AND NOW, comes Defendant, Rita Anstead, through her
attorneys I Saidis, Guido, Shuff & Masland and answers as follows:
1. Admitted.
2. Admitted.
3. Admitted.
4. Admittec in part and denied in part. It is admitted
that the Plaintiffs were providec with a copy of the disclosure
statement. Defendant, after reasonable investigati~n, is without
knowledge or information sufficient to form a belief as to when
and how the disclosure statement was provided to the Plaintiffs.
5. Admitted in part and denied in part. It is admitted
that Exhibit "B" is a contract between the parties dated April
18, 1994. With regard to the allegation as to how the contract
was provided to the plaintiffs, Defendant, after reasonable
investigation I is without knowledge or information sufficient to
form a belief as to the truth of the averment.
6. No answer is required as the averments of paragraph 6
state a conclusion of law.
7. No answer is required as Exhibit "A" speaks for itself.
8, Denied. On the contrary I the roof did not leak during
the period of ownership of the Defendant. By way of further
answer I the information contained in the disclosure statement was

9. No answer is required as the averments of paragraph 9
state a conclusion of law. By way of further answer, Defendant
made no misrepresentation and proof thereof is demanded at the
time of trial.
10. Denied. On the contrary, the information contained in
the disclosure statement was true and correct to the best of
Defendant's knowledge I information and belief.
11. No answer is required to the extent that the averments
of paragraph 11 state a conclusion of law. With regard to the
factual allegations, Defendant, after reasonable investigation,
is without knowledge or information to form a belief as to the
truth of the averments. By way of further answer I to the best of
the Defendant's knowledge I information and belief I the roof did
not leak at the time the disclosure statement was signed nor at
the time of settlement.
12. Denied. After reasonable investigation I Defendant is
without knowledge or information sufficient to form a belief as
to the truth of the averment and proof thereof is demanded at the
time of trial.
13. Admitted that the contract was dated April 18, 1994.
As to the averment concerning Plaintiffs' reading of the
disclosure statement I the Defendant, after reasonable
investigation I is without knowledge or information sufficient to
form a belief as to the truth of the averment and to the extent
it is relevant, proof thereof is demanded at the time of trial.

18. The residence was built in approximately 1973.
19. The Plaintiffs were advised that the roof was the
original roof and had not been replaced.
20. The Plaintiffs did not request a roof inspection.
21. The contract between the parties dated April 18, 1994,
attached to the Complaint as Exhibit "B", provides in part as
follows as paragraph 16:
REPRESENTATIONS: IT IS UNDERSTOOD THAT THE BUYER HAS
INSPECTED THE PROPERTY I OR HEREBY WAIVES THE RIGHT TO
DO SO AND HE/SHE HAS AGREED TO PURCHASE IT AS A RESULT
OF SUCH INSPECTION AND NOT BECAUSE OF OR IN RELIANCE
UPON ANY REPRESENTATION MADE BY THE SELLER . . .
AND THAT HE/SHE HAS AGREED TO PURCHASE IT IN ITS PRESENT
CONDITION UNLESS OTHERWISE SPECIFIED HEREIN AND FURTHER
ACKNOWLEDGES THAT THE AFOREMENTIONED PARTIES ARE NOT

For the Sale and Purchase of Real Estate" (hereinafter "the
Contract"), herein attached as Exhibit B.
6. Defendant had a duty to disclose all material facts to
the Plaintiffs provided for in the Disclosure Statement.
7. Defendant, in her Disclosure Statement, under item
number 3, with the heading marked "Roof", answered "no" to
question (cl; which states: "Has the roof ever leaked during your
ownership?"
8. On information and belief, Defendant knew the roof
leaked.
9. On information and belief, Defendant intended to have
Plaintiffs rely on the misrepresentation.
10. The condition of the roof was not as represented in the
Disclosure Statement.
11. The roof is defective in that it leaks, allowing water
to enter into the residence.
12, The estimated cost to place the roof in the condition as
represented in the Disclosure Statement is $1,960.00.
13. On April 18, 1994, Plaintiffs read the Disclosure
Statement and agreed to the selling price by signing the
Contract.
14. Plaintiffs would not have signed the Contract if the
Disclosure Statement had accurately revealed the condition of the
roof.
15. Plaintiffs reliance on the Defendant's Disclosure
Statement was justifiable.
16. The Plaintiffs purchased the residence on June 17, 1994.
