Prior to any commencement of construction, Defendant drew sketches 01' the proposed building and calculated what materials would be needed for the construction 01' said building. 5. Under the terms 01' the oral agreement, the parties agreed that the construction project would be paid on Ii time and materials basis, with the Defendant ordering all matsrials and Plaintiff paying for said materials. 6. Under the terms of the agreement, the parties agreed that labor would be paid atehe rate of $10.00 dollars per hour per man. 7. The Defendant, Barry L. Deitch, individually and t/d/b/a B.L. Deitch Home Improvements, thereafter contacted certain subcontractors to pursue the excavation, the laying of the footers and the pouring of concrete for the flooring. 8. The Defendant, Barry L. Deitch, individually and t/d/b/a B.L. Deitch Home Improvements, his servants, agents and employees thereafter completed the construction project which included, but was not limited to, framing out the building, installing the rafters, installing the siding, doors, windows, facia, and shingles. 9. In installing the rafters, the Defendant, Barry L. Deitch, individually and t/d/b/a B.L. Deitch Home Improvements, his servents, agents and employees put four foot exposed collar ties all the way across the roof. 10. construction of the building was completed on or about November 19, 1993. 11. On or about February 19, 1994, the Plaintiff was notified that the building constructed by the Defendant had collapsed. 12. On or about February 19, 1994, the Plaintiff visited the site where the building had been constructed and confirmed that the building had collapsed. 13. The total costs expended by Plaintiff for construction of said building was $11,412.31. 14. The total cost that will be incurred by Plaintiff in cleaning up the premises is $3,000.00. COUNT I NEGLIGENCE 15. Plaintiff incorporates herein by reference the allegations contained in paragraphs 1 through 14 above as though the same were set forth herein at length. .. 16. The negligence 01' Defendant consisted of: A. Failing to insure that the connections of the rafters and their collar ties were structurally adequate to support the snow load experienced by this building; B. Failing to insure that the roof system of the structure was adequately dssigned to withstand the snow loads recommended by the BOCA National Building Code; and C. Such other negligence which may be discovered at a later date. 17. As the direct result of Defendant's negligence, the building constructed by Dsfendant collapsed and the plaintiff sustained the damages more fully described herein above. WHEREFORE, Plaintiff demands that Judgment be entered against the Defendant and for the Plaintiff in an amount in excess of Ten Thousand Dollars ($10,000.00). COUNT II BREACH OF WARRANTY 18. Plaintiff incorporates herein by reference the allOlgations contained in paragraphs 1 through 17 above as though the same were setforth herein at length. 19. IN THB COURT OF COMMON PLBAS CUMBBRLAND COUNTY, PBNNSYLVANIA CIVIL ACTION - LAW NO. 94-7062 CIVIL TBRM ANSWER WITH NBW MATTBR AND NOW comes the Defendant by its Attorney David F. Tamanini and files this Answer based upon the information set forth herein. 1. Admitted 2. Admitted 3. Denied. No agreement in the nature of a contract or of any other nature was made for the construction of a 24 foot X 32 foot building on property owned by the Plaintiff in Cook Township. By way of further answer the Plaintiff and Defendant Barry Deitch discussed a collaborative effort under the direction of the Plaintiff for construction of a structure on the set property. 4. Admitted to the extent that the Defendant assisted in the drawing of sketches, and calculated the costs of materials for construction. Denied that any contractual obligation or relationship existed between the parties. S. Denied that an oral agreement in the nature of a contract or otherwise existed. Denied that the project would be on a time and materials basis, Defendant on friendly basis, because of a longstanding friendship with the Plaintiff, had agreed to secure materials at his cost for the Plaintiff, and any labor oharged for would be at oost in the nature of s.ouring employees to do the bidding of the Plaintiff for the oonstruotion of the struoture. Admitted that the Defendant did order materiallil and that the Plaintiff paid for materials. 6. Admitted to the degree that the rate per man hour was agreed at $10 per hour. Denied that the Defendant had entered into a oontraot to secure labor, no oontractual relationship existing between the Plaintiff and the Defendant. 7. Admitted that suboont~aotors were oontaoted. Denied that any suboontractor relationship existed betwsen the parties. B. Denied. No contractual relationship existed between the parties. To the extent that employees of the Defendant were partioipants in the conctruction of the project, it was not on the basis of a contraotual relationship between any of the parties. 9. Admitted that four foot collar ties were plaoed aorOBB the roof. Denied that any contractual relationship existed between the Plaintiff and the Defendant for the design of the project, or selection of materials. By way of further answer, the Defendant adamantly opposed the Plaintiff' s selection of materials and design, but on a non-contractual friendship basis, acquiesced to the demands of the Plaintiff. lO.
