R. ThomaB Kline, Sheriff who being duly sworn according to law,
says he made diligent search and inquiry for one of the within named
defendants to wit: Signature Homes, Inc., but waB unable to locate them
in his bailiwick. He therefore deputized the sheriff of York County to
servce the within Complaint in Civil Action Law and Notice according to law,
YORK COUNTY RETURN: Now January 23,1995 at 1:57 o'clock P.M. served
the wit~in NOtice and Complaint upon Signature Homes, Inc. et al
Serve Signature Homes Inc. at 60 Maple Drive, Suite 0 Etters, PA by
handing to Becky Condon, Secretary and adult person in charge for
Sign~ture Homes, Inc. a true and attested copy of the original Notice and
Complaint and made known unto her the contents thereof.

says he made diligent search and inquiry for the within named defendant
to wit: David W. Waltz and Donna Waltz, but was unable to locate them

7. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, Signature
Homes, Inc., acting within the scope of their employment, sold and
delivered to the Defendant, Signature Homes, Inc" goods and
materials, at the times, in the amounts of, and of the kinds, and
for the prices set forth in a true and correct copy of Plaintiff's
book of original entry, copy of which is marked Exhibit "A", and
Exhibit "A-I" to and including Exhibit "A-6", attached hereto and
made part hereof, which gOOds and materials were received and
accepted by the Defendant, Signature Homes, Inc,
8. The prices charged for said goods and materials are just
and reasonable and are the prices which the agents, servants, and
employees of the Defendant, Signature Homes, Inc" acting within
the scope of their employment, orally promised to pay Plaintiff for
the same.
9. Plaintiff has demanded payment from Defendant, Signature
Homes, Inc., in the amount of $2,630.37, with delinquency charges
in the am~unt of one and one-fourth (1-1/4th') percent per month

refused and still refuses to pay the same or any part thereof.
WHEREFORE, Plaintiff, Hempt Bros" Inc" demands judgment

and one-fourth (1-1/4th%) percent per month, together with costs of
suit.

employees of the Defendant, Signature Homes, Inc" acting within

Inc., has been unjustly enriched at Plaintiff's expense in the
amount of $2,630,37,

$2,630,37, together with delinquency charges in the amount of one

Hempt Bros., Inc., plaintiff v.
David W. Waltz and Donna waltz, his wife, Defendants
19. The allegations of paragraph 1 to and including paragraph
18 are incorporated herein by reference as though herein fully set
forth.

20. On or about November 12, 1993, the Detendants, David W.
Waltz and Donna Waltz, his wite, entered into a certain Guaranty
Agreement with Plaintiff, a cCJPy of which is marked Exhibit "B",
attached hereto and made part hereof, whereby Defendants, David W,
Waltz and Donna Waltz, his wife, inter Al1A, agreed to pay all sums
owed to Plaintiff by Defendant, signature Homes, Inc.
21. The Plaintiff, in reliance upon said Guaranty Agreem nt,
sold and delivered to the Defendant, Signature Homes, Inc., on
credit, certain goods and materials which the Defendant, Signa ure
Homes, Inc" used in its trade and business, at the times, and at
and for certain reasonable prices as set forth in a true and
correct copy of Plaintiff's book of original entry, copy of which
is marked Exhibit "A" and Exhibit "A-l" to and including Exhibit
"A-6, attached hereto and made part hereof, which goods and
materials were received and accepted by the Defendant, signature
Homes, Inc., totalling $2,630.37, and including delinquency charges
of one and one-fourth (1-1/4th%) percent per month after thirty
(30) days.
22. The time of payment of the prices of the said goods and
materials by the Defendants to the Plaintiff has long since
expired, yet Defendants, though often requested to do so, have not
paid the Plaintiff the amount of $2,630.37 or any part thereof,
23. Notice of the failure and refusal of Defendants to pay
for the goods and materials was given to the Defendants.

