be extended beyond its original expiration date if the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice that indicates continued
risk of harm to the plaintiff.
11. This Order may subject the defendant to: i) arrest
under 23 Pa.C.S. ~6113; il) a private criminal complaint under 23
Pa.C.S. ~6113.1; ili) a charge of indirect criminal contempt
under 23 Pa.C.S. ~6114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00; and iv) civil contempt
