The undersigned, for itself, its subcontractors, materialmen, laborers and anyone else acting or claiming through or under it, hereby waives and relinquishes all right to file a mechanics' lien, claim or noticc of intcntion to file any lien or claim against the Real Estate. The undersigned, for itsclf, its subcontractors, materialmen, laborers and anyone clse acting under or through it, hereby irrcvocably authorizes and empowcrs any attorney of any court of competent jurisdiction of the Commonwealth of Pennsylvania, or elsewherc, to appear as attorncy for it, them or names, mark satisficd of record at the cost and expense of thc undersigned, any and all claims, liens, any pleading or instrumcnt, or any amcndment to any pleading or instrument prcviously filed by it or them, to incorporate thcrein as part of the rccord this waiver and for such act or acts this waiver shall be good and sufficient warrant and authority, and the undersigned for itsclf, and for them, does hercby remisc, release and quit- claim all rights and all manner of errors, in filing such pleading, instrument or amendment, or in any way concerning thcm. Owner shall have the absolute right in its name or in the namc of the undersigned or any other entity or person who shall havc filed a claim or lien, to cause any and all such claims or liens to be discharged by any other instrument. pleading or proceeding pcrmitted at law or in cquity. The undersigned hereby avers, represcnts and warrants that no work has commcnccd on thc Real Estatc and no labor or malcrials havc bccn dclivcrcd to the Real Estatc or furnishcd for thc improvemcnt of thc Rcal Estulc by thc undcrsigncd or by any subcontractor, materialman, laborer. or other person or cntity, and that no authorization has yet been given by the Owncr to the undcrsigncd to commencc work or purchasc materials in connection with Real Estate.
