Denr Board Member,
please consider this my formal request for a sabbatical leave
for the 1994-95 school year for the purpose of study.
It should be understood that Dr. Cain has informe~ me that
the law with regard to sabbaticals does not provide me with
entitlement, due to the fact that my experience prior to
serving at Camp lIill was in private, not public, education.
1I0wever, upon consultation with an attorney, It is my perception
that the law allows sufficient latitude for the board to
grant me a sabbatical in this particular case.
Whereas, I have anticipated that the ensuing discussion with
regard to fuY case will no doubt focus on the problem with
setting a dangerous precedent for the future, please allow
me to herein present the uniqueness of my case.

12 With regard to the validity of private school teaching
experience in public school policy;
a. On the 18th day of July 1988, I was issued a contract
by the Camp lIi11 School Board. My salary was calculated
based on "Class II, Step 8" criterion. This would translate
in touay's contract language as being given 2 years credit
for my private school experience. (i.e. the Camp lIill District
has in fact dispersed funds for prior private school
experience. )
b. In May of 1992, the Pennsylvania Department of Education
granted me permanent Professional Certification based on
my being observed teaching in the very private school where
I was employed 4 years prior to my coming to Camp lIill.
Finally, while exploring my options, I recently enrolled
at Millersville University in their elementary education
certification program. I have been assured by Millersville
that scheduling of courses will not hinder me from attaining
elementary certification by August of 1995. Therefore, I
would greatly appreciate and am formally requesting that
the Board reserve a position for me in elementary education
for the 1995-96 school year, by offering the current open
position as a one year contract. I love working with young
children and hope to continue serving the parents of the
camp lIi11 School Dis trict.

This is the time set
by the Board of School Directors of the Carup
Hill School District for a hearing with respect
to the recommendation made by the Administration
of the School District that Randy L. Hoffman be
suspended from his employment as a professional
employee of the Camp Hill School District
effective August 28th, 1994 because of
substantial decline in pupil enrollment.
Mr. Daniel Altland has been retained
to represent the School Administration in
presenting its case. Mr. Richard stewart, the
school District's solicitor, has been appointed
to advise the Board on legal matters with
respect to this hearing and to assist the Board
in conducting this hearing. At the Board's
direction Mr. Stewart will preside over the
hearing.

You indicated that you made a
recommendation to furlough based on declining
student enrollment.
How did the declining
enrollment situation come to your attention?
A Well. primarily through my study of
this document, that is Administration
Exhibit 1. 1I1so it was really brought home
forcefully when we prepared the master schedule

for the junior/senior high school for 1994-95.
Q could you just explain briefly how
it was brought home forcefully to your attention
at that point?
A The process of constructing the
master schedule essentially involves students
electing the courses that they're going to take
for the following year and based upon those
elections, those numbers, then those students
are divided into classes.
Then those classes
are weighed across teachers' schedules. And
when we went through that process for the 94-95
school year we found that there were several
teachers for whom we did not have classes.

Who would those teachers be?
The teachers were Mr. Hoffman,
Ms. Valerie Davis, also a reduction for Mrs. Sue
Newton, for Mr. Ray White and also for a
longterm substitute in the area of physical
education and in addition Ms. Christy Sheaffer
in the English department.
Q Were all of those lack of classes
for the teachers in the high school?

refresh your recollection as to the date when
the Board acted on your recommendation with
respect to the furloughs?
A Yes. That action was taken at the
June 20, 1994 meeting.

Then referring your attention to
Exhibit 7, a letter dated June 21 of 1994 that's
from the school Board to Mr. Hoffman relating to
the Board of Directors' action on June 20th of
1994, did you also retrieve a copy of that
letter from the personnel file of Mr. Hoffman?

And in the letter it indicates that
there would be a suspension or furlough
effective August 28th, 1994 because of a
substantial decrease in pupil enrollment unless
there was a request for a hearing received no
later than July 6th of 1994; is that correct?

Mr. Hoffman make a timely request for a hearing
to be held?

the need for one less person in science than it
was in the other areas.

After having the discussion with
Mr. Hoffman on May 11th, 1994 concerning his
impending furlough did you receive any
information from any other school districts as
to possible jobs that would be available to him?
A Yes. I was contacted by Dr. winston
Cleland of the West Perry School District, and
he told me that he had heard that we would be
furloughing some people and he said that their
enrollment was increasing and they would be
hiring some people and they needed someone who
had a certificate in biology and chemistry.
Q Did you relay that information to
Mr. Hoffman?

Do you recall when that was?
No.
I would think it was a week,
maybe two after that meeting with him.

In any event, it would have been
before June 21 when he received the letter?
A

MR. HOFFMAN:
All right.
I have
tried to get a teaching position elsewhere. I
was really not certain after our conversation.
Dr. Cain, back on, I guess, May 11th. There has
been ,..lot of mixed me8sage~ to me from the time
a student mentioned -- the day before we had our
conversation a student, an 8th grade student,
said, Mr. Hoffman, is it true you got fired from
just yesterday?
People have been consoling me, and
it's taken a great amount of time to deal with
this whole situation. It also took a great
amount of time to apply for the many jobs that I
applied for. Back during the time that the West
Perry comment was made Dr. Cain had sent a note

