"replilce" sixty (60) IlrlCilr leet of curbing and to "piltch" twenty-one 121)
linear feet of llldellillk lu front of the MOl'l'lHon Ap,ll't.mont Complex IIhich is
located at 35 Sprlny ROiHl, Carlit;I." I'A (Exhibit A). 1'1'101' to the beginning
of hiB 1I0rk, Mr. GounB 'lilve me an elltlmate of $1,6'/5,00. I Immediately IIrote
him it check tor $6'/5.00. lie begiln the work and ilccompllBhed mOBt of it during
the month of August 1993.
On July 22, 1993, I hild received Blgnlflcant injurll!l; aB the result of a
motorcycle accident and was unable to go to the property and critically reviell
Mr. Goen's 1I0rk, As August concluded Mr. Goens contacted me and alleged that
the work lias complete except for a short scction of curbinq, a couole oatches
on the sidellalk. and the backfillinq of toosoil between the sidellalk and the
nell curbinq. To date none of this work has been done, the property was sold,
and the work was inspected on October 13, 1994 by the horo of Carlisle and
deemed to meet nell (lessened) standards (Exhibl t B),
On August 30, 1993, Mr. Goens Issued me a bill for $2,0'/5,00 and acknollledged
thereon that I had already paid him the aforementioned $6'/5.00 (Exhibit C).
On September 3, 1993, I met with Mr. Goens and protested the "Extra for Black
Top: $400.00". lie agreed to reduce that amonnt from $400.00 to $100.00. I
paid him $1,100.00 and he m,ll'ked the bill as "paid in full" on that date.
This matter is only Buperficially exacerbated by the fact that the bora leBs-
ened sidellalk/curbing inspection rules since it originally inspected the
property and October 13, 199,1, the date of final innpection (Exhibit B).
In conclusion, ~Ir. Goens never patched Beveral pieceB of sidellalk IIhich had
been originally marked for patching by the bora. lie also replaced only forty-
nine (49) linear feet of curbing despite the boro's clear identification that
nixty (60) linear feet. of cnrhiny should be replaced, Reqardinq the unfin-
ished 1I0rk, Mr.Gol!ns Diles me $325.00 (Re Curbing: 60 feet - 49 feet = 11 feet
or 10.13,\; and Re: sidell,llk lleveral unpatched sections and Re: insufficient
topsoil backfill) ($1,'/'/5.00 paid timen 10.33,\; unfinished 1I0rk equals approxi-
mately $325.00). Reqardinq the Incurred recoverv costn, Mr, Goens olles me
$3'/.50 for the "filing" and "Berving" cants il~ ~ustice Correal's oftice
Thus, MR. GOENS CURRENTLY OWES ME $362.50.
