1. The plaintiff iB an adult individual whoBe per.anent addreBB WaB 700
Sale. Road, Lot '54, EtterB, York County, PennBylvania, 17319,
2. The plaintiff iB teBporarlly Btaylng at an undiBcloBed location for
her own protection and to avoid further abuBe as iB Bore fully set forth
herein. This addresB will be furnlBhed to the court upon requeBt.
3. The defendant iB an adult individual reBldlng at 700 Sale. Road, Lot
'54, Rtters, York County, Pennsylvania, 17319.
4. The defendant Is the plalntlff'B husband.
5. Since approxi.ately 1990, the defendant haB atteBpted to C.UBe and
haB intentionally, knowingly, or recklessly caused bodily Injury to the
plaintiff and has placed plalntltf In re&llonable fear of luinent BeriouB
bodily Injury. ThlB has Included but Is not li.ited to the following Bpeciflc
Ins tanceB 0 f abuBe:
a. On or about DeceBber 21, 1994, when the plaintiff ~ent into the
bathrooB to use a breathing Bachlne (pulBalde) for her aBBatlc condition, the
defendant ca.e Into the rOOB holding a large butcher knife, grabbed the tube
which carried the Bedlcine froB the Bachlne Into the plaintiff's lungB, and
cut the tube Btopplng the flow of .edlclne. With hiB other hand, he threw a
glass of gatorade Into the plaintiff's face, ran the butcher knife across the
plaintiff's throat whlls applying increased pressure on her trachea. and
repeatedly threatened to kill her and specifying that she would be spitting up
blood and would die. The defendant then forced the plaintiff to clean up the
Bess froB the gatorade, grabbed the front of her shirt, and dragged her down
the hall to the living rOOB. He threw the plainti ff on the couch and told her
not to Bove causing her to fear for her safety. The defendant threw the
plaintiff fros the couch to the floor, jUBped on the plaintiff and forcefully
squeezed his hands around her throat. The defendant got up off of the
plaintiff, called his esployer saying he would not be at work that day. and
then threatened the plaintif! saying that she was going to die. The defendant
grabbed the plaintiff by the front of her shirt, pulled her up frOB the floor,
and repeatedly punched her on the side of her face causing bruising and
swelling about her jaw, 1 ip, ear, eyes, and nose. The defendant forced the
plaintiff to have sex and further threatened her saying, "If you leave. I'll
find you and ki 11 you."
b. On or about Decesber 20, 1994. the defendant grabbed the plaintiff's
night gown, ripped it to shreds, and threatened to kill her. He repeatedly
pushecl her around and threatened that she" would pay for his anger with her
life."
c. Since approxiBately 1990, the defendant has on several different
occasions punched, slapped, kicked, pushed, and threatened to kill the
plaintiff. On one occasion, the defendant thrsw the plaintiff out of a Boving
car.
6. On or about Decesber 22, 1994, the plaintiff left their rssldence at

700 Sales Road, Lot '~4, Btters, York Countf. Penneflvania in order to avoid
further abuee.
6, The plaintiff believes and therefore avere that ehe will be in
issediate and present danger of abuee fros the defendant and that ehe ie in
need of protection froe euch abuee.
7. The plaintiff deeires that the defendant be ordered to refrain fros
having any contact with her including, but not lisited to, entering her place
of eeplofsent, etalklng the plaintiff, and harassing the plaintiff or her
relatives.
8. The plaintiff desires that the defendant be ordered to refrain fros
d..agin, or deetroying any propertf owned bf the plaintiff or anf propertf
owned Jointly by the partiee.

9. The naee of the owners of the hose where the piaintiff is currently
etaying cannot be revealed because the n&Bes will disclose the plaintiff's
whereabouts which Bust be kept confidential for her protection; the plaintiff
ie not seeking the eviction of the defendant froB his residence but is
requesting that he stay away fros any residence where she r~sides.
D. A'l"1'ORRY FDS
10. The plaintiff asks that the defendant be ordered to pay reasonable
attorney fees pursuant to the Protection froB Abus6 Act.
WHEREFORE, pursuant to the prov isions of the "Protection froB Abuse Act"
of October 7, 1976,23 Pa.C.S.A. Section 6101 ~ ~., as asended, the
plaintiff prafs this Honorable Court to grant the following relief:
A. Grant a Tesporary Order pursuant to the "Protection fros Abuse Act":

1.' Requirin, the defendant to refrain fro. abu8in, the
plaintiff or placin, her in fear of abu8e.
2, Requlrin, the defendant to refrain fro. hay in. any
contact with the piaintiff including, but not li.ited to, enterin. t~e
plaintiff'8 ~lace of e.ployaent, 8talkin, the plaintiff, and harallin,
the plaintiff or her relatives.
3. Orderin. the defendant to stay away fro. any reuidence
the plaintiff .ay establiah for herself.
4. Ordering the defendant to refrain fro. daaaging or
destroying any property owned by the plaintiff or any property owned
jointly by the parties.
8, Schedule a hearing in accordance with the proYiuionu of the
"Protection fro. Abuse Act," and, after such hearing, enter an order to be in
effect for a period of one year:
1. Requiring the defendant to refrain fro. abusing the
plaintiff or placin. her in fear of abuse.
2. Requiring the defendant to refrain fro. haying any
contact with the plaintiff including, but not li.ited to, enterin. the
plaintiff's place of e.ploYBent, stalking the plaintiff, and harABsin,
the plaintiff or her relatives.

from abusing the plaintiff.
4. The defendant is ordered to refrain from damaging or
destroying any property owned by the plaintiff or any property
owned jointly by the parties.
5. This Order shall remain in sffect for a period of one
year.
6. The Camp Hill and any other appropriate Police
Departments will be provided with a copy of this Order by
attorneys for plaintiff. This Order shall be enforced by any law
enforcement agency when a violation occurs and an arrest for
indirect criminal contempt. The arrest may be without warrant
upon probable cause that this Order has been violated, whether or
not the violation is committed in the presence of the pOlice
officer. In the event that an arrsst is made under this section,
the defendant shall not be taken to jail but shall be taken
without unnecessary delay before the Court that issued the Order.
When that Court is unavailable, the defendant shall be arraigned
before a district justice who shall set bail according to the
provisions of Chapter 4000 of the Pennsylvania Rules of Criminal
Procedure (23 PS Section 6113).

1995, by the plaintiff, Susan Stambaugh and the defendant, Mark
O. Stambaugh. The plaintiff is represented by Joan Carey of
Legal Services, Inc.; the defendant is unrepresented but i$ aware
of hie right to have an attorney. The parties agree that the
following may bs entered as an Order of Court.
1. The defendant, Mark D. Stambaugh, agrees to refrain from
abusing the plaintiff, Susan Stambaugh, or from placing hsr in
fear of abuse.
2. The defendant agress not to have any contact with the
plaintiff, including but not limited to, entering the plaintiff's
place of employment.
3. The defendant agrees not to stalk the plaintiff or
harase the plaintiff or her relatives.
4. The defendant agrees to stay away from any residence the
