such place as he or she may from time to time choose or deem fit.
The foregoing provisions shall not be taken as an admission on the
part of either party of the lawfulness or unlawfulness of the
causes leading to their living apart.
2. INTERPERENCE: Each party shall be free from
'-Interference, authority, and contact by the other, as fully as if
he or she were single and unmarried except as may be necessary to
carry out the provisions of this Agreement. Neither party shall
molest the other or attempt to endeavor to molest the other, nor
compel the other to cohabi t wi th the other,' or in any way harass or
malign the other, nor in any way interfere with the peaceful
existence, separate and apart from the other.
3. WIPE'S DEBTS: Wife represents and warrants to Husband
that since the separation she has not and in the future she will
not contract or incur any debt or liability for which Husband or
his estate might be responsible and shall indemnify and save
harmless Husband from any and all claims or demands incurred by
her.
4. HUSBAND'S DEBTS: Husband represents and warrants to
Wife that since the separation he has not and in the future he will
not contract or incur any debt or liability for which Wife or her
estate might be responsible and shall indemnify and save harmless
Wife from any and ~ll claims or demands made against her by reason
of debts or obligations incurred by him.

5. MUTUAL RELEASE I Subj ece eo the provisions of this
Agreement / each party has released and discharged, and by this
Agreement does for himself or herself and his or her heirs, legal
representaeives, executors, adminiseraeors and assigns, release and
discharge the other of and from all causes of action, claims,
--ri~hts, or demands, whatsoever in law or equity, which either of
the parties ever had or now has againse the other, except any or
all causes of action for termination of the marriage by divorce or
annulment and except for all causes of action for breach of any
provisions of this Agreement. Husband' and Wife specifically
release and waive any and all rights he or she might have to raise
claims under the Divorce Code of 1980 and the 1988 Amendmentf:
thereto including, but not limieed to claims for equitable
distribution of marital property, support, alimony, alimony
pendente lite, counsel fees or expenses. Should a divorce action
be commenced by either of the parties, the moving party shall
request the Court to incorporate, but not merge, this Agreement
into any divorce decree. If this Agreement is incorporated into a
divorce decreet the parties shall have the right to enforce this
Agreement under the Divorce Code of 1980 and the 1988 Amendments
thereto in addition to any remedies in law or equity and these
enforcement rights are not waived or released by any of the
provisions of this Agreement. The fact that a party brings an

divorce decree, under the Divorce Code of 1980 and the 1988
Amendments thereto, does not give either party the right to raise
other claims under the Divorce Code, specifically waived and
released by this paragraph and all rights and obligations of the
parties arising out of the marriage shall be determined by this
. Agreement.
6. DIVISION OF PERSONAL PROPERTY I The parties have divided
between them, to their mutual satisfaction, the personal effects,
household furniture and furnishings, and all other articles of
personal property which have theretofore been used by them in
common, and neither party will make any claim to any such items
which are now in the possession or under the control of the other.
Should it become necessary, the parties each agree to sign any
titles or documents necessary to give effect to this paragraph upon
request.
7. DIVISION OF REAL PROPERTY I Wife agrees to transfer all
right, title and interest in and to the real estate situated at 116
Westover Drive, New Cumberland, Cumberland County, Pennsylvania,
now titled in the name of Husband and Wife as tenants by the
entireties to the Husband and agrees to immediately execute now or
in the future any and all deeds, documents, or papers necessary to
effect such transfer of title upon request. Wife further
acknowledges that she has no claim, right, interest, or title

whatsoever in said property and further agrees never to assert any
claim to said property in the future.
Within 90 days of the date of this agreement, Husband shall
assume all liability and shall obtain a release of any personal
liability for Wife on the following debts:
. --~. (a) the mortgage held with the Mellon Mortgage Company with
an approximate balance of Sixty-five Thousand Nine
Hundred Eleven ($65,911.00) Dollars; and
(b) the home equity loan held with Mellon Bank with an
approximate balance of Thirteen Thousand Five Hundred
Seventeen ($13,517.00) Dollars.
E'ending Wife's removal of liabilir:y of said debt, Husband
shall indmentify and hold Wife harmless on same.
8. ~STRIBUTION OP OTHER ASSBTS:
A. Wife agrees to transfers to Husband any and all right,
title and interest she may have to the following assets,
acknowledges that she has no claim, right, interest, or title
whatsoever in said property and further agrees never to assert any
claim to said property in the future:
(1) any interest which Husband may have or may have had
during the course of the marriage in Information Services
Group, !nc.;

