S & A HOMES STIPULATION AGAINST LIENS WHEREAS, JOSEPH E. CONNOLLY, (the "Owner"), has executed or is about to execute contemporaneously herewith a contract with S & A HOMES, (the "Contractor"), for construction of a single family dwelling (collectively the "Improvements") on a tract of land located on BARBARA DRIVE, situate in the Township of Hampden, County of Cumberland, Pennsylvania, known as Lot No. 301, Phase V, Good Hope South, Plan Book 79, Page 91, and more particularly described in Exhibit A attached hereto, incorporated herein by reference and made a part hereof (the "Premises"). NOW, JULY 19, 2002, before any authority has been given by the Owner to the Contractor to commence work on the Improvements, or to purchase materials for the same, or to enter into any contracts with any subcontractors or material men, or to authorize any purchases by or through any subcontractors or material men, in consideration of the making of said contract with the Owner and the further consideration of One ($1.00) Dollar, to Contractor paid by Owner, and with the intent of all parties to be legally bound hereby, it is agreed that no lien shall be filed against the Improvements, the Premises, or any part thereof, by the Contractor or any subcontractor, or by any of the material men or workmen or any other person for any labor, or materials pumhased, or extra labor or materials purchased, for the Improvements to the Premises (including hereafter changes made thereto), the right to file liens being expressly waived. It is the full intent of the Contractor, for himself and for any subcontractors or material men claiming for themselves, or by, through or under the contract or the Contractor, that the right to file a mechanic's lien, under the provisions of law and/or of Acts of Assembly in such cases made and provided, for work done or materials furnished in ad about the construction of the Improvements to the Premises is hereby waived. WITNESS: OWNER: 1'1 E~ONNOLLY CONTRACTOR: / ~ & A HOMES EXHIBIT "A" - STIPULATION AGAINST LIENS LEGAL ALL THAT CERTAIN piece, parcel or lot of land, together with improvements, situated in the Township of Hampden, County of Cumberland and Commonwealth of Pennsylvania, bounded and described as folows: BEGINNING at a point on the northern right of way line of Barbara Drive (50 feet wide), said point being located at the southwestern corner of Lot No. 302; thence along said right of way line on the arc of a circle curving to the left, having a radius of 175 feet, and an arc length of 90 feet to a point at the northeastern corner of Lot No. 299; thence along the northern boundary line of Lot No. 299, North 59 degrees 27' 7" West, for a distance of 239.06 feet to a point on the southern right of way. line of Skyport Road (50 feet side); thence along said right of way line of Skyport Road on the arc of a circle curwng to the right, having a radius of 1,243.24 feet and an arc length of 209.04 feet to a point; thence on the arc of a circle curving to the right, having a radius of 3,139.63 feet, and an arc length of 29.25 feet, to a point at the northwestern corner of Lot No. 302; thence along the western boundary line of Lot No. 302, South 29 degrees 59' 7" East, for a distance of 139.69 feet to a point and the place of beginning. BEING known as LOT NO. 301 on the Revised Final Subdivision Plan for Good Hope Farms South - Phase V, Lot Nos. 299,301 and 302, which is recorded in Cumberland County, Plan Book 79, page 91. ALSO BEING known as 5585 Barbara Drive, Mechanicsburg, Pennsylvania, 17050. PARCEL NO. 10-19-1602-123 (Connolly.pfd/CONNOLLY/14)