to call Cheryl, the secretary, over to my box.
I had a class. I went up and when I had a free
period I was walking down to call Cheryl and met
Dr. Ca in in the ha 11. I wondered what the
message was about and he conveyed to me that
there was an opening in West Perry. So I kept
that under my hat and I -- two other girls, Val
Davis and Christy sheaffer, were also apparently
told there were positions there.
There was another position that I
had heard about at Mechanicsburg, which was much
closer to me.
West Perry is over an hour
drive.
If you have ever been up over Wagner's
Gap it's very, very steep. It's a 20 mile per
hour limit for trucks going down. I weighed the
fact of West Perry versus Mechanicsburg.
Mechanicsburg is eight minutes from my home. So
I pursued Mechanicsburg before I pursued West
Perry.
I don't know if -- you're probably
familiar with the basic things that are required
in applying to a school district. For instance,
you need to have police check clearance. And
when I applied for that they logged it in and
they logged it out and it took 27 days for them

great deal of time for a teacher to go through
this process, to apply to other schoolsJ A
tenured employee such as myself with twelve
years experience in education, it's very
difficult -- I know Dr. Cain and -- we all have
to deal with budgets, and it's very difficult
for a Board to come to the conclusion that they
should hire a teacher that is. for an estimate.
$10,000 more expensive than a teacher right out
of college.
I have applied at -- I have the list
there -- the Milton Hershey School, the Hershey
School. South Middleton. cumberland Valley. We
called carlisle because of a newspaper article
we read that they were going to be hiring a
chemistry teacher. We read the newspaper
article and the secretary said. well, that
hasn't even been posted yet. We have furloughed
teachers that we must invite back before you.
So they never sent us an application.

as I stated earlier, West Shore, Bermudian
Springs.
Transcripts were also sent to Northern
and Big Sprillg.
Although they didn't have any
positiolls, I thought something might open up and
I thought I would get the jump on that because
that's a timely process getting that out.
'tlo I am appellling to you. I'
understand from the contract that I do have a ,
valid contract, having not been notified by th~
deadline of June 1. 11 believe that I did make
an honest effort to acquire a teaching
position.
I was given an interview at Hershey,
and I appreciate Dr. Cain having given me that
lead.
I might also add that by the time that I
had
the door had closed at Mechanicsburg I
did ask Christy and Val about their success at
West Perry, and they had said that the deadline
was June 1 and that they were denied positions
at West Perry.
So that was more reason not to
pursue West Perry.
I would like to have a win-win
attitude in everything that I do.
I don't look
at this conference as being an adversarial one.

entitled to it, but that it never hurts to ask
because the Board does have the power to grant a
sabbatical in a case such as this.
I stated before I believe that I
have a valid contract to come back next year,
but understand the dilemma you're in. What are
you going to do with me? You have already done
with the schedule and all. On the other hand, I
don't feel that just walking away from Camp Hill
is -- I think that's the other extreme, because
I really have come to love the people here and I
have made life-long friends and family here,
really. I would like to continue serving the
community as a teacher. I believe that if I was
granted a sabbatical for this year that I could
accomplish that goal of being certified come
September of the 95-96 school year.
I also believe that having had some
experience with the 5th and 6th grade, I do the
gifted program for Camp Hill. The 5th and 6th
graders came up from the elementary school and
came to my high school room and I taught them
science. And I enjoyed that age group. I just
came from a family conference where I was -- I
did a little bit of praetical experimentation

A perRon asked me to run the activities
for this family conference and I was reRponsible
for 100 H through 6th graders. I had some
volunteers, but it went quite well. It was
three hours a day for three daYR with that age
group, and I really enjoy that age group.
I have four children who are in that
age group. Next year Andrea will be a
kindergartener. Maria will be a second grader.
Josiah will be a 4th grader and Kendra will be a
6th grader. So I look forward to going back and
studying elementary education and coming home
and being able to have practical lab experiences
in my home with my children.
I believe that I could bring a great
wealth of expertise into the elementary program
at Camp Hill. I was discussing this with a
colleague, and the gentleman said that, wow,
there really aren't too many elementary scienee
people with your background.
You could be a
very -- I don't know -- prominent, I'm not sure
exactly the words that you use, like a showpiece
or something like that for the District because,
as we know, science is important and it may
benefit the District for me to be in the

CROSS-EXAMINATION

Q Mr. Hoffman, am I understanding
correct then that in order to teach elementary
science you have to have an elementary
certification; is that correct?
A I went to do some research. I was
just looking for a copy of the Pennsylvania
of the Public Code and quite by coincidence I
saw a man standing at the elevator.
He said,
oh, I'll walk you up and give you a copy. And
it turned out that he was like the third man
from the top. He is the assistant -- I hope I
get this right. He's the Assistant Director of
Secondary Elementary Education for the state.
He conveyed to me at that time that
emergency certificates are often given in
situations like this and if Dr. Cain -- he said
but it really does count on the superintendent.
He said that if Dr. Cain would -- that he would
see that the proper channels would be met and
that he felt confident that I could obtain an
emergency certificate in the same year.

It did not sayan that particular
document but, again. on consultation with the
attorneys they conveyed to me that something
this official should be. I did look through the
Public School Code, and you can check me on
this, but I believe it does say that it should
be in writing.
Well, I would disagree with you on

Q But you do admit that on May 11th
Dr. Cain did tell you that your furlough was

interesting that Dr. Cain had brought that up in
his previous comment.

districts that called you?
DR. CAIN:
Yes.

