3. On the 14th day of November, 1980, the above named mortgagors
made, executed and delivered a mortgage upon premises hereinafter
described to state capital savings and Loan Association, which
mortgage is recorded in the Office of the Recorder of Deeds for
CUmberland County in Mortgage Book 687 page 538.
4. The premises subject to the said mortgage is described in
Exhibit "A" attached hereto and made a part hereof.
5. The mortgage secures defendants' certain Note dated the same
as the mortgage in the amount of $42,000.00 payable to plaintiff in
monthly installments with interest at the rate of 12.5% per annum. A
copy of the said Note is attached hereto, made a part hereof and
marked Exhibit "B".
6. On the 30th day of September, 1989, the said mortgage was
assigned to FIDELITY BOND AND MORTGAGE COMPANY, the plaintiff herein,
by written assignment which is recorded in the Office of the Recorder
of Deeds for Cumberland County in Mortgage Book 370 page 369.
7. The mortgage is in default because the defendants have failed
to make the payment of the monthly installment of principal and
interest in accordance with the terms of the mortgage for the month of
June 1994, and each month thereafter, up to and including the present
time.
8. The following amounts are due on the mortgage:

Interest at 12.5% per annum from 5/1/94
through 10/31/94 ($12.57 per diem)
Late charges accrued thru 10/31/94 ($17.94/month)
Escrow deficit (taxes and insurance) ($27.33/month)
Attorney's fee (5%)

9. The attorney's fee set forth is in conformity with the
mortgage and Pennsylvania law and will be collected in the event the
premises are purchased by a third party at Sheriff's Sale. If the
mortgage is reinstated prior to sale, reasonable attorney's fees will
be charged based on the work actually performed.
10. On August 18, 1994, plaintiff sent to defendants by
certified mail Notice of Intention to Foreclose Mortgage in accordance
with the provisions of Section 403 of Pennsylvania Act No. 6 of 1974,
a true and correct copy of which is attached hereto, made a part
hereof and marked Exhibit "e".
11. On August 18, 1994, plaintiff sent to defendants by first
class mail Notice of Homeowners' Emergency Mortgage Assistance Act of
1983 in accordance with Pennsylvania Act No. 91 of 1983, a true and
correct copy of which is attached hereto, made a part hereof and
marked Exhibit "D". Defendants have not had the required face-to-face
meeting with the mortgagee within the required time and plaintiff has
received no notice that defendants have had a face-to-face meeting
with a consumer credit agency, nor has plaintiff received notice that
defendants have filed an application with the Homeowners' Emergency
Mortgage Assistance Program.
WHEREFORE, plaintiff demands judgmsnt in the sum of $45,555.17
plus interest and costs and foreclosure of 'he said mortgage.

ALL THAT CERTAIN tract or parcel of land and premises, situate,
lying and being in the Borough of Lemoyne in the County of
Cumberland and Commonwealth of Pennsylvania, more particularly
bounded and described according to a survey of D. F, Raffamaparger,
dated May 11, 1953, as follows.
BEGINNING at a point at the Southwest corner of the intersection of
Walton Street and 7th Street; thence Southwardly along the Western
line of 7th Street, one hundred seventy and sixty-five one-
hundredths (170.65) feet to a point on the Northern line of the
Borough of New Cumberland; thence South fifty-two (52) degrees no
(00) minutes West along same, seventy and two one-hundredths
(70.02) feet to a point at the dividing line between Lots Nos. 63
and 64 on hereinafter mentioned Plan of Lots: thence North thirty-
six (36) degrees thirty (30) minutes West along same, one hundred
seventy-two and forty- seven one-hundredths (172.47) feet to a point
on the Southern line of Walton Street; thence Eastwardly along
same, seventy (70) feet to a point, the place of beginning.

If any monthly installment under this Note Is not paid when due and remains unpaid after a dale specified
