Department of Tran.portation (the Department) oontendir~ that he
wa. mi. led into refu.ing a bre.thalyaer te.t by Corporal Jame.
Olozak of the penn.ylvania State Polioe (Corporal Olozak). We
hold a hearing on Maroh 20, 1995, from whioh we made the
following finding. of faotl
1. On Deoember 9, 1994, Corporal Olozak wa. on duty on
State Route 641 in We.t Penn. bora Town.hip, Cumberland County, in
an unmarked State Polioe vehiole.
2. While Corporal Olozak wa. travelling on Route 641, in a
no pa..ing zone with a po.ted .peed limit of 45 m.p.h., he
ob.erved a oar that had been travelling behind him pull into the
oppo.ite lane and pa.. him and a vehiole direotly in front of him
at a .peed in exoe.. of 60 m.p.h.
3. Corporal Olozak aotivated hi. polioe light. and pur.ued
and .topped the vehiole that had pas.ed him, who.e driver wa.

the horizontal gaze ny.tagmu. te.t and the one leg .tand te.t,
both of which Chikota. failed.
6. Corporal Olczak then arre.ted Chikota. for DUI and
tran.ported him to the State Polioe barraok. in Carli.le,
Cumberland County.
7. At the barrack., Corporal Olozak reque.ted that Chikot..
eubmit to a breathatyzer te.t and informed him that hie lioen.e
would be .u.pended if he refu.ed, ChJ,kota. refu.ed to .ubmit to
the te.t and .igned a form to that effeot.
8. At aome time .fter he aigned the form, Chikota. ..ked
Corporal Olozak what hi. option. were and Olozak told him about
ARD and mentioned the po..ibility that he oould obtain a limited
occupational lioen.e under 51553 of the Vehiole Code (the Code).

9. We find a. a fact that the oonveraation about Chikotaa'
optionu occurr.d after Chikota. had already given a knowing and
con.ciou. refuaal to aubmit to a breathalyaer teat.
DISCUSSION
Chikotaa contend., in ahart, that hi. appeal .hould b.

granted becauae he waa led to believe that he would be able to
obtain a limited occupational licenae under 11553 ot the Code it
he retuaed the breathalyzer teat. In aupport ot hia poaition
Chikotaa citea the caa. ot Com.. Dept. ot_~ortation v.
Oaborne, 135 Pa.Commw. 297, 580 A.2d 914 (1990), In that caae,
Oaborne waa arreated tor DUI at the aoene ot an accident. Betore
he waa tranaferred to the polioe atation and atter he had been
intormed of hia righta and dutiea under 51547 of the Code,
Oaborne refuaed to eubmit to a breath teat. At aome time during
theae evente, the polioe told Oaborne that he might ond up in a
worae poaition if he eubmitted to the teat, and alao,
erroneoualy, that he oould obtain a apecial permit allowing him
to drive to and from work. The trial oourt granted Oaborne'a
appeal of the auapension of hia lioense and the Superior Court
affirmed, atoting

OPINION AND ORDIR OF COURT
In the present aotion, petitioner oontends the followingl
1) The trooper did not have probable cause nor reasonable
grounds to request a blood alcohol teet,
2) Petitioner was oonfused ~egarding his Miranda warnings
and his right to oounsel,
3) Petitioner wae misled by the Trooper regarding the
possibility of options as to what tests would be requested, and
4) petitioner did not refuse to take a breath test.
A hearing was held before this oourt on February 6, 1995, from
which we made the following findings of fact.
rINDINGS OF FACT
1. On June 19, 1994, at approximately 1130 a.m" Trooper
William C. Palmero of the pennsylvania State polioe responded to
a domestic dispute in the area of Petersburg Road, South
Middleton Township, Cumberland county, pennsylvania,
2. While speaking with a woman involved ill the domestio
dispute, Trooper Palmero observed a vehiole slow down in front of
the residenoe, baok up and pull forward, repeat this aotion, and
then stop the vehiole in the street in front of the reeidence.

3. After asoertaining that the woman he speaking to did not
recognize thi. vehiole, Trooper Palmero approaohed the vehicle to
determine its purpole for stopping.
4. As Trooper Palmero engaged in oonversation with the
operator of the vehiole, he deteoted a strong smell of aloohol
emanating from the driver's side of the vehiole.
s. Trooper PAlmero then requested the operator's lioenle,
but the operator was unable to looate the lioense.
6. At this point, Trooper Palmero asked th~ operator
(petitioner) to step out of the vehicle and move to the front of
the vehiole.
7. As the potitioner did so, Trooper Palmero notioed that
he was having diffioulty balanoing, wae Itagger!ng, displaying a
general lack of ooordination, and had glassy, bloodshot eye..
B. The petitioner then eubmitted to an RON test, but
refueed to perform any other field lobriety tests.
9. Trooper Palmero then plaoed the petitioner under arrest
for driving under the influenoe, read him hil Mi~anda warning.,
placed him in the back of the patrol oar, and told him that he
would be required to take a breath test at the Btation,
10. At the station, the petitioner waB read the ohemioal
test warning., and was alBo allowed to road thom for himself,
(Commonwealth's Exhibit 1).
11. Petitioner refuBed every effort made by Trooper Palmero
to give him a breath teBt even though he was made aware numerou.