Because when I discovered that there
was a position just eight miles away both
these positions are very, very far. It would
probably necessitate me relocating and uprooting
my family. I have grandparents who are 78 and
85. I had an opportunity to stay in Arizona
where I did my undergraduate work. I really
like the climate there, but for family I decided
to move back into the area.
Both those jobs
would necessitate relocation.
I did knock on the door at
Mechanicsburg and South Middleton. If I could
elaborate on the South Middleton experience, we
had called South Middleton because it was
close.
It's, again, about an 8 or 9 minute
drive from my house, closer than Camp Hill. We

for. And, again, I knew he didn't have the
authority, it's the Board that has the authority
to hire, but my spirit was lifted.
I filled out the application
promptly and brought it back, and I discovered
that there wasn't one but two openings in 8th
grade physical science. One was all 8th grade,
half physical science and 7th grade life
Bcience. I filled out my application. There
was a big checklist. Do you happen to have a
copy of that checklist? I don't want to belabor
the point, but there was a big, long checklist,
all the things I had to do. It was one of the
more thorough applications. I went through all
of that and was guaranteed or granted -- I am
sorry, granted an interview with them.
So I went to the interview.
Mr. Andrejak, the principal, was there and
Mr. Mills was there and the assistant principal
whose name I can't recall, and they interviewed

I wanted to
know if I should prepare or not for this.
I had
prepared. I had gone with my son and made some
-- it was a lesson on gravitation. I had made
some object lesson things and was prepared, but
I wanted to make the last minute preparations.
I had acquired the textbook because the handouts
they had given me were incomplete.
The cover letter said certain things
would be included and they weren't. So I
acquired the text, and I was all ready. I
called on Thursday afternoon and Mr. Andrejak
said, I am sorry, you didn't make the cutoff.
We're not going to offer you a second
interview.
So my heart really dropped there.
I
was granted also an interview with Dr. Hasson at
Hershey and also given a rejection letter from
them as well as the others that I had
mentioned.

Dear Members of the Board,
Sec. 1125.1 of the Public School Code of 1949 states, "suspended
professional employes... shall be reinstated on the basis of
their seniority within the school entity. No new appointment
shall be made while there is such a suspended or demoted
professional employe available who is properly certified to
fill such a vacancy."
I understand that due to a miscalculation by the superintendent,
the recent furlough of teachers in the Camp Hill Jr./Sr. High
School has resulted in a shortage of certified teachers
particularly in the area of study halls.
I believe that my vast experience across the curriculum in
secondary education makes me a prime candidate for the study
hall teaching position and any other positions for which I may
be qualified to serve. In additiion to study halls, all of our
sciences (except for Earth and Physics), suspension room, on
call and Gifted Education, I am certified to teach study skills,
Guidance/Drug and /\lcohol, Computer Education, Distance Ed.,
vocational Ed. Learning Facilitator, /\t-Risk Student Programs,
Teen Parenting Programs and any other program of study that
requires only the Instructional II certificate.
I might add that having taught study halls at Camp Hill for
the past 6 years, I have taken anything but a passive role.
I have helped students who have requested my assistance in areas
from Math and Science to interpersonal relationships. I have
consistently enforced the rules of conduct set forth by the
administration and am confident that the students I have had
would say that I run a "tight ship". /\s was stated earlier,
(on /\ugust 18th at the hearing and on Sept. 13th by certified
letter), I have no job and am available for work.

The 1994-95 academic year began with three days ot teacher
in-service. On day three ot in-service, Auqust 31, a senior high
taculty meeting was held at the high school. Ors. Lonardi and
Cain tacilitated this meeting. Oepart~ent meetings tollowed.
Additionally, Mr. Yeager and Dr. Lonar1i ~3cilitated the 7th
grade orientation meeting later tha~ day.
3tudants rgeur~ed :~ 5chcol on 3ep~a~=er 1. 139~. The
opening days were surprisingly calm considering the institution
ot a new computer schedule and the absence ot a high school
principal. Ors. Cain and Lonardi have been acting as building
principals and will continue to do so until the new principal
arrives.
rACULTY SCHEDULES
Several changes in taculty schedules were necessary in order
to relieve contlicts and preserve contract quidelines. These
changes were completed by the end of week one. Mr. Greg Herb has
been added to the taculty as permanent substitute, and to date,
has been particularly helptul covering study halls and sports
dismissals. AlSO, Mr. John Judge and ~ore recently, Mr. James
Campbell, have been SUbstituting in the business department until
our permanent teacher arrives. Mrs. Anastasio and Mrs. Sabatino
are working continuously with the substitutes so that students do
not tall behind during this interim.
STOD~ SCHEDULES
Guidance counselors have been making changes to students
schedules since school began. They have just about completed
these changes and have designated Wednesday, September 14, 1994
as the tinal day for student schedule changes. Although most
individual problems have been resolved, there continues to be a
problem scheduling time for non-business subjects (eg. math) to
use the computer room. When all room changes have been
completed, this problem will be attended to, and hopefully,
resolved.
The quidance department reported three classes (English - 9,
World History - 11, and Reading Lab - 9-12) that had more than 30
students scheduled in the class. To date, two of the three have
been resolved.

approved leave of absence which does not exceed 15 consecutive
school days in a single assignment.
2. The employment of an appropriately certified subatitute ia authorized
when an aaaignment is temporarily open, but not vacated, due to the
absence of an incumbent temporory profesaional or professionsl employe.
All substitutes are required to hold proper certification for all
classes they teach.

