KUHN, Defendant . . tCIVIL ACTION - CUSTODY CONCILIATION CONFERENCE SUMMARY REPORT IN ACCORDANCE WITH CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE 1915.3-8(b), the undersigned Custody Conciliator submits the following report: 1. The pertinent information pertaining to the child who is the subject of this litigation is as follows: Shawn A. Struber, born December 4, 1992. 2. A Conciliation Conference was held on April 6, 1995, with the following individuals in attendance: The Father, Doug R. Kuhn, with his counsel, Carol L. Lindsay, Esquire, and the Mother's counsel, Joan Carey, Esquire. Ms. Struber was in Florida, but was available by telephone for the conference. 3. The parties appeared before the Court this past January in the nature of a Petition for Emergency Relief. The case was then referred to the Custody Conciliator. The parties were never married. The child resided in Florida with the Mother after his birth, and resided with the Father and Mother in Pennsylvania from approximately July of 1994 through November of 1994. 4. The Father believes that he is a capable parent and that custody should be shared. The parties exchanged some proposals with respect to custody arrangements but were unable to reach an agreement at the Hearing. 5. The Mother has serious concerns with respect to the Father's emotional situation and suggests that the Father has threatened suicide in the past. Mother also suggests that the Father is not able to provide appropriate parenting for the minor child. Mother is agreeable to providing extended periods of time to the Father with the child, but she is not prepared to accept the Father's recommendation. The parties cannot reach an agreement and a Hearing is necessary. I , I " I' I: and Michael McCauley The mother of the child is Traci struber, currently residing at 180 Mountain View Road, Mt. Holly, Pennsylvania 17065. She is single. The father of the child is Doug R. Kuhn, currently residing at P.O. Box 32, Carlisle, pennsylvania 17013. He is single. 4. The relationship of plaintiff to the child is that of mother. The plaintiff currently is residing with Glenda stough, Gary stough, Gretchen stough and Gary stough. 5. The relationship of defendant to the child is that of father. The defendant currently resides alone. 6. The plaintiff has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the child in this or another court. 7. The plaintiff has no information of a custody proceeding concerning the child pending in a court of this commonwealth. 8. The plaintiff is represented by Joan carey of Legal services, Inc.; the d~fendant is unrepresented but is aware of his right to have an attorney. WHEREAS, Traci struber, the plaintiff, is enlisting in the united States Navy requiring that she make arrangements regarding custody her child. The defendant and the plaintiff agree to the entry of an Order providing for the following custody schedule for their child, Shawn Alexander Struber: 1. Terry McCauley and Mike McCauley, the maternal grandparents, will have physical and legal custody of the child. 2. Traci Struber, the plaintiff, will have liberal periods of time with the child. 3. Doug R. THE COURT: For the record we will note that 2 \ 1 The order will also include a period of 2 partial custody with the father for six weeks in the 3 summertime with the father to advise the mother by May 1st 4 of that year, with respect to the intended six-week period 5 of partial custody. Though we note that in 1995 it will 6 commence on July the 1st. In addition, the parties will 7 alternate the period from November 15th to December 15th or 8 December 15th to January 15th, with the understanding that 9 in 1995 that period will be in the father from November 15th 10 to December 15th. 11 with respect to those foregoing provisions 12 having to do with partial custody, the parties will share 13 equally the cost of transportation. At the same time the 14 parties are free to agree to and encouraged by the Court to 15 agree to other times of partial custody in the father, as 16 she shall mutually agree, with the understanding with 17 respect to those additional periods of custody or visitation 18 there may be some other agreement with regard to the payment 19 of the costs of transportation. Just let me close with the comment 13 that I congratulate the two of you for your ability to reach 14 this agreement. I have no trouble sitting her all day 15 listening to custody cases; that's what I get paid for. I 16 have learned that in the long run the agreement that the 17 parties are able to reach is generally better than something 18 I would impose on them. 19 It also is a good sign in this case because 20 it also shows that you are able to put your love for this 21 child above whatever animosity you have for each other, and 22 I encourage you to continue to do that because this ie a 23 precious little being, who will need all of the love that 24 you can give him; and that will involve, from time to time, 25 a requirement that you agree as to things, even though it 4 . , 1 might be difficult from time to time to get along. 2 So again, I congratulate you and ask counsel 3 one final time it if there is anything further for the 4 record? 5 MS.
