In 1988, following the above referenced divorce in the Court of Common Pleas of Cumberland County, Pennsylvania, the Petitioner, Susan M. Barrick, was awarded full legal and physical custody of her daughter, Kenli Marie Hill. 7. The natural father of Kenli Marie Hill, Kenneth A. Hill, has had only sporadic contact with her and his conduct prior to incarceration was incompatible with the concept of a family unit. 8. The current incarceration of Kenneth A. Hill is for an extended period of time making a normal parent-child relationship impossible. 9. Petitioner's second minor daughter, McKenzie Hartman Hill, is a juvenile born February 22, 1990 and currently residing with her mother and step-father, Keith A. Barrick, at the above address. 10. The juvenile Petitioner in Paragraph 8, McKenzie Hartman Hill, prior to the above address, lived in Carroll Township, York County, Pennsylvania and Upper Allen Township, Cumberland County, Pennsylvania and has always lived with her mother. 11. The natural father of McKenzie Hartman Hill is David A. Hartman. 12. David A. Hartman and Susan M. Barrick were never married and never co-habitated. 13. David A. Hartman has never lived with McKenzie Hartman Hill. 14. David A. Hartman has no objection to the name change of McKenzie Hartman Hill to McKenzie Hartman Barrick. 15. There are no judgments or decrees of like character or record against either of the juvenile Petitioners in Cumberland County, Pennsylvania or any other jurisdiction. 16. Neither of the juvenile Petitioners has ever been arrested or been involved in any criminal trouble of any nature. 17. Hill, by his counsel, Francis M. Socha, and petitions this Honorable Court for a Writ of Habeas Corpus Ad Testificandum and in support thereof, avers the following: 1. The Petitioner is the natural father of Kenli Marie Hill, born February 19, 1986. 2. The said minor child, through her mother, Susan M. Barrick, has petitioned this Honorable Court for a change of name due to a divorce which occurred on May 18, 1988. 3. The Petitioner opposes the Petition for Change of Name. 4. The Petitioner, Kenneth A. Hill, is currently incarcerated on criminal charges at the State Correction Institute at Mercer. 5. A hearing on the Petitioner for Change of Name is presently scheduled for February 15, 1995, at 1:30 p.m. 6. Petitioner, through his counsel, has contacted the Cumberland County Sheriff's office who has indicated that the sum of Three Hundred ($300.00) Dollars is necessary to secure the transportation of the Petitioner to the said hearing.