3. A vacancy (created as a new position or by the resignation, termination,
retirement or death of on incumbent) requires the employment of a
qualified and appropriately certified person as a temporary professional
or professional employee. 1I0wever, a vacancy may be filled by employing
a substitute while a seorch ia conducted for a certified and qualified
person. In this inatance the Department recommenda that such vacancies
be filled within three (3) months unless the three month period will
expire close to the end of the instructional year and (i) replacement
of the incumbent substitute will create a detrimental disruption of
program continui.ty for pupils, (ii) the position is scheduled to be
aboliahed at the end of the inatructional year, or (iii) reasons exist
which evidence that extenaion will serve the best interests of the pupils
involved. In such instances decisions regarding the position rest with
the local board of school directora.

In a letter signed by lhe President and Secretary of the Camp Hill School Board and
dated June 21,1994, Ms. Valarle Davis (now Ms. Valarie Mayle) was advised that on June
20, 1994, the Board of School Directors of the Camp Hill School District acted to suspend
(furlough) her from employment with the district effective August 28, 1994. Section 1124
of the School Code (24 P.S. ~11.1124) enumerates the only causes for suspension
(furlough) of professional employes In Pennsylvania public schools. Consistent wilh those
criteria, Ms. Mayle was advised that her suspension was a result of a substantial decrease
In pupil enrollment.
Pursuant to the requlremenls of lhe Local Agency Law, Ms. Mayle was offered a hearing
before the Board of School Directors. Ms. Mayle waived her right to a hearing and
accepled her suspension (furlough) as a professional employe.
Section 1125.1 of the School Code (24 P.S. ~11.1125.1) specifies the procedures for the
suspension of professional employes and the recall rights of suspended employes.
Section 1125.1 (d)(2) provides.
Suspended professIonal employes or professIonal employes demoted for
the reasons set forth In section 1124 shall be reInstated on the basIs of
theIr senIorIty wIthIn the schoo/en/lty. No new aoooln/ment shall be made
while there Is such a susoended or demoted orofesslonal emo/ove
available who Is orooerlv certillcated to fill such vacancv. For the purpose
of thIs subsection, posItions from whIch professIonal employes are on
approved leaves of absence shall also be consIdered temporary
vacancIes. [Emphasis added.)
It has come to our attention that the Camp Hill School District has recently created a new
professional position that can best be described as a study halls teacher who also is
assigned (and paid) for various other substituting assignments during the school day
when he Is not supervising a study hall.

i Guidelines provides In CSPG No. 80 that,
~oroorlate Pennsylvania certl/lcatlon Is required of all persons who during the school day
are assigned duties and functions Involving: (I) responsibility for direct Interaction with
pupils In curricular activities or In pupil personnel services; (/I) selection of learning
materials and the planning or conduct of loarnlng experiences. or (III) dlrectfon of other
professlonaf-Ievel. certl/lcated staff Involved In the kind of activities described In this CSPG.
In order to allow the time students are assigned to these study periods to be counted as
Instructional time (24 P.S. ~ 15-1504), It Is required that an Individual with appropriate
, Pennsylvania certification be assigned to supervise the study hall.
Ms. Mayle's Social Studies certification (7-12) Is appropriate certification for assignment
as the sludy hall teacher.
Consequently, Ms. Mayle Is hereby formally asserting her right pursuant to Section
1125.1 of the School Code to fill this newly created vacancy for which she Is
properly certificated.
The school district's attention Is called to the decision of the Pennsylvania Commonwealth
Court In Pickup v Sharon City School District [86 Pa Cmwlth 630, 486 A(2d)543 (1985)].
In that case, the court held that a suspended professional employee has the right to
return to long.term temporary vacancies and that the reinstated employee will be
considered to be a professional employee during the term or reinstatement. The court
additionally held that the reinstated employee Is entitled to the benefits and wages set
forth In the collective bargaining agreement governing professional employees.
It Is respectfully suggested that Ms. Mayle be Immediately offered reinstatement as the
study hall teacher.'i\ While It Is apparent that she may very well be entitled to back
compensation for the period between now and when the new position was created to
which she Is so clearly entitled, that Issue will not be pursued If her reinstatement Is
Immediate.

This Agreement, made and entered between CAMP HILL SCHOOl DISTRICT, a School

WHEREAS, Association has been certllled by the Pennsylvania Labor Ralations Board
as exclusive representative lor a bargaining unit comprised 01 !III teachers, nurses,

NOW. THEREFORE, the parties agree as lollows:

DEFINITIONS
1. 'Board' shall mean the Board 01 School Directors 01 Camp Hili School District.
2. 'Employee' or 'Prolesslonal Employee' shall mean a member 01 the said

