WHEREAS the said parties hove by 0 duly executed Agreement under seal. bearing even date herewith,
enlered into 0 wriaen cnntracl forthe excavation on 0 portion of the premises, abd the construction and completio
of 0 sleel frame addition and a sewage plant to be er..ted on the lot of ground situate at 720 Green Spring Road,
Newville, Cumberland County, Pennsylvania,
NOW THIS AGREEMENT WITNESSETH: That the Conlractor for and in consideration of the
conlract aforesaid and the consideration mentioned dlCreundcr, as well as the further consideration of One ($1.00)
Dollar to him in hand paid by the Owner nt or hefore the sealing and delivery of these presenls, the receipt
whereof is hereby acknowledged, docs hereby covenant. promise, nnd agree that no mechnnics' lien or claim or
olher lien or claim of any kind whatsoever sholl he tiled or mainlained againsllhe said building or buildings or
the curtilage or curtilages appurtenanttheretn. hy Conlractor or hy any sub-contractor, mnterialmen, or laborers
for work done, or materials furnished under said contract or by any other party acting through or under them or
any of them for and ahout said building or buildings or any port thereof, or on credit thereof, and that all sub-
contractors, materialmen and laborers on said work shaillook to and hold Contraclor personally liable for all sub.
contracts. materials furnished and work and labor done, so thai there sholl not be any legal or lawful claim of any
kind whatever against Owner for any work done or labor or male rials furnished under said contract for and about
the erection, construction, and com pie lion of said buildings as aforesaid, or under any conlracl for extra work or
for work supplemental thereto or otherwise.
AND this agreemenl waiving the right of lien shail be on independentcovenanl and sholl operate and be
effective os well with respect to work done and materials furnished under nny supplemental contracl for extm
work in lhe erection, construction, and completion of the said building or buildings as any work nnd labor done
and malerials fumlsbed under the contmct afotesaid,
AND,'in orderto give the Ownerfuil power and authority to protect himself and the lot or 10lS of ground
against any and 011 claims tiled by the Contractor or nnyone ncting under or through him or it in violation of the
foregoing covenant, the sold Contraclor for himself, themselves, itself, hereby irrevocnbly aUlhorizes 1WI
empowers any Attorney of any Court of Commnn Pleas of the Commonwealth of Pennsylvania, to appear for
him, them, it or any of them, in any of the said Courts of Common Pleas as Attorney for him, them, or it 1WI
In him, dlelr, its, name, mark satistied of record at the cost and expense of the Contractor or of any Sub.
Coatraclor or Materialman, or Materialmen. any and ail clnlms or claim, lien or lien. tiled by or for the
Contractor, or any Sub-Contractor or Materiqlman, or In his or Iheir nnme agninst snid building or buildings, lot
or 10ls of ground or nny pnrt thereof nnd for such net, or acts this shnll be good nnd suftieienl warranllWl
authority, and a reference to the Court, Tenn and Number in which and where this Agreement shall hove been
tiled sholl be 0 sufficient exhibit of the AUlhority herein conlained to warrant such aClion, and the Contractor for
himself, themselves, itself, do hereby remise, release and quil.claim ail rights and 011 manner of errors, defects
and Imperfections whatsoever in entering such salisfaction or in anywise touching or concerning the same.