(2) Husband's Information Services Group, Inc. retirement
plan with an approximate balance of Thirteen Thousand
Seven Hundred Seventy-three ($13,773.00) Dollars;
(3) Prudential Plan Account No. 94561123 with an approximate
balance of Twelve Thousand Thirty-five ($12,035.00)
Dollars;
(4) Prudential plan Account No. 94549085 with an approximate
balance of Ten Thousand Four Hundred Eighteen
($10,418.00) Dollars;
(5) Prudential Whole Life Insurance Policy No. 73372652 with
a current value of Four Thousand Fifty-five ($4,055.00)
Dollars;
(6) Any interest Husband may have in the Data Quest Company;
(7) A 1989 Landau 24 Power boat (pontoon boat) trailer and
motor with an approximate value of Three Thousand Nine
Hundred ($3,900.00) Dollars;
(8) Husband's baas boat.
B. Husband agrees to transfers to Wife any and all right,
title and interest he may have to the following assets,
acknowledges that he has no claim, right, interest, or title
whatsoever in said property and further agrees never to assert any
claim to said property in the future:

(1) Wife's Federal Express Pension with an approximate value
of Twenty-one Thousand Three Hundred Forty-five
($21,345.00) Dollars;
(2) Wife's Federal Express Credit Union account with an
approximate value of One Hundred Eighty-one ($181.00)
Dollars;
(3) Wife's profit sharing plan with an approximate value of
Twenty-seven Thousand Seven Hundred Fifty-two
($27,752.00) Dollars;
(4) Dauphin Deposit Account No. 10637508 with a marital
balance of approximate Five Hundred Twenty-two ($522.00)
Dollars.
9. EQUITABLE DISTRIBUTION: Husband agrees to pay to Wife as
equitable distribution the sum of Fifty Eight Thousand ($58,000.00)
Dollars as follows:
(a) Twenty Thousand ($20,000.00) Dollars immediately upon the
execution of this Agreement.
(b) Thirty-eight Thousand ($38,000.00) Dollars at time of
refinancing or removal of Wife's name on the debt to the
marital residence. Said payment to be made no later than
ninety (90) days of the signing of this Agreement.
10. SUPPORT OBLIGATION TO WIFE: The parties agree that
Husband's obligation to pay spousal support, alimony pendente lite
or maintenance of any type to Wife shall terminate upon the entry

of a divorce decree. Husband agrees that unless he initiates legal
action to contest the amount of arrearages due and owing on the
aforesaid support action or the balance due to wife per the support
order on uncovered medical bills incurred prior to the date of the
decree, he shall satisfy said arrearages and within thirty (30)
--aays of the entry of a divorce decree. Should Husband commence a
legal action to contest the aforesaid arrearages or medical bills,
the parties agree that Husband's obligation to satisfy said
arrearages shall not arise until said litigation is completed.
11. INCOME TAX PRIOR RETURNS: The parties have heretofore
filed joint federal and state returns. Both parties agree that in
the event any deficiency in federal, state or local income tax is
proposed, or any assessment of any such tax is made against either
of them, each will indemnify and hold harmless the other from and
against any loss or liability for any such tax deficiency or
assessment therewith. Such tax, interest, penalty or expense shall
be paid solely and entirely by the individual who is finally
determined to be the cause of the misrepresentations or failures to
disclose the nature and extent of his or her separate income on the
aforesaid joint returns.
12. WAIVERS OP CLAIMS AGAINST ESTATES I Except as herein
otherwise provided, each party may dispose of his or her property
in any way. and each party hereby waives and relinquishes any and
all rights he or she may now have or hereafter acquire, under the

present or future laws of any jurisdiction, to share in the
property or the estate of the other as a result of the marital
relationship, including without limitation, dower, curtesy,
statutory allowance, widow's allowance, right to take in intestacy,
right to take against the Will of the other, and right to act as
.-~dministrator or executor of the other's estate, and each will, at
the request of the other, execute, acknowledge, and deliver any and
all instruments which may be necessary or advisable to carry into
effect this mutual waiver and relinquishment of all such interests,
rights and claims.
13. SUBSBOUENT DIVORCE: Both parties agree to execute
Affidavits of Consent to Divorce and Waiver of Notice of Intention
to Request Entry of a Divorce Decree pursuant to Section 3301(c) of
the Divorce Code contemporaneous with =he signing of this Agreement
and shall direct their respective counsel to immediately file with
the Court said documents. wife agraes that she shall direct her
counsel to immediately file with the Court a Decree in Divorce from
the bonds of matrimony under Section 3301(c) of the Divorce Code.
14. BREACH: If either party breaches any provision of this
Agreement, the other party shall have the right, at his or her
election, to sue for damages for such breach or seek such other
remedies or relief as may be available =0 him or her, and the party
breaching this contract shall be respcnsible for payment of legal

