AND NOW, come W, Stephen Kern and Marilyn C. Kern (hereinafter
"petitioners"), by and through their 8.ttorneys, Lowell R. Gates,
p,C" and make the following representations:
1, On December 30, 1994, Petitioners filed a petition under
the above caption to set aside the September 29, 1994, publ:\.c tax
sale of their real property at 428 Park Hills Drive, Upper Allen
Township, Cumberland County, Pennsylvania,
2, On January 4, 1995, this COurt issued a Rule upon the
Cumberland COunty Tax Claim Bureau to show cause why the public tax
sale should not be set aside,
3, The Rule was made returnable twenty days after service
thereof,
4, On January 6, 1995, a copy of the Rule was served upon
the Cumberland County Tax Claim Bureau and the Cumberland COunty
Sheriff's Office by certified mail, return receipt requested, and
a certificate of service to that effect was filed in this court on
January 10, 1995,
5. Twenty days have passed since the date of service of the
Rule, and no answers have been filed thereto,

AND NOW, come W, Stephen Kern and Marilyn C, Kern, by and
through their attorneys, Lowell R. Gates, P,C., and make the
fOllowing representations:
1, Petitioners are husband and wife and now reside at 326
Louisa Street, Williamsport, Lycoming county, pennsylvania 17701.
2. petitioners are the record owners of the real property
and improvements known as 428 Park Hills Drive, Lot 2-C with
building, Upper Allen Township, Cumberland County, pennsylvania,
with local tax identification number 42-27-1886-065.
2, On JUly 22,1994, petitioners were notified by the
Cumberland County Tax Claim Bureau that a public tax sale of their
Upper Allen Township property would be held on September 29, 1994,
in order to satisfy unpaid real estate taxes on the property.
3, The Tax Claim Bureau notice further indicated that notice
of the sale would be pUbliShed beginning the week of August 23,
1994, in the Evening Sentinel, the Harrisburg Patriot News and the
News Chronicle, and the Cumberland Law Journal,
4. On August 23, 1994, notice of the sale was publiShed in
the Harrisburg Patriot News, in the Metro West section, page 42.