SCOPE OF AGREEMENT
1. The parties acknowledge that this Agreement represents the results 01 collective
negotlatlons between them conducted In accordence with the provisions 01 the Public
Employes Rslatlons Act and constitutes the entlre agreement between the parties lor the
duration 01 the Agreement, each party waiving the right to bargain collectively with the
other on any subJect, matter or thing. whether speclllcally covered herein or wholly
omitted hsrelrom and Irrespective 01 whether said subject was mentioned or discussed
during the negotiations preceding the execution 01 this Agreement.
2. The Parties may mutually agree to renegotiate a provision 01 this Agreement
during Its term provided that the consent 01 the parties to renegollate Is given In writing
and that a refusal to renegotiate by either party shall be Ilnal and not subject to the
grievance procedure.
3. The parties may conduct negotlatlons during the term hereol with a view to the
reaching 01 an agreement to become effective alter the date 01 expiration 01 this Agreement
<t. There shall be no strike. as that term Is defined under the Public Employee
Relallons Act, during the IIle 01 this Agreement, or shall any olllcer, representative or
official 01 the Association authorize, assist or encourage any such strike during the IlIe 01
this Agreement.
5. The School District shall not order or engage In any lockout during the lIIe 01 this
Agreement.
6. This Agreement pertolns only to those Prolesslonal Employaes lalllng within the
classlllcallon 01 the certlllcatlon relerred to In the premises.
III.
RIGHTS AND RESPONSII:lILITIES OF THE ASSOCIATiON
1. The School District shall deduct unllled membership dues 01 the Association Irom
the salaries 01 Prolesslonal Employees In ten (10) equal Installments beginning with the
first pay 01' the new contractual salary year. and shall transmit the total amount so
deducted to the Association within thirty (30) days. provided that the Bosrd has been
presented with the cards signed by lhs Individual Prolesslonal Employees authorizing such
deductions.
2. The Association shall Indemnlly. delend and save harmless the School District
against any and all claims, demands, costs, lees. expensas arising out 01 suits or other
lorms 01 liability that may arise out 01 or by reason 01 action token by the School District
In reliance upon the payroll deduction authorlzallon cards submitted by the Association to
the School District. provided such action taken Is that which Is authorlzad by ths cards.
3. The making 01 deductions by the School District shall be conditioned upon the
receipt by the District Irom the Association 01 the signed authorization cards at least two
(2) weeks prior to the IIrst deduction.

5. All employees who are members 01 the Camp Hili Education Association and who
desire to terminate payroll dsductlon 01 dues, must give written notice to the Secretary 01
the Board In the Business Office and the Association President at least two (2) weeks prior
to the first deducllon. ,
6. Whenever any representative 01 the Association or any Employee Is mutually
scheduled by the partie' to participate during working hours In conlerences or meellngs
relating to' AssOciation business; he shall suRer no loss In pay, and shall be provided with
released time Irom his regular dutlss. Grievance procedures and negotiations. however,
shall not be conducted during Employee's scheduled class time or scheduled supervisory
responsibilities unless the administrative oflJcers 01 the ~istrict order otherwise.
7. The Association and Its representatives shall nonnally be allowed the reasonable
use 01 school buildings lor meetings alter school hours and during In-service days outside
scheduled programs. Arrangements lor such meetings shall be made with the Principal 01
the building In which the meeting Is planned or with the staR member In charge 01 such
building.
B. The School District shall permit the President 01 the Association or his designee a
total 01 t1free (3) work.scheduled days with pay II needed per semester to carry out
Association business. The Assoclallon shall reimburse the School District lor the cost 01
substitutes employed to replace the President or his designee while on such leave when

IV.
QEHERAl CONDITIONS OF EMPLOYMENT
1. A Prolesslonal Employee may be disciplined. reprimanded In writing, reduced In
rank or compeneatlon or discharged lor Just cause only.
2. Whenever any Prolesslonel Employee Is required to appear belore the
Superintendent. Board, Committee or Member theraolto answer charges. the resolution 01
which may a<<ect tenure, he shall be entitled to prior written notice and permitted to have
. a representative 01 the Association or legal counsal present to advise him and represent
him during such meeting or Intarvlew. In the event that a Prolesslonal Employee Is
auspended pending a decision on said charges, then the Prolesslonal Employee shall be
entitled to eny delerred or accrued earnings up to the data 01 such suspension. Such
earnings shall be paid at the next regular pay period.

3. An Employee shall have the right to review the contents 01 his personnel file In
confidence at any reasonable time alter reasonable notice. In the presence 01 the
Superintendent or his designee, and shall have the right to have a copy 01 any document
therein made at cost. An Employee shall be entitled to have a representatlva 01 the
Asaoclatlon accompany him during such review. Roasonable notice shall be deemed to mean
a period 01 not more than lorty-elght (48) hours.

4. No material darogatory to an Employae's conduct, service, character or
personality shall be placed In his personnel file unless the Employee has had an
opportunity to review the material. The Employee shall also have the right to submit a
written answer to such material and his answer shall be attached to the lIIe copy.
5. An Employee shall be entitled to have deducted from his salary In addlllon to
deductions authorized or required by law and by this Agreement, any or all 01 the lollowlng:
a, Tax-sheltered Annuity
b. Unitad Way Contribution
c. Blue Cross and Blue Shield coverage In excess 01 that paid by the District.
d. United States Government Savings Bonds
e. West Shore Teachers Federal Credll Union
All changes 01 daductlons shall be provided to the Business Olllce two (2) weeks prior to
the beginning 01 each quarter. Authorization lor any such deduction shall be on a lorm
approved by the School District. The balance 01 remaining lunds may be automatically
wired to the bank or credll union 01 the employees choice. The emploYGa shall be IImlled to
having these lunds sent to only two different financial Institutions.
~ 6. Notification 01 complaints - Any complaint regarding any Employee made to any
member oltl1e administration 01 the School District by any parent. student or othsr person
' which may be used In any manner In evaluating an Employee shall be promptly Investigated
and called to the attention 01 the Employee. The Employee shall be given an opportunity to
l respond to or rebut any such complaint.