fees and costs incurred by the other in enforcing their rights
under this Agreement.
15. ADDITIONAL INSTRUMENTSI Each of the parties shall from
tims to time, at the request of the other, execute, acknowledge,
and deliver to the other party any and all further instruments that
-lfiay be reasonably required to give full force and effect to the
provisions of this Agreement.
16. VOLUNTARY EXECUTrONI The provisions of this Agreement
and their legal effect have been fully explained to the parties by
their respective counsel. The Wife has' employed and had the
benefit of counsel of John J. Connelly, Jr., Esquire as her
attorney. The Husband has employed and had the benefit of counsel
of J. Paul Helvy, Esquire as his attorney. Each party acknowledges
that he or she has received independent legal advice from counsel
of his or her selection and that each fully understands the facts
and has been fully informed as to his or her legal rights and
obligations, and each party acknowledges and accepts that this
Agreement is, under the circumstances, fair and equitable, and that
it is being entered into freely and voluntarily after having
received such advice and with such knowledge, and that execution of
this Agreement is not the result of any duress or undue influence
and that it is not the result of any collusion or improper or
illegal agreement or agreements. Also, each party hereto
acknowledges that he or she has been fully advised by his or her

respective attorney of the impact of the new Pennsylvania Divorce
Reform Act, whereby the Court has the right and duty to determine
all marital rights of the parties, including divorce, alimony,
alimony pendente lite, equitable distribution of all marital
property or property owned or possessed individually by the other,
--counsel fees and costs of litigation and, fully knowing the same
and being fully advised of his or her rights thereunder, each party
hereto still desires to execute this Agreement acknowledging that
the terms and conditions set forth herein are fair, just, and
equitable to each of the parties and waives'their respective right
to have the Court of Common Pleas of Cumberland County or any other
Court of competent jurisdiction to make any determination or order
affecting the respective parties' right to a divorce, alimony,
alimony pendente lite, equitable distribution of all marital
property, counsel fees and costs of litigation.
17. ENTIRE AGREEMENT I This Agreement contains the entire
understanding of the parties, and there are no representations,
warranties, covenants, or undertakings other than those expressly
set forth herein.
18. MODIFICATION AND WAIVERI A modification or waiver of any
of the provisions of this Agreement shall be effective only if made
in writing and executed with the same formality as this Agreement.

any of the provisions of this Agreement shall not be construed as
a waiver of any subsequent default of the same or similar nature.
19. DESCRIPTIVE HEADINGS I The descriptive headings used
herein are for convenience only. They shall have no effect
whatsoever in determining the rights or obligations of the parties.
. -- ~- 20. MUTUAL ACCEPTANCE I The parties accept the provisions of
this Agreement in lieu of and in full and final settlement and
satisfaction of all claims and demands that they may now or
hereafter have against each other for their support and
maintenance, and also alimony, alimony pendente lite, counsel fees
or for any other provision for their support and maintenance, and
also alimony, alimony pendente lite, counsel fees, costs and
expenses and any other charge of any nature whatsoever pertaining
to any divorce proceeding which may have been or may be instituted
by the parties in any court in the Commonwealth of Pennsylvania or
any other jurisdiction and/or any divorce proceeding which may be
instituted by either party in any court in the Commonwealth of
Pennsylvania or any other jurisdiction or any other counsel fees,
costs or expenses incurred or to be charged by any counsel arising
in any manner whatsoever for breach of this Agreement.
21. DESIRE OF THE PARTIES: It is the desire of the parties,
after long and careful consideration, to amicably adjust,
compromise and settle all property rights and all rights in, to, or
against each other's property or estate, including property

