Defendant requests that paragraph 11 of the Complaint be
stricken because lt fails to allege a "requlred precondltion to
payment", namely, reoeipt of payment by the Defendant of payments
to be made to Plalntiff,
First of all, the Amendea Complaint speclfically alleges, ln
paragraph 11. that aU prerequ1s1te. to Plalntiff's rights and
remedled under the Contractor and Subcontractor Payment Act have
been satisfied. That averment stands on its own, and lu not
legally defloient, If Defendant dlsputes that said prerequisites
have been .fttht1ed, it can certll1nly deny the averment in its
answer,
Moreover. If the prerequisite to payment auggested by
Defendant is contained anywhere within the Contractor and
Subcontractor Paymlnt Act. Plaintlft has been unable to find it,
