The mother of the child is Jessica C. Heller, currently residing at the last known
address of 231 North zl.0th Street, Harrisburg, Pennsylvania, 17111. She is not married.
The father of the child is Lawrence M. Herrera, currently residing at 114 Amy
Drive, Carlisle, Pennsylvania, 17013. He is not married.
4. The relationship of Plaintiff to the child is that of Father. He currently
resides with his fiancee, .lessica Bucher.
5. The relationship of Defendant to the child is that of Mother. It is unknown
who she resides with at the present time.
6. The Plaintiff has participated as a party or witness, or in another capacity,
in other litigation concerning the custody of the child in another court, in that, a
Protection from Abuse Order was entered in York County, Pennsylvania on November 3,
1999 granting primary physical custody of Kayla to her mother and awarding her father
partial physical custody in the form of visitation every weekend. That order expired
November 3, 2000.
7. The Plaintiff has no information of a custody proceeding concerning the
child pending in a court of this Commonwealth.
8. The Plaintiff does not know of a person not a party to the proceedings
who has physical custody of the child or claims to have custody or visitation rights with
respect to the child.
9. The best interest and permanent welfare of the child will be served by
granting the relief requested for reasons including the following:
a. The father has been a primary caregiver of the child from his birth. He
has:
1.) planned and prepared meals
2.) bathed, groomed and dressed the child
3.) purchased, cleaned and cared for the child's clothing
4.) arranged medical care, including trips to physicians
b. The child has a psychological bond with Father;
c. Since June 2, 2002, the father has had no contact with the child;
d. Mother has not been accommodating to Father to allow for his visitation;
e. Father would provide a stable environment for the child;
f. The mother has not acted in the child's best interest by denying the father
contact with the child since June 2, 2002;
Mother has repeatedly been uncooperative in reaching agreements
regarding the custody of Kayla and other issues involving their
relationship;
10. Each parent whose parental rights to the child have not been terminated
has been named as parties to this action.
WHEREFORE, the Plaintiff prays that This Honorable Court grant him primary
physical custody of their child.

AND NOW, Wednesday, August 21, 2002 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Tuesday, September 10, 2002 at 9:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. All children age five or older may also be present at the conference. Failure to al~l>ear at the conference may
provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Sl~ecial Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearinR.

consideration of the attached Custody ConciliatiorI Report, it is ordered and directed as
follows:
1. The Father, Lawrence M. Herrara, and the Mother, Jessica C. Heller, shall
have shared legal custody of Kayla Rochelle Mary Herrera, born June 25, 1999. Each
parent shall have an equal right, to be exercised jointly with the other parent, to make all
major non-emergency decisions affecting the Child's general well-being including, but
not limited to, all decisions regarding her health, education and religion.
2. Father shall have primary physical custody of the Child.
3. Mother shall have periods of partial physical custody of the Child on the
following schedule:
A. Every weekend except the first weekend of every month, from Friday
at 6:00 p.m. to Sunday at 6:00 p.m.
4. Christmas shall be divided into two Blocks. Block A shall be from
Christmas Eve at 12:00 noon to Christmas Day at 12:00 noon. Block B shall be from
Christmas Day at 12:00 noon to December 26 at 12:00 noon. Father shall have physical
custody of the Child for Block A in even numbered years and Block B in odd numbered
years. Mother shall have physical custody of the Child for Block A in odd numbered
years and Block B in even numbered years.
5. Mother shall have physical custody of the Child on Mother's Day from
9:00 a.m. to 6:00 p.m. Father shall have physical custody of the Child on Father's Day
from 9:00 a.m. to 6:00 p.m.
6. The Thanksgiving holiday shall be split and alternated from 9:00 a.m. to
3:00 p.m. and 3:00 p.m. to 9:00 p.m. Father shall physical custody of the child during the
earlier time in even numbered years and the later time in odd numbered years. Mother
shall have physical custody of the Child for the later time in even numbered years and the
earlier time in odd numbered years.
7. Each party shall be entitled to three hours with the Child on her birthday.

months, until June, 2002 when Mother took the child for her weekend and failed to return
her. Mother has failed to provide access of the child to Father since June, 2002. Father
requested an Order in the form as attached.