5. Teachers shall rscelve a complimentary non-Iranslerable pass for two (2)

be on a IIrst-come, Ilrat-selVe basis, as It Is with the general public. Provisions of this
Article do not apply 10 those student clubs or class-sponsored acllvllles which are Intended
to ralss funds lor the respecllve groups.
6. A fund shall be malnlalned at each school lor purchass of minor lIems approved by
the Principal. Receipts lor lIems purchased shall be provided lor all expenditures.
7. Travel required In the Job assignment, except during lunch. shall be reimbursed
atlhe rate equal 10 the maximum mlleags rate as established Irom lime to lime by
Pennsylvania Leglslallon lor public school districts or $.75 per teaching day, at the opllon
01 the Employed (II reimbursement Is requested). The exception lor lunch Is provided we
have a lunch period that Is longer than 30 minutes, otherwise the reimbursement will be
opllonal with the Individual.
8. To lacllltete teacher planning, teachers shall ba informad 01 the deletion of Items
Irom their respecllve requlslllons wllhin thirty (30) days lollowlng the adopllon 01 the
budgat.
9. Teechers normally shall receive written ,nollce 01 their assignments lor the
forthcoming year no later than June 1 and a leniiiifvascfiedule by August 15. Any changes
made necessary due 10 unloreseen circumstances or altered conditions shall be made known
to the teacher alfected wllh dispatch.

10. A request by an Employee lor transler to a dlllerent class, building or poslllon
shall be mede In wrlllng to the Superintendent through the Principal. The Employee will
set lorth the resson lor the transler or position sought and his quallflcallons. The
superintendent shall acknowledge receIpt 01 the request In wrlllng within five (5)
working days. The decision 01 the Board on any translers shall be nnal and binding. The
affected Employea shall be nollliad 01 this decision In wrlllng promplly.
11. The district shall provide reasonably prompt notice 01 a vacancy In any
prolesslonal position by memo to the stall. Any Prolesslonal Employee may apply lor such
vacancy. The decision by the Board on the filling 01 any such vacancy shall be final and
binding.
12. Prolesslonal Employees shall attend the listed acllvllles, usually held outside the
normal school day. as spectned below. Exceptions will be absence lor Illness or by prior
administrative approval lor a school-related activity.

15. In the Interest 01 lunch time supervision. extra-duty poslllons will be available
In each of the schools. All stall membere that work In a given building may be asslgnad a
maximum of one twenty (20) minute duty per week during the lunch period provided that:
a. Stall Is assigned on an equal basis.
b. Each stall member Is provided with a lunch period In accordance
with the school code.
c. The stall shall be solicited as to their prelerence lor serving this
lime.

SUPPLEMENTARY EMPLOYMENT
1. Certain regularly assigned Employees may be offered work on special profects
such as curriculum development conducted outside the school year as previously defined.
Such offer by the School District wUllnclude specific economic conditions 01 employment.

2. The School District reserves the right to withhold any remunerallon under
supplemental contracts upon the recommendation 01 the Principal and the Superintendent

3. Aemuneratlon lor the prolesslonal service provided In the operallon of the
summer school shall be the same as outlined In VI-l ebove: 522.00 for contract year
1993-94; 523.00 for contract year 1994.95; 524.00 for contract yeer 1995-96. For
every three (3) hours 01 teechlng, one (1) hour shall be allotted for planning, preparallon
and recordkeeplng.
VII.
PROFESSiONAL LF.AVES
1. Any unused sick leave shall be accumulallve from year to year In the School
District wlthoutllmllation. All or any part of such accumulated unused leave may be taken
with lull pay In anyone or more school years. Sick leave will be accumulated at the rate of
ten (10) days per year except that during the IIrst year 01 employment In the School
District. an Employee who does not have ten (10) days accumulated sick leave shall be
enlltled to an addlllonal live (5) days 01 sick leave which shall be velld during that year
only. '
2. In case 01 death In the Immediate lamlly. a Professional Employee shall be allowed
to be absent with pay from the date of death to the morning 01 the second school day
following the burial. provided that not more than live (5) days wIll be allowed In anyone
Instance. The Immediate family shall be construed to Include: parent. brother, sister.
wile, husband, lion. daughter. parent-In-law, or any person living In the Immediate
household.
3. In case of death 01 a near relative. which shall be defined as IIrst cousin,
grandlather, grandmother, grandchild, aunt. uncle, niece, nephew. brother-In-law. sister-
In-law, Employee may be absent one (1) day without loss 01 pay to attend the luneral.

