Defendant, Martin-Brower Company, is engaged in the trUcking business operat.1nq from a principal place of busine.. at 4215 lAe Hill Drive, Fredericksburg, Virginia, 22401 3. Defendant, Philip M. Mahoney, i. an adult individual re.iding at 29305 Mine Run Road. Unionvi1le, Virqinia. 221567. 4. The fact. and occurrences hereinafter .tated took place on or about August 2. 19~3 at or about 9130 a.m. at the inter.ection ot Trindle Road and South 34th street, camp Hill. cumberland County, Penn.ylvania. 5. At the aforesaid time and place, Plaintiff. Eleanor Reap, v.. operating a 1986 cadillao Deville owned by Plaintiff. in a .o~therly direction on South 34th street in camp Hill, Cumberland county, P.~~- jl. .ylvania. e. Plaintiff'. v.hiole prooeeded through the interseotion of South 34th street .nd Trindl. Ro.d, the tr.otor and trailer driven by Defendant, rhilip M. Mahon.y, prooeeded through . red light at the interseotion of South 34th stre.t and Trindle Road striking Plaintiff" motor vehiole in the p....ng.r lid. of the 1986 cadillao D.ville. B. At the .fore.aid time .nd plaoe due to the neglig.noe and oar.le..n.,. of pefendant Mahoney, Defendant Mahoney drove into the pa..enger .ide of Plaintiffs vehicle oausing Plaintiff Eleanor R.ap to ,ultain injuries as .et forth below. 9. Th. tractor and trailer oper.ted by Defondants did not m.ke any attempt to .top before str.iking the Plaintiffs vehiol.. 10. Upon being struok by the t~aotor trailer driv.n by D.f.ndant Mahon.y, Pl.intiff was rendered unconscious and taken to the Harri,burg Hospital for treatment of injuries associated with the oolli.ion with D.fendant, traotor and trailer. 11. At the time of the accident, Plaintiff wa. w.aring her ,eat- belt. a 13. A. a re.ult of Defendant~' negligenoe, Plaintiff. motor vehiole wa. totaled and was ren~ered oompletely inoperable. As a dir~~t result of her injuries, Plaintiff Eleanor Reap wa. ho.pitalized, sUbjected to various medical treatments and proo.dur.1 inclUding x-rays, stitches, surgery, a hospital stay, daily bandaqing, th.rapy and various types of medication. 17. As a result of her injuries, Plaintiff, Eleanor Reap, hal undergone in the past and in the future will continue to Undergo gr.at pain and luff.ring and aching. 18. Plaintiff is advised and therefore avers that the afor'laid injurie. are permanent in nature and effect. 19. AI a result of her injuries, Plaintift sutfered impairment ot h.r earning power and vapacity, and lost wage. due to her inability to .. work at her job trom August 2, 1993 through Ootober ot 1993. 20. Ae a reeult of her injurioe, Plaintiff, Eleanor Reap, hal undergone in the past and in the future will continue to undergo great pain and suffering and aching. 32. Plaintiff is advised and therefore avers that the aforesaid injuries are permanent in nature and effect. 7 33. That a. a V.sult of .aid injuries, Plaintiff has .uffered los. of wages in a presently induterminable amount:, with Plaintiff'. hourly wage at the time of her injury equaling $5.35, not inclUding overtime, and has further suffsred a permanent lo.s of earning oapacity. 35. Plaintiff will experience a deterioration of her condition a. she ag.s and will become increasingly unable to engag. in normal physi- ~al activiti... 36. Albert T. R.ap has been and will be deprived of the ...i.tance, companionship, consortium and society of his wife. all of which has been and will be to her great )OS8 and detriment. WHEREFORE, Plaintiff, Albert T. Reap, demands judgment against the Defendant, Martin Brower Co., in an amount in excess of $20,000.00, ~l an amount whinh exceeds local compulsory arbitration.
