3. Plaintiffs allege in the Complaint that Shippensburg Sand
and Gravel is a trade name for Defendant Furnley Enterprises.
4. Plaintiffs are alleging negligence on behalf of the
Defendant "in failing to exercise required care reasonably to
assure deliver of the proper sand".
5. The only basis of liability of all of the other
Defendants except Furnley Enterprisea, d/b/a Shippensburg Sand &
Gravel, is that of alleged ownership.
6. Plaintiffs have not alleged the nature of the ~ntity of
Defendant Furnley Enterprises.
7. Plaintiffs have not alleged the basis of liability of
Defendants other than Furnley Enterprises (a corporation),
sufficient to establish liability based on mere ownership.
WHEREFORE, Defendants Rimac Inc., Furnley H. Frisch & Sons,
and Furnley H. Frisch respectfully request that this Complaint be

reference herein.
9. The Complaint in this action is not specific to show how
the alleged negligence on the part of Furnley Enterprises d/b/a
Shppensburg Sand & Gravel, renders D~fendants Rimac Inc., Furnley
H. Frisch & Sons and Furnley H. Frisch liable for that negligence.
WHEREFORE, Defendants respectfully move for this Court to
order Plaintiffs to file a more specific pleading.
~T III -- MOTION TO STRIKE
10. Paragraphs 1 through 9 above are incorporated by
reference herein.
11. The nature of Plaintiffs' Complaint is based on the
purchase of material.
12. The Complaint fails to state whether or not the agreement
was oral or in writing.
13. Pa.R.C.P. Rule 1019(h) specifies that a pleading shall
state specifically whether or not a complaint or defenses based on
a writing and if so, said Rule requires a copy of the part of the
writing to be attached or an explanation made as to why it cannot
be attached.
14. Plaintiffs' Complaint makes no mention concerning whether
or not their claim is based on a writing.
WHEREFORE, Defendants respectfully move that the Complaint be
stricken off for failure to comply with the Rule of Civil
Procedure.
