breaking a mirror and repeatedly pushed her in the chest with both his hands
stopping only when a friend of the plaintiff's entered the room.
b. In or ahout August 1994, the defendant forcefully pushed the
plaintiff against a door causing her to fall and cut her foot. A copy of a
picture of this injury is incorporated herein and marked Exhibit A.
c. Since approximately 1992, the defendant has on several different
occasions placed his face inches from the plaintiff yelling obscenities and
repeatedly poking her in the Cace and chest, thrown objects at her, prevented
her Crom leaving rooms, and repeatedly pushed her. The deCendant has
threatened the plaintiCC's liCe saying such things as the following: when he
hits the plaintiff it will be the "last time" and something could happen to
her and the property which could look like it waH Crom natural causes, such as
a fire.
5. The plaintifC believes and thereCore avers that she will be in
immediate and present danger of abuse from the deCendant and that is in need
oC protection Crom such abuse.
6. The plaintiCC desires that the defendant be ordered to refrain Crom
having any contact with her including, but not limited to, entering her place
oC business, stalking the plaintiCC, and harassing the plaintiCC or her
relatives.
7. The plaintiCC desires that the deCendant be ordered to reCrain Crom
damaging, destroying, or removing any property owned by the plaintiCf or any
property owned jointly by the parties.
B. EXCLUSIVE POSSESSION
8. The home which the plaintiff is asking the Court to exclude the

defendant fros is owned In the n88es of the plaintiff and the defendant.
9. The plaintiff desires possession of the residence because she
operates a business out of her hose. The plaintiff filed for divorce in
August 1994, and the defendant continues to refus~ to Bove out of the
residence even though the plaintiff is paying the household bills.
10. The defendant has brothers in the area with who. he could live.
C. ATTORNEY FilES
11. The plaintiff anks that the defendant be ordered to pay reasonable
attorney fees of this lawsuit pursuant to the Protection fro. Abuse Act.
WHEREFORE, pursuant to the provisions of the "Protection fro. Abuse Act"
of October 7, 1976, 23 Pa.C.S.A. Section 6101 ~ ~., as 88ended, the
plaintiff prays thin Honorabie Court to grant the following relief:
A. Grant a Tellporary Order pursuant to the "Protection fro. Abuse Act":
1. Requiring the defendant to refrain fro. abusing the
plaintiff or placing her in fear of abuse.
2. Requiring the defendant to refrain fro. having any
contact with the plaintiff including, but not li.ited to, entering the
plaintiff's place of business, stalking the plaintiff, and harassing the
plaintiff or her relatives.
3. Granting possession of the home located at 204 S. Front
Street, Wormleysburg, Pennsylvania, to the plaintiff to the exclusion of
the defendant pending a final order in this Batter.
4. Ordering the defendant to stay away fro. any residence
the plaintiff may in the future establish for herself.
5. Ordering the defendant to refrain fro. daaaging, destroying,o

or removing any property owned by the plaintiff or any property
owned jointly by the parties.
B. Schedule a hearlng in accordance wlth the provisions of the
"Protection from Abuse Act," and, after such hearlng, enter an order to be in
effect for a period of one year:
l. Requiring the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse.
2. Requiring the defendant to refraln from having any
contact with the plaintiff including, but not limited to, entering the
plaintiff's place of business, stalking the plaintiff, and harassing the
plaintiff or her relatlves.
3. Granting possession of the house located at 204 S. Front
Street, Wor.leysburg, Pennsylvania, to the plaintiff to the exclusion of
the defendant.
4. Ordering the defendant to stay awsy from any residence the
plaintiff may in the future establish for herself.
5. Ordering the defendant to refrain from damaging, destroying or
removing any property owned by the plaintiff or any property owned
jointly by the parties.
6. Ordering the defendant to pay reasonable attorney fees.
The plaintiff further asks that this Petition be filed and served
without payment of costs, pending a further order at the hearing, and that a
copy of this Petition and Order be delivered to the Wor.leysburg Police

Dear Hubert:
I have met with my client since our last exchange of
correspondence. There are still some problems we should address
immediately to avoid bigger problems down the road and I write to
request your assistance in these matters.
The first item is the financial condition of the household.
Your client is making no contribution to the household, including
the payment of the mortgage which encumbers the building, yet he
continues to live there. Obviously, if he intends to continue to
live in the house, he should contribute his fair share of the
household expenses. He seems to feel that he will make a great
living selling commercial real estate. If that is the case, he
certainly should be able to make a reasonable contribution to the
household expenses.
The second matter involves the rental properties the parties
own on Derry Street in Harrisburg and in York Springs. Mr.
Aiello has been collecting the rent from the Derry Street
property but has not made the mortgage payments. We suspect he
may not have made other payments due on that property and that he
is, in effect, using the rent to pay his personal expenses. That
property is in my client's name and she is the one who will
suffer the injury if the payments are not made. Accordingly, she
will direct the tenants to make all future rental payments to
her, from which she will pay the mortgage and the other expenses
of the building. Because we are concerned about the York Springs
property, which is also in her name, she will make similar
arrangements for that property as well. Please advise your
client that she should not attempt to collect rents from any of

under the Protection from Abuse Statute. In that order, the defendant was prohibited

PROBABLE CAUSE BELIEF IS !lASED ON THE FOLLOWING FACTS AND CIRCUMSTANCES: (see instruc.
~Iow) On January 15. 1995 at 13:45 hours this officer was dispatched to 204
South Front Street Borough of Wormleysburg for a active violation of a Protection From Abuse
Order. Based on scene investigation and interview of William Muniz and ANNA MUNIZ they
both state that defendant AIELLO did enter a restricted bedroom and remove a clothing
dresser and defendant also had entered the downstairs lobby of Sculptured Images Hair
Salon and attempted to remove a television before he encountered WILLIAM MUNIZ who
then immediately contacted this police department.
THis officer then did speak with Defendant WILLIAM AIELLO who stated that he did in fact
enter the bedroom/hallway area to obtain the dresser and attempt to remove the above T.V.
from lobby as indicated above.

following Order is entered by agreement of the parties, it is
hereby ordered and directed as follows:
1, This Court's prior Orders of December 30, 1994 and
January 6, 1995 are hereby amended such that the
Petitioner, Sara L. Aiello, is granted exclusive
possession of the entire marital residence at 204 South
Front Street, Wormleysburg, PA. Defendant is prohibited
from entering the marital residence and is prohibited
from entering the hair salon business operated by the
Petitioner at that address.
2. Defendant, William A. Aiello, may make arrangements to
go to the residence with a constable or police officer to
retrieve the following personal belongings from the home:
his clothes, his daughter's single wooden bed, two wooden
dressers, the bed in the garage, the tools and related
items, and his miscellaneous personal itoms such as
photographs, books, etc.
