O'Brien, a minor, and they reside together at 1011 Northfield Dr.,
Carlisle, Cumberland County, pennsylvania.
2. The defendant, Bonnie Lyons, is an individual residing at
150 Faith Circle, Carlisle, Cumberland County, Pennsylvania.
3. On February 24, 1993, the defendant, Bonnie J. Lyons, was
operating a day care center in her home at 150 Faith Circle,
Carlisle,Cumberland County, Penna.
4. At the sarne time and place, Kyle A. O'Brien, a minor,
approximately 18 months of age, was one of the children receiving
day care at the Lyons' home during daytime hours.
5. On this date, the defendant claims she attempted to remove
Kyle A.O'Brien from a playpen when the minor plaintiff's left leg
became caught in a hole in the floor of the said playpen.
6. The defendant attempted to remove the minor plaintiff from
the playpen with such force that she fractured the minor
plaintiff's left femur.
7. The defendant had a duty to inspect and make sure that the
playpen was safe for use by the minor plaintiff.
8. The defendant knew or should have known that there was a
hole in the floor of the playpen, and, therefore, she should not
have been using it at the time of this accident.
9. The serious injury was caused by the negligence of the
defendant in the following respects I
a. In failing to use reasonable care when removing
Kyle A. O'Brien from the playpen.
b. In failing to repair or replace the said playpen
when she was aware it was defective.
WHEREFORE, the plaintiff claims of the defendant an amount in
excess of the sum requiring compulsory referral to arbitration
under the local rules of court.