heretofore or subsequently acquired by either party, and to eettle
all disputes existing between them, including any and all claims
for wife's and/or Husband'S maintenance and/or for support,
alimony, counsel fees and costs.
22. INDEPENDENT SEPARATE COVENANTS I It is specifically
"Uinalerstood and agreed by and between the parties hereto that each
paragraph hereof shall be deemed to be a separate and independent
covenant and agreement.
23. APPLICABLE LAWI This Agreement shall be construed under
the laws of the Commonwealth of Pennsylvania.
24. PRIOR AGREEMENTSI It is understood and agreed that any
and al::' property settlement agreements which mayor have been
executed prior to the date and time of this Agreement are null and
void and of no effect.
25. VOID CLAUSES I If any term, condition, clause or
provision of this Agreement shall be determined or declared to be
void or invalid in law or otherwise, then only that term,
condition, clause or provision shall be stricken from this
Agreement and in all other respects this Agreement shall be valid
and continue in full force, effect and operation.
26. DISCLOSURE I The respective parties do hereby warrant,
represent, and declare and do acknowledge and agree that each is
and has been fully and completely informed of and is familiar with
and cognizant of the wealth, real and/or personal property, estate

3. When used with respect to a document, the term

B. The term "documents" when used herein shall mean all
written, typed, printed, recorded or graphic matter of every type
and description, however and by whomever prepared, produced, repro-
duced, disseminated or made, in any form, now or formerly in the
possession, custody, or control of the party to whom this Request
is addressed, its officers, agents, employees and attorneys, or any
of them, including, but not limited to letters, correspondence,
telegrams, memoranda, records, minutes of all types of meetings,
contracts, subcontracts, agreements, intra and interoffice communi-
cations, purchase orders, requieitions, plans, studies, summaries,
analyses, results of investigations, reviews, bulletins, proposals,
estimates, appraisals, recommendations, critiques, trip reports,
engineering calculations, bills of materials, drawings, sketches,
blueprints, charts, indices, notices,
diaries, books, desk
calendars, appointment books, messages, instructions, work assign-
ments, notes, notebooks, tape recordings, partial or complete
reports of telephone conversations, photographs, slides, public
statements, newspaper or other media releases, public alld
governmental filings, opinions, and any other writings, drawings or
recordings.
If any document was, but is no longer, in the
possession of the party to whom this Request is addressed or
subject to such party's control, identify the document.

C. When used herein, the term "person" ahall mean any indi-
vidual, partnership, joint venture, firm, association, corporation
or business or any governmental or legal entity.
D. When used herein, the term "communication" shall mean any
and all transmissions of information, the information transmitted,
the process by which the information is transmitted and the term
shall expressly be inclusive of all written and oral
communications.
E. When used herein, the terms "relate to", "relating to" or
"in relation to" shall mean constituting, reflecting, repre-
senting, supporting, contradicting, referring to, stating,
describing, recording, noting, embodying, containing, mentioning,
studying, analyzing, discussing, evaluating, or relevant to. As
indicated, the term necessarily includes information which is in
opposition to as well as in support of the position(s) and claim(s)
of the party to whom the Request is addressed.
F. When used herein, the term "reflect" shall mean embody,
contain, record, note, refer to, relate to, describe, be relevant
to, state or mention.
G. When used herein, the term "Plaintiffs" shall refer to
Vartan Enterprises, Inc., and Vartan Supply Company, Plaintiffs
herein.
H. When used herein, the term "Defendant" shall refer to the
Defendant named herein, his agents and assigns.

II. General Instruotions
A. Whenever a request for documents is framed in the
conjunctive, it shall also be taken in the disjunctive and vice
versa.
B. Whenever a request for documents is framed in the
singular, it shall be taken in the plural, and vice versa.
C. The use of any tense of any verb shall be considered also
to include within its meaning all other tenses of the verb so used.
D. All documents produced shall be segregated and identified
by the paragraphs to which they are primarily responsive. Where
required by a particular paragraph of this Request, documents
produced shall be further segregated and identified as indicated in
that paragraph. For any documents which are stored or maintained in
files in the normal course of business, such documents shall be
produced in such files, or in such a manner as to preserve and
identify the file from which such documents were taken.
E. If you object to the production of any do~ument on the
grounds that the attorney-client, attorney work-product or any
other privilege is applicable thereto, you shall, with respect to
that document:
(1) State its date;
(2) Identify its author;
(3) Identify each person who prepared or participated
in the preparation of the document;
(4) Identify each person who received it;

