Duncan, Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a statement: 1. Plaintiff is Farmers Trust Company, a corporation organized and existing under the laws of the Commonwealth of Pennsylvania with its main office and principal place of business located at 1 West High Street, Carlisle. Cumberland County. Pennsylvania 17013. 2, Defendant, Betty A. Kuykendall, an adult individual, who resides at 140 Appalachian Drive. Carlisle. Cumberland County, Pennsylvania 17013. 3. On or about June 28, 1988. Defendant made, executed and delivered to Plaintiff a note and security agreement and a real estate mortgage financing Sixteen Thousand Six Hundred Ninety-four and 66/100 Dollars ($16,694.66), a copy of said note and security agreement and said real estate mortgage being attached hereto as Exhibits "A" and "B", respectively, and are incorporated herein by reference as though fully set forth. 4. Said note and security agreement and said real estate mortgage have not been assigned. 5. Betty A. Kuykendall is the sole record owner in fee simple of said premises subject to said mortgage. by virtue of a Oeed dated and recorded on October 5, 1967, and recorded in the Cumberland County Recorder I s Of fice in Deed Book "N", Volume 22, Page 474. more specifically set forth in Exhibit "e", attached hereto and made a part hereof by reference. 6. Said note and said real estate mortgage are in default because Defendants herein have failed to pay the payments that were due and owing for the months of September 10. 1994 to December 10, 1994. 7. The Plaintiff has given to the Defendants writ,ten notice of intention to foreclose on said mortgage as required by law under Act 6, dated November 15. 1994, a copy of which is marked Exhibits "D". "E" and "F". and attached hereto and made a part hereof by reference. 8. The Plaintiff has given written notice of default as required by the Homeowner's Emergency Assistance Act of 1983, dated November 15, 1994, a copy of which is marked Exhibits "G", "H" and "I", and attached hereto and made' a part hereof by reference. 9. By reason of the aforesaid default, the entire principal balance of Twelve Thousand Four Hundred Seven Dollars and 22/100 ($12,407.22) Dollars, with interest thereon at the rate of twelve (12,OOt) percent per annum computed from September 12, 1994, accruing insurance premiums, attorney's fees in the amount of Five Hundred Eighty-Nine and 34/100 Dollars ($589.34) are now due and payable. 10.
