COMPLAINT
1. The plaintiff, Ginevra J. Marchi, is an adult individual
residing at 414 East Green Street, Shiremanstown, Cumberland County,
Pennsylvania 17011.
2. The defendant, Timothy Witters, is an adult individual
residing at 412 East Green Street, Shiremanstown, Cumberland County,
Pennsylvania 17011.
3. At all times relevant hereto plaintiff was the owner of a
certain above-ground swimming pool situate in the rear yard of her
home at 414 East Green Street, Shiremanstown, Cumberland County,
Pennsylvania.
4. On or about June 1B, 1994, defendant, without the consent ot
plaintiff, used the plaintiff's swimming pool and allowed minors in
defendant's custody and control to use plaintifi's swimming pool in a
negligent manner causing substantial damage to said pool.
5. Because of the negligence and actions of defendant and minors
in the custody and control of the defendant, plaintiff's swimming pool
was totally destroyed causing damages to the plaintiff of $2,579.00.

PLAINTIFF'S REPLY TO NEW HATTER
AND NOW comes the plaintiff, Ginerva J. Marchi, by and through
her attorneys, Stone LaFaver & Stone, and hereby replies to the new
matter of the defendant as follows:
6. The allegations of paragraphs 1 through 5 of plaintiff's
complaint are incorporated herein by reference thereto.
7. The defendant has set forth a conclusion of law to which no
response is necessary.
8. Admitted.
WHEREFORE, the! 'aintiff, Ginerva J. Marchi, requests judgment in
her favor and against the defendant, Timothy Witters, for the sum of
Two Thousand Five Hundred Seventy-nine and NO/lOO ($2,579.00) Dollars,
together with costs of suit.