(5) Identify each person from whom the document was
received;
(6) State the present location of the document and all
copies thereof;
(7) Identify each person who has ever had possession,
custody or control of it or a copy thereof; and
(8) Provide sufficient information concerning the docu-
ment and the circumstances thereof to explain the
claim of privilege and to permit the adjudication
of the propriety of that claim.
F. All documents produced in response to this Request shall
be produced in t2t2 notwithstanding the fact that portions thereof
may contain information not requested, shall include interim as
well as final editions of a document, and shall include all
editions or copies of a document which are not identical to
(whether due to handwritten notations, or revisions, or otherwise)
the original or other produced copy of a document.
G. This Request shall be deemed to be continuing so as to
require a supplemental answer by the person to whom this Request is
directed, or such person's agents, employees, representatives or
attorneys obtain such information between the time of response
hereto and trial of this case.

such place as he or she may from time to time choose or deem fit.
The foregoing provisions shall not be taken as an admission on the
part of either party of the lawfulness or unlawfulness of the
causes leading to their living apart.
2, INTBRPERENCEI Each party shall be free from
interference, authority, and contact by the other, as fully as if
he or she were single and unmarried except as may be necessary to
carry out the provisions of this Agreement. Neither party shall
molest the other or attempt to endeavor to molest the other, nor
compel the other to cohabit with the other, or in any way harass or
malign the other, nor in any way interfere with the peaceful
existence, separate and apart from the other.
3. WIPE'S DEBTS: Wife represents and warrants to Husband
that since the separation she has not and in the future she will
not contract or incur any debt or liability for which Husband or
his estate might be responsible and shall indemnify and save
harmless Husband from any and all claims or demands incurred by
her.
4. HUSBAND'S DEBTSI Husband represents and warrants to
Wife that since the separation he has not and in the future he will
not contract or incur any debt or liability for which Wife or her
estate might be responsible and shall indemnify and save harmless
Wife from any and all claims or demands made against her by reason
of debts or obligations incurred by him.

5. MUTUAL RELEASE I Subject to the provisions of this
Agreement, each party has released and discharged, and by this
Agreement does for him&elf or herself and his or her heirs, legal
representatives, executors, administrators and assigns, release and
discharge the other of and from all causes of action, claims,
rights, or demands, whatsoever in law or equity, which either of
the parties ever had or now has against the other, except any or
all causes of action for termination of the marriage by divorce or
annulment and except for all causes of action for breach of any
provisions of this Agreement. Husband and wife specifically
release and waive any and all rights he or she might have to raise
claims under the Divorce Code of 1980 and the 1988 Amendmants
thereto including, but not limited to claims for equitable
distribution of marital property, support, alimony, alimony
pendente lite, counsel fees or expenses. Should a divorce action
be commenced by either of the parties, the moving party shall
request the Court to incorporate, but not merge, this Agreement
into any divorce decree. If this Agreement is incorporated into a
divorce decree, the parties shall have the right to enforce this
Agreement under the Divorce Code of 1980 and the 1988 Amendments
thereto in addition to any remedies in law or equity and these
enforcement rights are not waived or released by any of the
provisions of this Agreement. The fact that a party brings an
action to enforce the property agreement as incorporated in the

divorce decree, under the Divorce Code of 1980 and the 1988
Amendments thereto, does not give either party the right to raise
other claims under the Divorce Code, specifically waived and
released by this paragraph and all rights and obligations of the
parties arising out of the marriage shall be determined by this
Agreement.
6. DIVISION OP PERSONAL PROPERTY I The parties have divided
between them, to their mutual satisfaction, the personal effects,
household furniture and furnishings, and all other articles of
personal property which have theretofore been used by them in
common, and neither party will make any claim to any such items
which are now in the possession or under the control of the other.
Should it become necessary, the parties each agree to sign any
titles or documents necessary to give effect to this paragraph upon
request.
7. DIVISION OP REAL PROPERTY I Wife agrees to transfer all
right, title and interest in and to the real estate situated at 116
Westover Drive, New Cumberland, Cumberland County, Pennsylvania,
now titled in the name of Husband and Wife as tenants by the
entireties to the Husband and agrees to immediately execute now or
in the future any and all deeds, documents, or papers necessary to
effect such transfer of title upon request. Wife further
acknowledges that she has no claim, right, interest, or title

whatsoever in said property and further agrees never to assert any
claim to said property in the future,
Within 90 days of the date of this agreement, Husband shall
assuma all liability and shall obtain a release of any personal
liability for Wife on the following debts:
(a) the mortgage held with the Mellon Mortgage Company with
an approximate balance of Sixty-five Thousand Nine
Hundred Eleven ($65,911.00) Dollars; and
(b) the home equity loan held with Mellon Bank with an
approximate balance of Thirteen Thousand Five Hundred
Seventeen ($13,517.00) Dollars.
Pending Wife's removal of liability of said debt, Husband
shall indmentify and hold Wife harmless on same.
8. DISTRIBUTION OF OTHER ASSETSI
A. Wife agrees to transfers to Husband any and all right,
title and interest she may have to the following assets,
acknowledges that she has no claim, right, interest, or title
whatsoever in said property and further agrees never to assert any
claim to said property in the future:
(1) any interest which Husband may have or may have had
during the course of the marriage in Information Services
Group, Inc,;