For valuable consideration, the receipt of which is acknowledged and
intending to be legally bound hereby, the Undersigned jointly and severally
unconditionally guarantee to you the full and prompt perfonmance by
SIGNATURE HOMES
herein called .Obllgor" of all obligations which Obligor presently or
hereafter may have to you and payment when due of all sums presently or
hereafter owing by Obligor to you, and agree to Indemnify you against any
losses you may sustain and expenses you may Incur as a result of any wrong-
ful act of ObI igor.
For the purposes of this gauranty and indemnity, all sums owing to
you by Obligor shall be deemed to have become immediately due and payable
if (a) Obligor defaults in any of its obligations to you; (b) a petition
under any Chapter of the Bankruptcy Act, as amended, or for the appointment
of a receiver of any part of the property of Obligor be filed against Obligor,
and be not dismissed within thir't.y days; (c) such a petition be filed by
Obligor; (d) Obligor makes a general assignment for the benefits of creditors.
suspends business or commits any act amounting to a business failure, or (e)
an attachment be levied ~r tax lien be filed against any of Obligor's property.
This shall be a continuing glJaranty and indemnity and irrespective of
the lack of any notice to or consent of Undersigned, their obl igations here-
under shall not be impaired in any manner whatsoever by any
(a) new agreements or obligations of Obligor with or to you; amendments,
extensions, modifications, renewals or waivers of default as to any existing
or future agreements or obligations of Obligor or third parties with or to
you, or extensions of credit by you to Obligor.

(b) adjustments, comprises or re1'eases 'of any obligations of Obligor,
Undersigned or other parties, or exchanges. release~ or sales of any security
of Obligor. Undersigned or other parties;
(c) fictitiousness. incorrectness, invalidity or unenforceability, for
any reason. of any instrument or writing, or acts of commission or omission
by you or ObI igor;
(d) compositions. extensions. moratoria or other ,relief granted to
Obligor pursuant to any statute pre~ently in force or hereafter enacted, or
(e) interruptions in the business relations between you and Obligor.
Notice of your acceptance hereof, of default and non-payment by Obligor'
or any other parties, of presentment. protest and demand. and of all other
matters of which Undersigned otherwise might be entitled, is waived,
The obligations hereunder of each of Undersigned are joint and several,
and shall be binding upon their respective heirs and personal representatives.
The failure of any person to s1'gn this guaranty and indemnity shall not affect
the liability hereunder of any signer thereof, The death or release from
liabit ity hereunder of any of Undersigned shall not relieve the others from
liability hereunder. Each of Undersigned may terminate his obligations
hereunder as to then future transactions between you and Obl Igor by regis-
tered mail notice to you at your above stated address. provided, however,
that such termination shall not effect either his liability hereunder with
respect to any obI igations of Obligor to you incurred prior to your receipt
of such notice, or the continuing liability of such of the others of Under-
signed as have not given such notice.
Undersigned shall reimburse you, on demand, for all expenses incurred
by you in the enforcements or attempted enforcement of any of your rights
hereunder against any of Undersigned,

.Confession: As security ,for any such obligations, the Undersigned
hereby au.thorize any attorney of any Court of record of anY state to appear
for them or any of them and to confess a judgment against them or any of
them for entire unpaid balance due by Obligor at any time, whether immatured
installments or otherwise, with or without declaration, with costs of suit,
release of errors, without stay of execution and with twenty (20S) per cent
added for collectioll; and they also waive the right of inquistion on allY
real estate that may be levied upon to collect this note, and do hereby
voluntarily condemn the san~, and authorize the Prothonotary or clerk to
enter upon the execution \'1rit their said voluntary condemnation, and they
further agree that said estate may be sold on an execution writ and they
further hereby waive and release all relief from any and all appraisements,
stay or exemption laws of any state now in force or hereafter enacted,
This guaranty and indemnity is assignable. shall be construed liberally
in your favor and shall inure to the benefit of your successors and assigns.
If Obligor shall default in the performance of any of Obligor's obligations
to you, and if any third party makes any payment to you with respect thereto,
such third party shall. to the extent thereof, be subrogated to all of your
rights against Undersigned hereunder,
