5. Between February 2, 1994, and February 22, 1994,
various products, goods, supplies, and materials (hereinafter
collectively referred to as "products") were ordered by Defendant
from Plaintiff. Plaintiff sold and provided the products ordered
by Defendant, the same being represented by the invoices attached
hereto and made a part hereof and collectively referred to as
Exhibit "A".
6. The prices charged for the products sold to
as set forth in Exhibit "A" were the fair, reasonable, and market
prices of the products, and the prices that Defendant agreed to
pay.
7. The invoices attached to Plaintiff's Complaint as
Exhibit "A" represent products sold by Plaintiff and purchased by
Defendant pursuant to Defendant's account with Plaintiff.
8. Defendant has not objected to any of these invoices
and has accepted the products provided thereby, but has failed to
pay Plaintiff despite demand pursuant to its open account, all to
the damage of Plaintiff.
9. Plaintiff has submitted to Defendant statements of
account accurately showing all debits and credits for transactions
with Defendant, said statements of account showing an amount owing

AND HOW, comes Plaintiff, APPLEBY BROS. , WHITTAKER CO., by
its attorneys, KUNDRAT , SEDOR, and states the following cause of
action:
1. Plaintiff, APPLEBY BROS. , WHITTAKER CO., is a
Pennsylvania corporation with offices and/or a place of business
situate at 230 S. Tenth Street, Lemoyne, CUmberland County,
Pennsylvania.

3. Defendant JAKES ALLISON, is an adult individual with
a last known address of 7059 Linglestown Road, Harrisburg, Dauphin
County, Pennsylvania. Defendant during all relevant times hereto
conducted business under the fictitious name of "JAMES ALLISON
MECHANICAL CONTRACTOR".

3. Plaintiff is, and at all relevant times was, a
wholesale distributor of building supplies.

5. Between February 3, 1994, and February 23, 1994,
various products, goods, supplies, and materials (hereinafter
collectively referred to as "products") were ordered ~y Defendant
from Plaintiff. Plaintiff Bold and provided the products ordered
by Defendant, the same being represented by the invoices attached
hereto and made a part hereof and cOllectively referred to as
Exhibit "A".

.. The prices Charged for the products sold to
as set forth in Exhibit "A" were the fair, reasonable, and market
prices of the products, and the prices that Defendant agreed to
pay.

7. The invoices attached to Plaintiff's Complaint as
Exhibit "A" represent products sold by Plaintiff and purchased by
Defendant pursuant to Defendant's account with Plaintiff.

e. Defendant has not objected to any of these invoices
and has accepted the products provided thereby, but haB failed to
pay Plaintiff despite demand pursuant to its open account, all to
the damage of Plaintiff.

The bulk of our debt with Appleby Bros. & Whittaker Co. was
incurred when we purchased 5 steam heater units for installation
at Phoenix poultry, Inc., 70 Konhaus Rd., Mechanicsburg.
The units were partially installed when we halted work due to
non-payment of $35,000.00 in billings owed to us by Phoenix Poultry.
The units were removed and returned to our office. They were
not used and are no longer in their original packing cartons.
We propose;
1. to have the units appraised by Appleby Bros.
2. to return the units to Appleby Bros.
3. to accept a restocking charge of 15%
4. to agree on terms if a balance due remains.

1) This statement is rendered on behalf of Allison Mechanical
Contracting Inc., 7059 Linglestown Road, Harrisburg, PA 17112,
because the undersigned will be out of state on the hearing
date.
2) On 27 Sep 94 a telephone conversation was held between
Jim Allison of Allison Mechanical and John Kundrat, an
attorney representing Appleby Bros & Whittaker Co., regarding
a debt in the amount of $4,356.63. It was agreed between
Jim Allison and John Kundrat that Allison Mechanical would pay
$700.00 per month until the debt was paid. John Kundrat ~as
to present this offer to Appleby's and call Allison Mechanical
back if it was an acceptable arrangement. John Kundrat never
called back.
3) Allison Mechanical received a letter from John Kundrat,
dated 13 Oct 94 advising us that payment of $700.00 was not
received as promised. He was contacted immediately and was
informed that, as he never confirmed any kind of payment plan,
maybe we could still come to some kind of agreement.
4) Allison Mechanical, on 19 Oct 94, proposed to have the units
appraised by Appleby Bros, return the units to Appleby's, to
accept a restocking charge of 15% and to agree on terms if
a balance remained. This proposal was FAXED to John Kundrat
on 19 Oct 94. Allison Mechanical never received a reply to
this proposal.
5) On 27 Oct 94 Allison Mechanical received a certified
letter from John Kundrat informing us of a judgement hearing to
be held on 26 Nov 94. Allison Mechanical again contacted John
Kundrat. In the discussion we again offered to return the
material which was still new and had not been used. The heaters
were installed but half-way through the installation the company
we were installing them for, Phoenix poultry of Mechanicsburg,
PA., informed us that his debt of $35,000.00 could not be paid.
Consequently Allison Mechanical ceased installation and removed
the heaters (which still had not been turned on).
