PETITION FOR HODIFICATION
Tonya Sue Hurley, by and through her attorney Joan carey, of
Legal Services, Inc" respectfully respresents tile following:
1, The plaintiff, Kevin Lee Hurley, hereinafter referred
to as the father, resides at 216 Burnthouse Road, Carlisle,
Cumberland County, Pennsylvania 17013,
2, The defendant, Tonya Sue Hurley, hereinafter referred
to as the mother, resides at 164 Big Spring Terrace, Newville,
Cumberland County, Pennsylvania 17241,
3. On April 26th, 1995, this Court entered an Order of
Court awarding the father primary physical custody of the minor
child, Colleen Dru Hurley, hereinafter referred to as the child,
subject to visitation in the mother as agreed upon by the father.
A true an correct copy of the order is attached to this petition.
4. The mother requests that the Court modify the Order to
grant her liberal partial physical custody according to a
specific schedule for reason8 including, but not limited to, the
following:
a, The mother is able to provide for the physical and
emotional needs of the child.
b, Tt is in the child's best interest to maintain a
relationship with her mother.
c, The father has not acted in the child's best

COURT ORDER
AND NOW, this ~ day of ~;!i..L..,. ,1996, upon
consideration of the attached Custody Conciliation Report, it is
ordered and directed as follows:
1. This Court's prior order of April 26, 1995, is vacated.
2. The Father, Kevin Lee Hurley, and the Mother, Tonya Sue
Hurley, shall enjoy shared legal and physical custody of
Colleen Dru Hurley, born September 6, 1993.
3. The Father shall enjoy primary physical custody of the minor
child.
4. Mother shall enjoy temporary physical custody of the minor
child as follows:
A. Every Wednesday from 2:30 p.m. until 8:00 p.m.
B. For a period of four Saturdays from 2:30 p.m. until 8:00
p.m. Upon Mother exerc1sing custody for these four
Saturdays within a two-month period, overnight custody as
set forth in subparagraph C below shall begin.
C. On alternating weekends from Friday at 2:30 p.m. until
Saturday at 8:00 p.m. for a period of three alternating
weekends.
D. Upon conclusion of the alternating weekends set forth in
subparagraph C above, the Mother shall start alternating
weekends on a regular basis from Friday at 2:30 p.m.
until Sunday at 8:00 p.m.
5. The parties will al terna te holidays wi th the time frame being
from 9 :00 a .m. until 7 :00 p.m. and the holidays being New
Year's Day, Easter, Memorial Day, July 4th, and Labor Day.
The Mother will begin the schedule with New Year's Day 1997.
6. The Thanksgiving holiday shall be split into two periods from
Wednesday before Thanksgiving at noon until Thanksgiving Day
at noon and from Thanksgiving Day at noon until that Friday at
noon. This split schedule shall be alternated between the
parties with the Mother starting in 1996 having the first
period from Wednesday at noon until Thursday at noon.