4, Maternity Leave - A Prolesslonal Employee shall ba entllled to maternity leave lor
a period not exceeding one (1) year alter the date 01 delivery. The Employee shall request
such leave In writing not less than thirty (30) days prior to commencement 01 leave,
provided that euch notice need not be given II an emergency condition occurs. The
Prolesslonal Employee must conllrm In wrlllng her Intention to resume her employment
by giving at least sixty (60) days notice prior to her scheduled return. II such a leave
terminates on or alter April 15th 01 any year, the Prolesslonsl Employee shall notlly the
School District In writing 01 her Intent to resume employment In Septamber of that year,
and her leave shall ba extended un III the beginning 01 school In September. lithe
Proleeslonal Employee lalls to give such notice, she shall be deemed to have waived her
rlghtll to resume employment and her status as Employee shall be terminated, During
matarnlty leave. the Employee shall retain her unused sick leava, credit toward sabbatical
leave and credit lor past service on her rating card,
6. A Prolesslonal Employee shall be entllled to leave 01 absence totaling two (2) lull
days during the school term. without loss 01 pay, lor reasons 01 personal buslnees,
emergencies or lor voluntary attendance at an educational conlerence. upon written requeet
throught the Principal to the Superintendent.
Further. the Employee may carry over, unused personal leave days Irom one year to
the next yesr,'wlth a maximum carry over 01 two (2) days Into the next year; however,
only a maximum 01 lour (4) days may be used during anyone school year. f.,ny unused
personal leave days In excess 01 two at the end 01 any year will be credited to one's
accumulated sick leave days.
All such leaves 01 absence shall be reported to the Board monthly, No more than ten
(10%) percent 01 the teachers In any given building may receive personal leave on any
teaching day. Elementary buildings shall be allowed at least two on any teaching day.
The Board at the recommendation or the Superintendent may 1T0m time to time
approve attendance of a Professional Employee at an educational workshop, conference,
clinic or convention deemed benellclal 10 the School District. and In such event the
Employee will not be charged with personal leave. Reimbursement for expenses will be on
the basis agreed on at the time 01 approval. Where possible, notice 01 desire to attend a
program will be given by the Employee prior to May 1 of the precadlng year.
6. A teacher subpoenaed to give tesllmony as a wltnsss before any legally constituted
judicial or administrative tribunal. exclusive 01 appearrances for any reason before the
Pennsylvania Labor Relations Board unless requested by the School District, or to sarve on
a legally conslltuted jury. may do so without loss of personal leave, The School District
will pay to the Employee the difference between the lee to which the Employee Is entitled by
reason of such testimony or service and Employee's regular salary,
7. An Employee who Is unable to work because 01 personal Illness or disability and
who has exhausted all available sick leave shall be granted an unpaid leave of absence lor
the durallon 01 such Illness or disability, up to one (1) year, Ind laave may be renewed at
the discretion 01 the Board upon written request by the Employee, It Is expressly
understood that this Section Is contingent upon the Board's IIndlng a suitable replacement.
Any such Employee shall be re-employed alter such leave provided, In the judgement 01 the
Board. he or she Is physically and mentally cop able of performing his or her duties and
there Is a job available lor which he or she Is qualified, No Increments or other benefits
shall accrue during this leave period,

8. Absences due to Injury Incurred In the course of the Professional Employee's
employmenlshall nol be charged against the Professional Employee's sick leave. The
Dlstrlclshall pay to such Employee the difference between his salary and the banefits 10
which he Is entltlod under the Pannsylvanla Workman's Compensation Act for the duration
of such absence not exceadlng one hundred twenty (120) work days.
9. Sharad Sick leeve Benefit: The District will administer this additional sick leave
benefit under the lollowlng condllions:
a. All Individuals shall be eligible to receive donated sick leave days as
contrlbutsd and within the terms 01 this benefit.
b, When an Individual has exhausted all personal sick leave. he/she may
receive donated days up to sixty (60) days per school yesr.
c. Any Individual may contribute Irom his/her accumulated sick leave up to a
maximum of five (5) days per year.
d. All donated sick leave days shall be on a voluntary basis and remain
confidential.
e. No sick leave days donated shall remain In a bank. bul shall be contributed
only as needed.
f, The Association or the District may maks the staff awere 01 such need.
g. A physlclan'a statement la required certllylng that the member utilizing
this benefit la unable to perform normally required dutlea.
10. An Employee that Is rnqulred to prepare for hearings. attend hearings or testily
at hearings as a representative 01 the School District shall be glvsn compensatory time.
For each hour the Employee devotes to hearings, the Employee shall be granted equal
releass time from normal dally responsibilities.

Eech Professional Employee shall receive compensation as shown on the schedules as
sel forth In the appendixes. Where a new Employee to the Camp Hili School District Is to be
hired above the starting step In a Step and Class as provided for In Appendixes III through V
ror the conlract year Involved, the new Employee shall be offered a salary equal with other
Professional Employees or the Camp HIli School District on that Step and Class as provided

2. Placement 01 Employees on Steps 01 salary schedule. Each Prolesslonal Employee
will be placed on the Step one number higher than that on which he was pieced during the
previous year 01 employment with Camp Hili School District, unlll he achieves the highest
Step on the schedule lor his Class. Prolesslonal Employees who heve served the District
lor leas than one lull semester will remain on the same Step at which they started lor tha
entire achoolterm lollowlng their employment. Each salary will be adjusted to show
appropriate Increment only at the beginning 01 the schpolterm.
3. Credits approved lor permanent certlllcallon by the Departnllmt 01 Educallon and
earned by Proleaslonal Employees who do not have permanent certlficaUon, and credits
leading to the masters degree lor those who have permanent certlficatlon, will saUsly the
requirements lor advancementlrom Class I through Cless IV. For advancement beyond
Class IV, the Board will approve graduate credits In the Prolesslonal Employee's teaching
or service lIeld. or 01 a nature deemed by the Board appropriate to Improve the Employee's
prolesslonal competency. The Bosrd will normally accept no more than nine (9) credits
earned during the School Term while an Employee Is employed lull time. but may lor cause I
ehown accept more. Prolesslonal Employees who wish to have prior approval lor a course I
io be taken lor class advancement may request this by complellng the lorm supplied lor the
purpose and submitting same to the Superintendent. Final approval will depend on

