COHPLAINT
AND NOW comes the plaintiff, F & G Properties, by and through its
attorneys, Stone La Faver & Stone, and sets forth the followingl
1. The plaintiff, F & G Properties, is a Pennsylvania sole
proprietorship having a mailing address of Post Office Box 75,
Halifax, Dauphin County, Pennsylvania 17032.
2. The defendants are Douglas DiSante and Brenda Weigle, now by
marriage Brenda DiSante, adult individuals residing at 35 Fort Street,
A~artment 1, Lemoyne, Cumberland County, Pennsylvania 17043.
3. On or about April 17, 1994, the plaintiff leased to the
defendants a certain apartment known as Apartment 4, 2801 Market
Street, Camp Hill, Cumberland County, Pennsylvania 17011 to the
defendants. A copy of the written lease agreement between the plain-
tiff and defendants is attached hereto as Exhibit "A" and incorporated
by reference herein.
4. The defendants have defaulted under the lease agreement in
that they have failed to make payments as required therein. Further,

defendants are in default under the lease agreement in that they
vacated and abandoned the leased premises on or about December 3,
1994.
5. The defendants also defaulted under the lease agreement as a
result of their having a water bed at the leased premises in direct
violation of paragraph 24 of the lease agreement between the plaintiff
and defendants. The defendants also breached the lease agreement as a
result of their failing to provide insurance as required under para-
graph 11 of the lease agreement.
6. As a result of the defendants moving from the premises prior
to the expiration of the lease term, the plaintiff is entitled to
accelerate the rent for the balance of the term as provided under
paragraph 30 of the lease agreement.
7.' The amount due and owing due plaintiff from defendant as of
December 16, 1994, is as follows:
Rent for October, November
and December 1994
$ 890.00
Rent for January 1, 1995,
through May 1, 1995
Total rent
$2.225.00
$3,115.00
8. The plaintiff is also entitled under paragraph 5 of the lease
agreement to $5.00 per day late fee until payment is received from the
defendants.
9. The plaintiff, as a result of defendants' failure to properly
maintain the premises, has been required to paint the hardwood floors
in the living room and dining room and further has been required to

WITNESSETH, that the Lessor, in consideration of the rents and covenants hereinafter mentioned,
does demise and lease to the Lessee, to be used as a single family residence only, the premises known as

To have and to hold unto the Lessee, subject to the conditions of this Agreement for the term beginning on
the first day of _June_, 1994_, and ending on the last day of May , 19_95_.
IN CONSIDERATION OF WHICH, Lessee agrees to pay the Lessor for the use of said premises,
the sum of ]ifty-three hundred forty dollars ( $5340.00 ). and other
considerations as hereinafter set forth, payable in equal monthly installments of Four hundred forty-five
dollars ($_445.00 ), on the FIRST day of each month of the term, in advance.
