cindy L. Boonie, a hearing is set on the License Suspension Appeal

in Courtroom Number ~_, Cumberland County Courthouse, CarliSle,
CUJIl))erland County, Pennsylvania, all proceedings to stay meanwhile.
Notice of said hearing shall be given by Petitioner's counsel
to the Department of Transportation at least thirty (30) days pr,t.or
to the date of said hearing.
Pursuant to Section 1550(b) of the Pennsylvania Motor Vehicle
Code, Petitioner's appeal shall act as an automatic supersedeas,
and Petitioner's operatinq privileges shall not be suspended
pending a final determination in this matter.

AND NOW, comes Petitioner, Cindy L. Boonie, by and through her
attorneys, MANCKE, WAGNER, HERSHEY & TULLY, who make the following
averments in support of this License Suspension Appeal.
1. Petitioner, cindy L. Boonie, an adult i.ndividual, is a
licensed driver within the Commonwealth of Pennsylvania with a
residence address of 17 Birch street, Mechanicsburg, Cumberland
county, Pellnsyl vania 17055.
2. Respondent, Pennsylvania Department of Transportation,
Bureau of Driver Licensing, has a mailing address at Transportation
and Safety Building, Harrisburg, Dauphin County, Pennsylvania
17120.
3. Petitioner allegedly received a citation filed by the
Carlisle police Department on or about October 12, 1994, alleging
a violation of Section 1542(e) of the Motor Vehicle Code.
4. The citation was issued through Magisterial District 09-
2-01 in Carlisle, Cumberland county, pennsylvania.
5. Petitioner, or someone claiming to be the Petitioner,
allegedly appeared before Distr.ict Justice Correal, Magisterial
Dbtriot 09-2-01, on Ootober 25, 1994, and the Dbtriot Justice
allegedly accepted petitioner's guilty plea and accepted
Petitioner's payment.
6. Petitioner &eceived a notice of license suspension with
a mail date of November 28, 1994, from the Department of
Transportation advising her that her license was to be suspended
for a period of two years as mandated by section 1542 (e) of the
Vehicle Code with an effective date of March 27, 1996. This notice
is attached hereto and is incorporated herein by reference as
Exhibit "A".
7. The above-mentioned suspension as proposed by the
Department is illegal, invalid and improper for 80me or all of the
following reasons:
(a) petitioner was not advised by the District
Justice that a suspension would result prior
to Petitioner entering a plea of guilty;
(b) The District Justice failed to give notice at
the time of conviction and sentencing to
Petitioner that a suspension would be imposed;
(c) 'fhe District Justice failed to advise
petitionel" of her right to appeal from the
conviction and sentence pursuant to the Rules
of Criminal Procedure;