(2) Husband's Information Services Group, Inc. retirement
plan with an approximate balance of Thirteen Thousand
Seven Hundred Seventy-three ($13,773.00) Dollars;
(3) Prudential Plan Account No. 94561123 with an approximate
balance of Twelve Thousand Thirty-five ($12,035.00)
Dollars;
(4) Prudential Plan Account No. 94549085 with an approximate
balance of Ten Thousand Four Hundred Eighteen
($10,418.00) Dollars;
(5) Prudential Whole Life Insurance Policy No. 73372652 with
a current value of Four Thousand Fifty-five ($4,055.00)
Dollars;
(6) Any interest Husband may have in the Data Quest Company;
(7) A 1989 Landau 24 Power boat (pontoon boat) trailer and
motor with an approximate value of Three Thousand Nine
Hundred ($3,900.00) Dollars;
(8) Husband's bass boat.
B. Husband agrees to transfers to Wife any and all right,
title and interest he may have to the following assets,
acknowledges that he has no claim, right, interest, or title
whatsoever in said property and further agrees never to assert any
claim to said property in the future:

(1) Wife's Federal Express Pension with an approximate value
of Twenty-one Thousand Three Hundred Forty-five
($21,345.00) Dollars;
(2) Wife's Federal Express Credit Union account with an
approximate value of One Hundred Eighty-one ($181. 00)
Dollars;
(3) Wife's profit sharing plan with an approximate value of
Twenty-seven Thousand Seven Hundred Fifty-two
($27,752.00) Dollars;
(4) Dauphin Deposit Account No, 10637508 with a marital
balance of approximate Five Hundred Twenty-two ($522.00)
Dollars.
9. EQUITABLE DISTRIBUTIONt Husband agrees to pay to Wife as
equitable distribution the sum of Fifty Eight Thousand ($58,000.00)
Dollars as follows:
(a) Twenty Thousand ($20,000.00) Dollars immediately upon the
execution of this Agreement.
(b) Thirty-eight Thousand ($38,000.00) Dollars at time of
refinancing or removal of Wife's name on the debt to the
marital residence. Said payment to be made no later than
ninety (90) days of the signing of this Agreement.
10. SUPPORT OBLIGATION TO WIPEt The parties agree that
Husband's obligation to pay spousal support, alimony pendente lite
or maintenance of any type to Wife shall terminate upon the entry

of a divorce decree. Husband agrees that unless he initiates legal
action to contest the amount of arrearages due and owing on the
aforesaid support action or the balance due to Wife per the support
order on uncovered medical bills incurred prior to the date of the
decree, he shall satisfy said arrearages and within thirty (30)
days of the entry of a divorce decree. should Husband commence a
legal action to contest the aforesaid arrearages or medical bills,
the parties agree that Husband's obligation to satisfy said
arrearages shall not arise until said litigation is completed.
11. INCOME TAX PRIOR RETURNSI The parties have heretofore
filed joint federal and state returns. Both parties agree that in
the event any deficiency in federal, state or local income tax is
proposed, or any assessment of any such tax is made against either
of them, each will indemnify and hold harmless the other from and
against any loss or liability for any such tax deficiency or
assessment therewith. Such tax, interest, penalty or expense shall
be paid solely and entirely by the individual who is finally
determined to be the cause of the misrepresentations or failures to
disclose the nature and extent of his or her separate income on the
aforesaid joint returns.
12. WAIVERS OF CLAIMS AGAINST ESTATES I Except as herein
otherwise provided, each party may dispose of his or her property
in any way, and each party hereby waives and relinquishes any and
all rights he or she may now have or hereafter acquire, under the

