CCHPLAINT
Plaintiff, Mark Nesselrode, by his attorneys, Broujos, Gilroy &
Houston, P.C., sets forth the following:

Plaintiff, Mark Nesselrode, is an adult individual residing at
13880 Paseo Zaldivar, San Diego, California.
2
Defendants, John Kaminski and Barbara Kaminski, are adult
individuals residing at P.O. Box 512 Grand Rapids, Minnesota.

Plaintiff and his wife, Martha Nesselrode, entered into a Lease
Agreement with Defendants for the lease of premises at 105 Fairway
Drive, Carlisle, PA. A copy of said Lease Agreement is attached
hereto and marked Exhibi t "A".

By the terms of said Lease, Plaintiffs were to occupy the mentioned
premises from August 1, 1993 to August 1, 1994.

Pursuant to the terms of the Lease, Plaintiff made a payment to the
Defendants in the amount of $2,000.00 which represented security
deposit .

Pursuant to Paragraph 10 of the Lease, the "Military Clause" was in
effect during the term of the Lease whereby the Plaintiff could
terminate the lease upon Plaintiff being advised that he was
required to relocate from the Carlsile area by virtue of military
orders.

By letter of May 23, 1994, Plaintiff advised Defendants that .he was
required to move from the Carlsile area and that he would vacate
the premises which is the subject of the lease on or before July 1,
1994. A copy of said letter is attached hereto and marked Exhibit

Plaintiff surrendered possession of the mentioned real estate on or
about June 24, 1994 at which time the property was delivered to
Richard Kuhn, the real estate agent for Defendants, and said
property was delivered in a clean and orderly condition.

By virtue of Plaintiff's May 23, 1994 letter to Defendants,
Plaintiff advised Defendants of Plaintiff's future mailing address.
