Leroy Hippensteel, Deputy Sheriff, who being duly sworn
according to law, says on January 6, 1995 at 10.40 o'clock A.M.,
E.S.T., he posted the property of Gettys Builders at Lot #24 1202
Kings Circle Mechanicsburg, Cumberland County, pennsylvania with a
copy of Real Estate Writ, Notice, Poster and Description according tc
law.
Audrey G. Adams, Deputy Sheriff, whc being duly sworn according
to law. says on December 30, 1994 at 2.30 o'clock P.M., E.S.T., he
served true copies of Real Estate Writ, Notice, Poster and
Description in the above entitled action upon one of the within
named defendants, to wit. Gettys Builders Inc. by making known unto
Stephen Johansen President of Gettys Builders Inc. at Cumberland
County Sheriff's Office, 1 Courthouse Square, Carlisle, Cumberland
County, Pennsylvania its contents and at the same time handing to him
personally the said true and attested copies of the same.
R. Thcmas Kline, Sheriff, who being duly sworn according to law,
says that he served the above Real Estate Writ, Notice Poster and
Description in the following manner. The Sheriff mailed the within
named defendant, to wit. Gettys Builders a notice of the pendency of
the action by regular mail to sthere last known address at 806
Michigan Avenue, Lemoyne, Pennsylvania 17043. This letter was mailed
under the date of January 9, 1995 and was returned with reason check
UNKOWN. Letter is hereto attached unopened.
R. Thomas Kline, Sheriff, who being duly sworn according to law,
says that after due and legal notice had been given according to law,
exposed the within described premises at public venue or outcry at the
Court Hcuse, Carlisle, Cumberland County, Pennsylvania on March 8. 1995
at 10.00 o'clcck A.M., E.S.T., and sold the same for the sum of $1.00
to Attcrney Richard C. Ruben for Harris Savings Bank, Its successors
and assigns. It being highest bid and the best price received for the same
Harris Saving Bank at P.O. Box 1711 Harrisburg, Pa. 17105, being the buyer
in this Execution paid Sheriff R. Thomas Kline the sum of $2,479.10 it
being poundage, stamps etc. Sheriff's Costs listed below. See attachej
distribution sheet for additional costs.

COMPLAINT
1. Plaintiff, Harris savings Bank, (hereinafter "Harris"), is a
Corporation organized and existing under the laws of the
Commonwealth of Pennsylvania and having its principal place of
business at Second and pine streets, Harrisburg, pennsylvania
17101

with last known address
Pennsylvania 17011-0425.
3. That Defendants, Stephen R. Johansen and Krista Y. Johansen
are husband and wife are adult individuals whose last known
address was 806 Michigan Avenue, Lemoyne, Cumberland County,
Pennsylvania 17043.

at P.O. Box 425, camp Hill,
4. That on or about March 18, 1994 Defendants executed a Note in
favor of Harris Savings Bank in the principal amount of
$165,000.00 at 9.375% interest. said Note was for the purpose
of financing the construction of a "spec" house to be built by
Defendant Gettys Builders, Inc. A true and correct copy of
the Note is attached hereto and incorporated herein as Exhibit
"A",
5. That the Note, Exhibit "A" is secured by a Mortgage on Lot 24
Kings Circle, Hampden Township, Mechanicsburg, Cumberland
County, Pennsylvania dated March 18, 1994 and recorded in the
Office of Recorder of Deeds Cumberland County, Pennsylvania in
Mortgage Book 1202, Page 157 on March 21, 1994. Said mortgage
is a construction mortgage for the construction of the above
referenced "spec" house to be built by Defendant Gettys
Builders, Inc. for sale in the ordinary course of its
business.
6. That Defendants are in default under the terms of the Note in
that they have failed to make monthly interest only payments
as provided for in the Note for the months of october,
November and December, 1994.
