JUDGMENT FOR DISSOLUTION
THIS CAUSE COMING TO BE HEARD for trial by order of Court,
trial commencing May 11, 1994, and proceeding from time to time
thereafter, both parties having been present in open Court in
person and by and through their respective counsel, the Court
having considered and reviewed all of the documents offered and
entered into evidence, the testimony of each of the parties and
witnesses and having reviewed all of the statutory factors
pertaining to child Dupport, maintenance, property divillion,
attorneys fees and college expenses and having considered the
credibility of the witnessell and being fully advised in the
premises;
THE COURT DOES FIND:

7. Plaintiff has proven the material allegations of her
Petition for Dissolution of Marriage by substantial and
competent evidence.
8. Defendant filed in January 1991, 8 Petition for
Contribution for Household ExpenseR, which remained
pending and undetermined and was continued to the time of
trial for disposition; Plaintiff filed in January 1991, a
Petition for Temporary Maintenance, which remained pending
and undetermined and was continued to the time of trial
for disposition; Plaintiff filed in November 1991, a
petition for Temporary support, which remained pending and
undetermined and was continued to the time of trial for
disposition.
9. The Plaintiff, during the period of separation of the
partieo up until May 15, 1994, resided on a conjugal baeis
with an unrelated member of the opposite sex and therefore
is not entitled to temporary maintenance.
10. Defendant's net income as of November 19, 1991, was Four
Thousand Three Hundred Fifteen Dollars and Forty Two Cents
($4,315.42) per month. Applying the statutory guidelines,
the Court orders child support in the amount of One
Thousand Seventy Eight Dollars and Eighty Five Cents
($1,078.85) (representing 25\ of the Defendant's net

monthly income) for the period November, 1991 through
June, 1993. In addition, the Court ordera support in the
amount of Eight Ilundred Sixty Three Dollara and Nine Cents
($863.09) (representing 20\ of Defendant's net monthly
income for the period July, 1993 through July, 1994).
1\ccordingly, the Court finds child fJupport due and owing
from the Defendant to the Plaintiff from November, 1991
through July, 1991 in the amount of Thirty Two Thousand
Seven Hundred Ninety Seven Dollars and Seventeen Cents
($32,797.17). The Court finds Defendant is entitled to a
credit for Ten Thousand Seventy Five ($10,075.00) Dollars
in payments made during that time and One Thousand Seventy
Eighty Dollars and Eighty Five Cents ($1,078.85) for
support not owed during the parties' one month attempted
reconciliation, the Court finds a total net arrearage of
Twenty One Thousand six Hundred Forty Three Dollars and
Thirty Two Cents ($21,643.32) through the majority of the
parties' younger child in July, 1994.
11. Both the prudential Company life insurance policies and
the corporate ownership in the Potteiger Corporation were
gifts from Defendant's father to the Defendant.
1\ccordingly, Defendant's interest in the Potteiger Company
and all distributions therefrom and the life insurance
policies are not marital property.

13. The Forty Four Thousand ($44,000.00) Dollars paid by
Defendant to his parents from the proceeds of the sale of
the marital residence (2400 Bluemont Court, Naperville,
Illinois) must be reimbursed to the marital estate due to
the fact that this was not a loan to the parties based
upon Plaintiff's proof by preponderance of the evidence
that said funds were a gift from the Defendant's parents.
14. There has been dissipati.on by the Defendant in the amount
Ret forth in paragraph 12(g) based upon Eight Thousand
Five Hundred ($8,500.00) Dollars used by the Defendant for
non-family related expenses from his Morse-Diesel IRA and
Seven Thousand Twenty One ($7,021.00) Dollars used by

to the Plaintiff at the rate of Four Hundred Fifty
($450.00) Dollars per month over the next forty-eight (48)
months or until paici in full. No child support for the
period after July, 1994 shall accrue.
G. Based on th~ aforesaid findings, the Court orders a
distribution of the marital estate on the basis of sixty
(60\) percent to the Plaintiff and forty (40\) percent to
the Defendant. The Plaintiff shall receive Eighty One
Thousand Nine Hundred Two ($81,902.00) Dollars from the
marital estate composed of her Five Hundred ($500.00)
Dollar retirement, Seven Thousand ($7,000.00) Dollars from
the proceeds of the marital residence already received,
the Mazda automobile, and Seventy Four Thousand Four
Hundred Two ($74,402.00) by way of cash paymsnt from the
Defendant.
H. Defendant will receive Fifty Four Thousand Six Hundred One
($54,601.00) Dollars consisting of his 1994 Jeep Cherokee
valued at a net equity of Fifteen Thousand Five Hundred
($15,500.00) Dollars, his Principal Financial Group IRA in
the amount of Twenty Five Tpousand ($25,000.00) Dollars,
and cash in the amount of Fourteen Thouaand. One Hundred
One ($14,101.00) Dollars. As indicated, and in order to
accomplish this division, Judgment is entered in favor of
the Plaintiff, PATRICIA H. TOOLE and against Defendant,

MICHAEL TOOLE in the amount of Seventy Four Thousand Four
Hundred Two Dollars ($74,402.00) to be paid with interest
at the statutory rate in equal monthly installments of One
Thousand Five Hundred Fifty Dollara and Four Cents
($1,550.04), plus intereat, over the next forty-sight (48)
months or until paid in full.
I. In addition to the foregoing, Defendant, MICHAEL TOOLE,
ahall pay to the Plaintiff, PATRICIA H. TOOLE, as and for
rehabilitative maintenance, the sum of Eight Hundred
($800.00) Dollars per month for a period of thirty-six
(36) months, which rehabilitative maintenance will
terminate upon the expiration of three (3) yearn, the
death of either party, the remarriage of the Plaintiff or
the resumption of cohabitation on a continuous conjugal
basis with an unrelated male, whichever occurs first.
J. In addition to the foregoing, the Court orders Defendant,
MICHAEL TOOLE to reimburse the Plaintiff, PATRICIA H.
TOOLE, One Thousand Two Hundred Fifty Eight ($1,258.00)
Dollars in medical expenses incurred by the minor children
of the parties during the pendency of this action based
upon his far superior ability to pay said amounts and an
additional judgment in said amollnt is entered in favor or
the Plaintiff, PATRICIA H. TOOLE and against Defendant,
MICHAEL TOOLE.
