COMPLAINT
1. The Plaintiff is AGWAY INC., a corporation organized and
existing under the laws of the State of Delaware with its
registered office within the Commonwealth of Pennsylvania c/o
C. T. Corporation System, 123 South Broad Street, Philadelphia,
County of Philadelphia.
2. The Defendants are KEVIN P. KENDIG and NANCY E. KENDIG,
husband and wife, sui juris individuals, citizens of the united
States who presently reside within the Commonwealth of
Pennsylvania at 74 Kline Road, Shippensburg, Cumberland County.
3. At all times material to the claim hereinafter set
forth, the Defendants were the owners and operators of a farm
located within the Commonwealth of Pennsylvania at 74 Kline Road,
Shippensburg, Cumberland County.
4. At the special instance and request of the Defendants,
the Plaintiff sold and delivered to said Defendants, goods and
merchandise at the times, in the quantities and for the prices
.
set forth in Plaintiff's monthly statements, true and correct
copies of which are attached hereto, made a part hereof, and
marked Exhibits Nos. 1 through 16.
5. The Defendants received and accepted the goods and
merchandise described in Exhibits Nos. 1 through 16.
6. The prices set forth in Exhibits Nos. 1 through 16 are
the fair, reasonable and market prices for said goods and
merchandise and the prices which Defendants agreed to pay.
7. All credits, if any, to which Defendants are entitled
are set forth as shown on Exhibits Nos. 1 through 16.
8. Finance charges on the Defendants' account are reflected
in Exhibits Nos. 1 through 16, which amounts Defendants agreed to
pay.
9. The balance due and owing on the account of the
Defendants as reflected in Exhibit 16 is the sum of One Thousand
Five Hundred Thirty-eight Dollars and Fifty-nine Cents
($1,538.59).
10. Although demand has been made, Defendants have failed
to make payment of the amount due and owing.
WHEREFORE, Plaintiff demands judgment in its favor and
against Defendants in the amount of ONE THOUSAND FIVE HUNDRED
THIRTY-EIGHT DOLLARS AND FIFTY-NINE CENTS ($1,538.59), plus
interest and the costs of this action, which amount does not