replaced in its entirely with the following:

have shared legal custody of Kayla Rochelle Mary Herrera, bom June 25, 1999. Each
parent shall have an equal right, to be exercised jointly with the other parent, to make all
major non-emergency decisions affecting the Child's general well-being including, but
not limited to, all decisions regarding her health, education and religion.
3. The parties shall have shared physical custody of the Child on a 3/4/4/3
alternating schedule. Said schedule shall begin Wednesday, November 6, 2002 with
Mother having the three days and alternating thereafter as afi>resaid. As a result of this
schedule, Mother shall always have the Child on Wednesday, Thursday and Friday;
Father shall always have the Child on Sunday, Monday and Tuesday. The parties shall
alternate custody of the Child on Saturdays. The pickup time shall be 3:00 p.m. unless
otherwise agreed by the parties.
4. Christmas shall be divided into two Blocks. Block A shall be from
Christmas Eve at 12:00 noon to Christmas Day at 12:00 noon. Block B shall be from
Christmas Day at 12:00 noon to December 26 at 12:00 noon. Father shall have physical
custody of the Child for Block B in even numbered years and Block A in odd numbered
years. Mother shall have physical custody of the Child for B][ock B in odd numbered
years and Block A in even numbered years.
5. Mother shall have physical custody of the Child on Mother's Day from
9:00 a.m. to 6:00 p.m. Father shall have physical custody of the Child on Father's Day
from 9:00 a.m. to 6:00 p.m.

Costopoulos, Esquire, avers the following in support of this Petition:
1. Following a preheating custody conference before Jacqueline Vemey, an Order of Court
was entered by the Honorable J. Wesley Oler, Jr., on November 5, 2002 (Exhibit A).
2. Paragraph 3 of the November 5, 2002 Order should be modified such that Petitioner
should be granted primary physical custody subject to three weekends per month with
Respondent supervised by his wife, Jessica Herrara, tbr the following reasons:
a. Respondent neglects the child when in his custody in that he leaves her
unattended while he sleeps. Recently, Petitioner arrived at Respondent's home
to pick up the child. When she knocked on the door, it was answered by her
four year old daughter. The child told Petitioner that her father was asleep.
Petitioner was uncomfortable entering the house, so she asked the child to go in
and wake him. The child returned stating that she could not wake him.
Petitioner entered the residence and shook Respondent awake. Petitioner
smelled the odor of an alcoholic beverage c,n Respondent's breath. Petitioner
also observed in plain view at least eight dirty diapers strewn about the room as
well as feces on one of Respondent's two other children (ages one and two) who

replaced in its entirely with the following:

have shared legal custody of Kayla Rochelle Mary Herrera, bom June 25, 1999. Each
parent shall have an equal right, to be exercised jointly witlzt the other parent, to make all
major non-emergency decisions affecting the Child's general well-being including, but
not limited to, all decisions regarding her health, education and religion.
3. The parties shall have shared physical custody of the Child on a 3/4/4/3
alternating schedule. Said schedule shall begin Wednesday, November 6, 2002 with
Mother having the three days and alternating thereafter as aforesaid. As a result of this
schedule, Mother s .13all always have the Child on Wednesday, Thttrsday and Friday;
Father shall always have the Child on Sunday, Monday. and Tuesday. The parties shall
alternate custody of the Child on Saturdays. The pickfip time shall be 3:00 p.m. unless
otherwise agreed by the parties.
4. Christmas shall be divided into two Blocks. Block A shall be from
Christmas Eve at 12:00 noon to Christmas Day at 12:00 noon. Block B shall be from
Christmas Day at 12:00 noon to December 26 at 12:00 noon. Father shall have physical
custody of the Child for Block B in even numbered years and Block A in odd numbered
years. Mother shall have physical custody of the Child for Block B in odd numbered
years and Block A in even numbered years.
5. Mother shall have physical custody of the Child on Mother's Day from
9:00 a.m. to 6:00 p.m. Father shall have physical custody of the Child on Father's Day
from 9:00 a.m. to 6:00 p.m.
6. The Thanksgiving holiday shall be split and alternated fi'om 9:00 a.m. to
3:00 p.m. and 3:00 p.m. to 9:00 p.m. Father shall physical custody of the child during the
earlier time in even numbered years and the later time in odd numbered years. Mother
shall have physical custody of the Child for the later time in even numbered years and the
earlier time in odd numbered years.
7. The parties shall be entitled to two (2) non-consecutive weeks during the
year, provided they give the other party thirty (30) days prior notice.
