COMPLAINT Plaintiff, Hempt Bros., Inc., is a Pennsylvania corporation with a principal place of business at 205 Creek Road, Camp Hill (Lower Allen Township), Cumberland County, Pennsylvania 17011. 2. The Defendant, Gettys Builders, Inc., is a Pennsylvania corporation with a place of business at 1~01 state street, Camp Hill, Cumberland county, Pennsylvania 17011. J. The Defendant, Fred A. Gettys & Associates, Inc., is a Pennsylvania corporation, being the successor in interest to Johansen & Dugan, Inc., a Pennsylvania corporation, with a place of business at 1901 state street, Camp Hill, Cumberland County, Pennsylvania. 4. At all times relevant hereto, Plaintiff has been engaged in the business, inter AliA, of manufacturing and selling concrete, asphalt, and stone. 5. At all times relevant hereto, the Defendant, Gettys Builders, Inc., has been engaged in the construction, landscaping, remodeling, and excavation business. . . 6. At all times relevant hereto, the Defendant, Fred A. Gettys' Asscciates, Inc., has been engaged in the construction, landscaping, remodeling, and excavation business. The Plaintiff, at the special insistence and request of the agents, servants, and employees of the Defendant, Gettys Builders, Inc., acting within the scope of their employment, sold and delivered to the Defendant, Gettys Builders, Inc., goods and materials, at the times, in the amounts of, and of the kinds, and for the prices set forth in a true and correct copy of Plaintiff's book of original entry, copy of which is marked Exhibit "A", and Exhibit "A-l" to and including Exhibit "A-13", attached hereto and made part hereof, which goods and materials were received and accepted by the Defendant, Gettys Builders, Inc. 9. The prices charged for said goods and materials are just and reasonable and are the prices which the agents, servants, and employ... of the Defendant, Gettys Builders, Inc., acting within the scope of their employment, orally promised to pay Plaintiff for the same. -2- 10. Plaintiff has demanded payment from Defendant, Gettys Buildera, Inc., in the amount of $1,890.60, with delinquency charges in the amount of one and one-fourth (1-1/4th') percent per month after thirty (30) days, but Defendant, Gettys Builders, Inc., haa refused and still refuses to pay the same or any part thereof. WHEREFORE, Plaintiff, Hempt Bros., Inc., demands jud91Dent against Defendant, Gettys Builders, Inc., in the amount of $1,890.60, together with delinquency charges in the amount of one and one-fourth (1-1/4th\) percent per month, together with costs of suit. COUNT II Hempt Bros., Inc., Plaintiff v. Gettys Builders, Inc., Defendant 11. The allegations of paragraphs 1 to and including paragraph 10 are incorporated herein by reference as though herein set forth. 12. The Plaintiff, at the special insistence and request of the agents, servants, and employees of the Defendant, Gettys Builders, Inc., acting with the scope of their employment, sold and delivered to the Defendant, Gettys Builders, Inc., goods and materials at the times, in the amounts of, of the kinds, and for the prices set forth in the invoices marked Exhibit "A-1" to and including Exhibit "A-13 II , attached hereto and made part hereof, which gOOds and materials were received and accepted by the Defendant, Gettys Builders, Inc. -3- 13. The prices charged for said goods and materials are just and rea.onable and are the prices which the agent., .ervant., and employ... of the Defendant, Gettys Builders, Inc., acting within the scope of their employment, orally promised to pay Plaintiff for the same. 14. Plaintiff has demanded payment from Defendant, Gettys Builders, Inc., in the amount of $1,890.60, with delinquency charges in the amount of one and one-fourth (1-1/4th\) percent per month after thirty (30) days, but Defendant has refused and still refuses to pay the same or any part thereof. 15. As a result of the aforesaid, Defendant, Gettys Builders, Inc., has been unjustly enriched at Pll'lintiff' s expense in the amount of $1,890.60. WHEREFORE, Plaintiff, Hempt Bros., Inc., demands judgment against Defendant, Gettys Builders, Inc., in the amount of $1,890.60, together with delinquency charges in the amount of one and one-fourth (1-1/4th\) percent per month, together with costs of suit. Gettys & Assooiates, Inc., being the successor by merger to Johansen & Dugan, Inc., entered into a certain Guaranty Agreement with Plaintiff, a copy of which is marked Exhibit "B", attaohed hereto and made part hereof, whereby Defendant, Fred A. Gettys & Assooiates, Inc., inter A.l..iJl, agreed to pay all sums owed to Plaintiff by Defendant, Gettys Builders, Inc. 22. The Pleintiff, in reliance upon said Guaranty Agreement, sold and delivered to the Defendant, Gettys Builders, Inc., on credit, certain goods and materials which the Defendant, Gettys Builders, Inc., used in its trade and business, at the times, and at and for certain reasonable prices as set forth in a true and correct copy of Plaintiff's book of original entry, copy of which is marked Exhibit "A" and Exhibit IIA-1" to and including Exhibit "A-13", attached hereto and made part hereof, which goods and materials were received and accepted by the Defendant, Gettys Builders, Inc., totalling $1,890.60, and including delinquency charges of one and one-fourth (1-1/4th%) percent per month after thirty (30) days. -6- .... .~~., '.