present or future laws of any jurisdiction, to share in the
property or the estate of the other as a result of the marital
relationship, including without limitation, dower, curtesy,
statutory allowance, widow's allowance, right to take in intestacy,
right to take against the Will of the other, and right to act as
administrator or executor of the other's estate, and each will, at
the request of the other, execute, acknowledge, and deliver any and
all instruments which may be necessary or advisable to carry into
effect this mutual waiver and relinquishment of all such interests,
rights and claims.
13 . SUBSEQUENT DIVORCE I Both parties agree to execute
Affidavits of Consent to Divorce and waiver of Notice of Intention
to Request Entry of a Divorce Decree pursuant to Section 3301(c) of
the Divorce Code contemporaneous with the signing of this Agreement
and shall direct their respective counsel to immediately file with
the Court said documents. Wife agrees that she shall direct her
counsel to immediately file with the Court a Decree in Divorce from
the bonds of matrimony under Section 3301(c) of the Divorce Code.
14. BREACH I If either party breaches any provision of this
Agreement, the other party shall have the right, at his or her
election, to sue for damages for such breach or seek such other
remedies or relief as may be available to him or her, and the party
breaching this contract shall be responsible for payment of legal

fees and costs incurred by the other in enforcing their rights
under this Agreement.
15. ADDITIONAL INSTRUMENTSI Each of the parties shall from
time to time, at the request of the other, execute, acknowledge,
and deliver to the other party any and all further instruments that
may be reasonably required to give full force and effect to the
provisions of this Agreement.
16. VOLUNTARY EXECUTION I The provisions of this Agreement
and their legal effect have been fully explained to the parties by
their respective counsel, The Wife has employed and had the
benefit of counsel of John J. Connelly, Jr., Esquire as her
attorney. The Husband has employed and had the benefit of counsel
of J. Paul Helvy, Esquire as his attorney. Each party acknowledges
that he or she has received independent legal advice from counsel
of his or her selection and that each fully understands the facts
and has been fully informed as to his or her legal rights and
obligations, and each party acknowledges and accepts that this
Agreement is, under the circumstances, fair and equitable, and that
it is being entered into freely and voluntarily after having
received such advice and with such knowledge, and that execution of
this Agreement is not the result of any duress or undue influence
and that it is not the result of any collusion or improper or
illegal agreement or agreements, Also, each party hereto
acknowledges that he or she has been fully advised by hi~ or her

respective attorney of the impact of the new Pennsylvania Divorce
Reform Act, whereby the Co~rt has the right and duty to determine
all marital rights of the parties, including divorce, alimony,
alimony pendente lite, equitable distribution of all marital
property or property owned or possessed individually by the other,
counsel fees and costs of litigation and, fully knowing the same
and being fully advised of his or her rights thereunder, each party
hereto still desires to execute this Agreement acknowledging that
the terms and conditions set forth herein are fair, just, and
equitable to each of the parties and waives their respective right
to have the Court of Common Pleas of Cumberland County or any other
Court of competent jurisdiction to make any determination or order
affecting the respective parties' right to a divorce, alimony,
alimony pendente lite, equitable distribution of all marital
property, counsel fees and costs of litigation.
17. ENTIRE AGREEMENT I This Agreement contains the entire
understanding of the parties, and there are no representations,
warranties, covenants, or undertakings other than those expressly
set forth herein.
18. MODIFICATION AND WAIVERI A modification or waiver of any
of the provisions of this Agreement shall be effective only if made
in writing and executed with the same formality as this Agreement.
The failure of either party to insist upon strict performance of

any of the provisions of this Agreement shall not be construed as
a waiver of any subsequent default of the same or similar nature.
19. DGSCRIPTIVE HEADINGS. The descriptive headings used
herein are for convenience only. They shall have no effect
whatsoever in determining the rights or obligations of the parties.
20. MUTUAL ACCEPTANCE, The parties accept the provisions of
this Agreement in lieu of ar.d in full and final settlement and
satisfaction of all claims and demands that they may now or
hereafter have against each other for their support and
maintenance, and also alimony, alimony pendente lite, counsel fees
or for any other provision for their support and maintenance, and
also alimony, alimony pendente lite, counsel fees, costs and
expenses and any other charge of any nature whatsoever pertaining
to any divorce proceeding which may have been or may be instituted
by the parties in any court in the Commonwealth of Pennsylvania or
any other jurisdiction and/or any divorce proceeding which may be
instituted by either party in any court in the Commonwealth of
Pennsylvania or any other jurisdiction or any other counsel fees,
costs or expenses incurred or to be charged by any counsel arising
in any manner whatsoever for breach of this Agreement.
21. DESIRE OF THE PARTIES, It is the desire of the parties,
after long and careful consideration, to amicably adjust,
compromise and settle all property rights and all rights in, to, or
against each other's property or estate, including property

heretofore or subsequently acquired by either party, and to settle
all disputes existing between them, including any and all claims
for Wife's and/or Husband's maintenance and/or for support,