4. Time 01 payment - The annual salary 01 the Prolesslonal Employee shall be divided
Into twenty-six (26) or twenty-seven (27) equal parts, one 01 which shall be paid to the
Employee on each altarnate Friday thst coincides with the current payroll system. This
division shall be made so that no altemate pay day will be omlUed.
An employee may elect to receive the balance 01 his salary on the next pay lollowlng
the close 01 the school term or earlier at the discretion 01 the District. The opllon 10
receive a lump sum payment will require two (2) weeks notice to the Business Olllce
prior to the date 01 such payment.
5. Health and hospltallzaUon benefit. The School District shall arrange lor Blue
Cross and Blue Shield, "high opUon" coverage 01 all Employees. The enUre cost 01 coverage,
subject to cost 01 IIl11ltatlons dellnad herein, lor Single Person, Married Person, and
Families shall be paid by the District. The major medical deductible amount will be 5250.
Terms 01 the benefits shall be supplied to employees by the District. The lollowlng shall be
a part 01 the group:
a. Eligible dependents who are lull-time students to age 23.
b. At age 01 lull soclol security benellts retirees of the District and their
eligible dependents who desire to remain part 01 the health plan on a sell-
paying basis may do so provided that at that age they remain part 01 ths
group only to the extent 01 'Current Supplement Coverage'.
c. "an employee retires belore the age 01 lull social security benelils or
when eligible lor medicare end II the employee has been employed by the
Camp Hili School District lor twenty-live (25) years or more, the School
District will pay lor the retiree's health and hospitalization Insurance

The benefit would only apply to the employee until age at which lull social security benellts
are realized. Persons not taking the benellllmmedlately upon retirement may not reenter
the district plan. "an employee rellres and remains part 01 the plan but Is covered under
the lamlly provision through a spouse then this benefit shall be provided when the spouse
Is no longer employed until ege at which full social security benellls are realized. The
benefit Is paid only as a premium benent II the employee remains part 01 the District plan.
The employee must be part 01 the District Medical Plan lor two (2) years prior to
retirement. A person would be eligible to reenter the plan In accordance with the school

It Is understood thalli the P.S.B.A. would elect to cancel the Blue Cross and Blue

to pool Camp Hili with remaining school districts lor experience and rating purposes. "

previous year the district shall have the right to obtain similar coverage Irom another
qualifying carrier while maintaining the lollowlng conditions:
a. Cover all existing medical problems, and continue to pay tor them.
b. No waiting period lor any coverage.
c. No deductlbles.
d. Guarantee equal beneftt In actual cost based on the prevailing les 01 BCIBS.
e. Guarantee that participating physicians will accept the lee paid as
payment In lull.
I. Guarantee that II the plan does not remain comparable to BCIBS that the
plan cen be reestebllshed with BCIBS with no loss 01 benents.
g. That such e plan would accept all Individuals as now carried on our
existing plan.
h. The Association will participate In the review of the alternative qualllled
carrier and provide concurrence with the propoeed change. However. II the
proposed change (upon lulllllment of condlllons a through h above) would
result In a cost savings from the coslto be Incurred from the present or
existing cerrler and ths Association desires to retain the present or existing

Payment will be made In a lump sum at retlrsment provided that nottce of Intent to

7. Qualified extra-credit reimbursement - Prolesslonal employess who have attained
tenure status under the Public School Code of 1949 shall be reimbursed at the rate 01
eighty-five (85%) percent 01 the cost per credit charged by The Pennsylvania Slate
University or one hundred (100%) percent of the credit cost. whichever Is loss, If these
provisions are met:
a, Courses and credits shall be pre-approved by the Superintendent and shall
be college or university credits In the teacher's field of certification or be
earned In a higher degree or certification program acceptable to the
Pennsylvania Department of Education.
b. Payment will be made upon receipt ollhe Employer of an official
transcript Indicating a grade of B or above In the pre-approved course.
c. Payment shall be i1mlted to a maximum 01 six (6) credits por semester or a
total ollwelve (12) credits during the period of July 1 through June 30.
il. Responsibility ior course and credit pre-approval as weii as submlt1lng the
necessary documentation regarding credit completion rests with the Employee.
e. Payment lor successlul completion of credits does not become part of the
Employee's salary.

GRIEVANCE PROCEDURE
1. The parties hereto agree that an orderly and expedltloua resolution 01 grlevancee

MISCELLANEOUS PROVISIONS
1. Nothing contained In this Agrsement shall In any way abrogate or diminish the
right of the school District to seek equitable rellel In the courts when In the Bosrd's
opinion a strike has occurred. The utilization 01 the grievance procedure established In
this Agreement shall not be considered a prerequisite for such recourse to the court.
2. During the course of ths negotiations for this Agreement. the parties hereto have
"met and discussed' on mailers which may be contained In a Handbook for Professional
Employees. This handbook is not to be considered an addendum. a supplement. nor a
separate and Independent agreement. Mailers contained In this handbook may be changed by
the Board at any time and any disputes arising out 01 the Interpretations of mailers
contained therein shall not be subject to the grievance procedures established In this
Agreement. , However. the School District agrees that It will through Its selected
representatives 'meet and discuss' on any policy decision which affects wages, hours and
condition of amployment with representatives 01 the Association. Meetings will be
scheduled at mutually acceptable times lor the purpose,
3. Copies of this Agreement shall be reproduced at the expense 01 the School District
within thirty (30) days alter the Agreement Is signed and presented. together with a copy
of the Handbook for Prolesslonal Employees, to each 01 the Employees. Copies will also be
made available to those being considered lor employment.
4. The Association shall be allowed time on an agenda formulated by the Board lor the
orientation program for new teachers to explain the function 01 the Association.
5. School District shall provide the Association with the names of all teachers and
their assigned schools by October 1 of each year,
8. A Prolesslonal Employee elected or appointed to serve the Pennsylvania
StateEducatlon Association or the National Education Association os 3 state or national
olllcer shall be granted a leave 01 absence without pay for not more than one (1) year and
shall be restored to his lormer position wllh the same rights and benellts as those to which
he was entitled to at the time such leave commenced
