COMPLAINT
1.) Plaintiff is a federally chartered Credit Union with
its place of business in Hampden Township, Cumberland County,
Pennsylvania; on April 11, 1994, the Credit Union changed its
name from Defense Activities Federal Credit Union to Members 1st
Federal Credit Union.
2.) Defendant, Laurie E. Garrett, formerly Laurie E.
Clawson, is an adult individual whose last known residence was
2147 Ritner Highway, Shippensburg, Cumberland County,
Pennsylvania.
3.) Defendant, John A. Clawson, Jr" is an adult individual
whose last known residence was Lot 22, 967 West Trindle Road,
Mechanicsburg, Cumberland County, Pennsylvania.
4.) On April 30, 1990, John A. Clawson, Jr. and Laurie E.
Clawson, being husband and wife, executed 'and delivered a note in
the amount of $8,794.73 in favor of Defense Activities Federal
Credit Union to secure payment of a loan to them (Exhibit A)
which was used to purchase a 1981 Derose Mobile Home,
Title No. 33890138703 CL, the title to which contained an
encumbrance in favor of Plaintiff (Exhibit D) ,
5.) The Defendants failed to pay the loan according to its
terms and it has been in arrears since April 1, 1994; the unpaid
balance on that date was $5,162.56, with interest from that date
at the rate of 13' per annum ($1.84 per day) .
6.) Plaintiff has demanded payment, but defendants have
failed or refused to pay the same.
7,) Notice of Plaintiff's intention to repossess the mobile
home was given pursuant to 69 P.S. 623 to John A. Clawson Jr. on
September 4, 1994, by certified mail and by regular first class
mail addressed to him at his address at the time, viz: 2264
Woodley square No.3 240, Montgomery, Alabama; the certified mail
was returned unclaimed and the first class mail was not returned,
said notice is attached as Exhibit C.
B.) Said notice was given to Laurie E, Clawson on September
4, 1994, by certified mail and regular first class mail addressed
to her at the site of the mobile home, viz: Lot 15, Shippensburg,
Mobile Estate, Shippensburg, Pennsylvania; the certified mail was
returned unclaimed and the first class mail was not returned,
said notice is attached as Exhibit D.
9,) No action was taken by either Defendant to bring the
account up to date after said notice was sent.
WHEREFORE, Plaintiff is entitled to the following relief:
a,) The right to recover possession of the mobile
home, and

Notice of Inteotion to Repossess Mobile Home
Pursuant to 69 1',S, 623, Members 1st Federal Credit Union,
formerly lJefense Activities Federal Credit Union gives notice to
tho above Laurie g, Clawson and John A. Clawson Jr. that the loan
daLod Al'l:.ll 30, 1990, in the amount of $0,794,73 eecured by the
titlo Lo u 1901 lJeHoae Mobile 1I0me, title number 33090138703 CL
is in default for failure to make payments of $245.21 per month
as provided in the agreement. 'I'he unpaid balance of the loan as
of April 1, 1994, is $5,162.56, Interest accrues on the loan at
the rate of 13t per annum or $1.84 per day. as of the date of
this notice the unpaid principal and interest totals $5,354.92.
You have the right to pay in cash, cashiers or certified
check the amount which would have been due at the time of payment
in the absence of default, As of September 6, 1994, this amount
is $1,307.31 which includes $81.26 in late chargee. On October
6, 1994, the amount will be $1,572.84. Payment of this amount
will reinstate the loan as though no default had taken place.
Failure to cure the default within 35 days will result in the

Pursuant to 69 P,S. 623, Members 1st Federal Credit Union,
formerly Defense Activities Federal Credit Union gives notice to
the above Laurie E, Clawson and John A. Clawson Jr. that the loan
dated April 30, 1990, in the amount of $8,794.73 secured by the
title to a 1981 Derlose Mobile Home, title number 33890138703 cr.
is in default for failure to make payments of $245.21 per month
as provided in the agreement, The unpaid balance of the loan as
of April 1, 1994, is $5,162.56. Interest accrues on the loan at
the rate of 13% per annum or $1.84 per day. as of the date of
this notice the unpaid principal and interest totals $5,354.92.
You have the right to pay in cash, cashiers or certified
check the amount which would have been due at the time of payment
in the absence of default. As of September 6, 1994, this amount
is $1,307.31 which includes $81.26 in late charges, On October
6, 1994, the amount will be $1,572.84. Payment of this amount
will reInstate the loan as though no default had taken place.
Failure to cure the default within 35 days will result in the
