O~ ' ~ 3"(~7 ,2002 ~/~ L~ FILED: STIPULATION AGAINST LIENS WHEREAS, CENTRAL DAUPHIN REALTY CO., a Pennsylvania business corporation, with its principal business office address of P.O. Box 349, Lemoyne, Pennsylvania 17043-0349, Owner of the 211 House Avenue building, situate in Camp Hill, East Pennsboro Township, Cumberland County, Pennsylvania 17011 (the "Build- ing''), has executed or is about to execute contemporaneously herewith a Construction Contract with EDWIN L. HElM COMPANY, the Contractor, with its principal business office address of P. O. Box 2247, Harrisburg, Pennsylvania 17105, for the remodeling construction work at 211 House Avenue, Camp Hill, East Pennsboro Township, Cumberland County, Pennsylvania, as more particularly bounded and described in the Deed, dated 20 December 1999, and recorded in the Office of the Recorder of Deeds of Cumberland County, in Deed Book 213, Page 663. NOW, THEREFORE, this 25th day of July, 2002, before any authority has been given by CENTRAL DAUPHIN REALTY CO., to EDWIN L. HElM COMPANY, the Contractor, to commence work on said Building, or purchase materials for the same, in consideration of the making of the above-described contract with EDWIN L. HElM COMPANY, the Contractor, and in further consideration of One Dollar ($1) paid to the Contractor by Owner, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or maintained against the Owner's Building, as above- described, by the Contractor, or any subcontractor, or by any of the materialmen or workmen or any other person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for, towards, in or about the construction and improvement of said Building, under said contract or otherwise, the right to have, file and maintain such liens or claims against the Building above-described being hereby expressly waived by the Contractor for itself, its subcon- tractors, all materialmen or workmen and others acting through or under them. IN WITNESS WHEREOF, each of the parties, or by their duly authorized representatives, have hereunto executed this Stipulation Against Liens this 25th day of July, 2002. KINZER, who acknowledged himself to be Treasurer of CENTRAL DAUPHIN REALTY CO., a Pennsylvania business corporation, and that he as such officer, being duly authorized to do so, executed the foregoing instrument for the purposes therein contained by signing the name of the company by himself as such officer.