22. INDEPENDENT SEPARATE COVENANTS I It is specifically
understood and agreed by and between the parties hereto that each
paragraph hereof shall be deemed to be a separate and independent
covenant and agreement.
23. APPLICABLE LAWI This Agreement shall be construed under
the laws of the Commonwealth of Pennsylvania.
24. PRIOR AGREEMENTSI It is understood and agreed that any
and all property settlement agreements which mayor have been
executed prior to the date and time of this Agreement are null and
void and of no effect.
25. VOID CLAUSES I If any term, condition, clause or
provision of this Agreement shall be determined or declared to be
void or invalid in law or otherwise, then only that term,
condition, clause or provision shall be stricken from this
Agreement and in all other respects this Agreement shall be valid
and continue in full force, effect and operation.
26. DISCLOSURE I The respective parties do hereby warrant,
represent, and declare and do acknowledge and agree that each is
and has been fully and completely informed of and is familiar with

I . PROCEDURAL AND FACTUAl. BACKGROUND
The Plaintiff, June E. Mowery (hereinafter referred to as
"Wife"), and the Defendant, Thomas A. Mowery, Sr. (hereinafter
referred to as "Husband"), were married on September 7, 1991 in
Harrisburg, Pennsylvania. No children were born of the marriage.
The parties separated on January 15, 1996. Wife was employed
throughout th~ marriage, and Husband was employed as a business
owner/partner as well as an employee within his business,
Wife filed a Divorce Complaint on December 9, 1994 indexed
to the above term and number in the Court of Common Pleas,
Cumberland County, Pennsylvania. Husband filed an Answer and
Counterclaim to Wife's Divorce Complaint on January 26, 1998
raising the claim of equitable distribution. Wife then filed a
Petition for Economic Relief on April 9, 1998 raising the cliams
of alimony, alimony pendente lite, counsel fees and expenses.
In January of 1998, Husband filed for the appointment of a
Master. Said Master directed Pre-Trial Statements be filed
pursuant to Pa.R.C.P. 1920.33(b).

SCOPE OF SURVEY
The purpose of this survey inspection is to detennine, as much as possible within limitations of
physical and visual accessibility, without the use of evasive or destructive means or methods, the
condition of the subject vessel's structure, systems, cosmetics, levels of compliance with currently
applicable mandatory and voluntary standards, and other industry standards and common
practices. The survey of the marine vessel is based solely on a careful visual inspectionof all
accessible portions of it's structure and available equipment. Only the external condition of the
electrical wiring, connections and systems installations will be inspected. Attention to compliance
with electrical standards is critical to avoiding conditions which will lead to fires, explosions and
personal injury or death.
The Federal Rules and Regulations for Recreational Boats, published and promoted by the
American Boat and Yacht Council (ABYC), the Standards and Recommended Practices For Small
Craft, (also published and promoted by the ABYC, and the recommendations of the National Fire
Protection Association (NFPA), Section 302, provide some of the reference bases for the
surveyor's recommendations where applicable. Where compliance with a standard cannot be
determined, this will be so noted. Insurance Underwriting Standards vary and mayor may not be
known by the surveyor.
The forgoing commentary on the scope of the survey process and it's limitations is designed to
give the purchaser of this service some insight about what can or cannot be expected from the
appraisal survey inspection of a marine vessel. Further qualification remarks may be found in the
body of this survey report as may be required with refere'lce to a specific part of the marine vessel
or it's equipment.
INTRODUCTION
The survey inspection of the marine vessel, 1989 LANDAU 24 PONTOON BOAT was made as
she was hauled and laid in a boat trailer for appraisal inspection on December 6, 1997, at116
Westover Drive, New Cumberland, Pa. 17070.
No reference or infonnation should be construed to indicate any of the following:

2..Elecrronic compliance with manufacturer's published specifications.
This survey represents the unbiased opinion of the undersigned, but it is not to be considered a
warranty either specified or implied. This marine vessel was inspected for compliance widt the
American Boat and Yacht Council and National Fire Protection Association standards and for the
equipment required by the U.S. Coast Guard
The use of the word "appears" is inter.ded to indicate that a close or complete inspection was not
possible or it was not deemed appropriate at the time of this survey. The deficiencies reported
herein renect the conditions observed at the time that this survey was conducted.
