Petitioner was physically incapable ot allowing 0 sample of his
breath tc be taken ae requested by the police otficer. Upon his
arreet on December 4, 1994, Petitioner wae involved in an
altercation with the police in which blowe were e.changed.
Petitioner was eprayed at least twice by the police with a ohemical
agent (apparently Mace), which caused him to be ehort of breath and
made it impossible tor him to perform the braathaly.er teete,
WHIREFORI, Petitioner, Timothy r. Merritt., bas.d on the
toregoing averm.nt., respeotfully nque.te that Your Honorable