12. Petitioner .tated that he wanted to talk tQ an
attorney. He wal told .gain by Trooper Palmero that he did not
have the right to an attorney at thi. time, but if he gav. the
polioe the na~ of hie attorne~ they would try and oontact him.
Petitioner nev~r gave police the name of hiB attorney.
13. Peti,tioner received notice of hiB euepeneion dated
October 18, 1994, and thiB appeal followed.
14. Petitioner WaB not preBent at the hearing, but couneel
agr.ed to proceed in hiB abeence. Petitioner w.e permitted to
t.etify at a later time ae to why he wae not in attendanoe at the
h.aring.
DISCUSSION
Initially, we muet determine whether Trooper palm.ro had
probable oauee or reaeonable grounde to requeet petitioner to
.ubmit to a blood alcohol teet. Seotion 1547(a) of the Vehicle
Code provide., in pertinent partl
Any pereon Who drivee, operatee or
ie in actual physical control of
the movement of a motor vehicle in
thie Commonwealth shall be deemed
to have given consent to ono or
more chemical teet. of breath,
blood or urine for the purpoBe of
dotermining the alcoholic content
of blood or the preeence of a
controlled oubBtance if a polioe
officer has reaBonable groundB to
believe the perBon to have been

alcohol or a controlled .ub.tance

75 Pa.C.B.A. 51547(a). Therefore, where a police officer ha.
rea.onable ground. to believe that a person i. driving under the
influence of alcohol, he may require the individual to .ubmJ,t to
a chemical test without warrant, "Rea.onable ground. exi.t. if a
rea.onable pereon in the po.ition of the officer, viewing the
fact. and circum.tance. a. they appeared at the trial, could have
concluded that the motori.t had oper.ated the vehicle while under
the influence of alcohol." Department of Tran.Dortation. Bureau
of Driver Licen.in9 v. Dixon, 141 Pa.Commw. 507, 510, 596 A.2d
286, 287 (1991), quoting Decartment of Tran,portation. Bureau of
Driver Licen.ina v. Terreri, 114 Pa.Cornrow. 208, 210, 538 A.2d
639, 640-41 (1988).
Turning to the fact. of the present ca.e, it i. clear that
Trooper Palmero wa. authorized, in the cour.e of his
inve.tigation of a dome.tic di.pute, to approach petitioner'.
vehicle and a.certain it. purpose for Itopping in the .treet in
front of thi. re.idence. AB he engaged the petitioner, Trooper
Palmero detected a Itrong Imell of alcohol emanating from the
driver's Bide of the vehicle. The petitioner could not locate
hi. licen.e upon reque.t, and after being asked to exit the
vehicle, petitioner had difficulty balancing, was staggering, wag
di.playing a general lack of coordination, and had blood.hot and
glassy eyel. From theee observatione, Trooper Palmer.o alked

petitioner to sub.it to a e.riee of field eobriety t.ete, but
petitioner refused to perfo~ any teet except for the UGH teet.
We believe it ie clear fro. these facte that a realonable
person in the pOlition of Trooper Palmero could have concluded
that petioner wal operating his vehicle while under the influence
of alcohol. Therefore, the officer had realonable grounde to
requeet a blood alcohol test.
The eecond illue raieed in thie appeal ie whether police
satiefied the requiremente eet forth in Comm9nwea1tb. Dept. of
Traneportation. B~reau of Traffic Safety v. O'Connell, &21 Pa,
242, ~~~ A.2d 873 (1989), and the line of caees which followed.
Moet recently, the Penneylvania Supreme Court etatedl

covered in warnings ieeued by the
police.

The facte of the present case indicate that petitioner wae
read hiM Miranda warnings at the time of hie arrelt. Once back

for driving while under the
influence of alcohol or a
oontrolled gubstance.
IIa Commonwealth's Bxhibit 1. In addition to Trooper Palmero
reading him this form Beveral times, petitioner was also given an
opportunity to read thh form for himBelf. It is clear that
these warnings eatisfy the requirementB set for.th in Inqram.
.uora.
Pet:itioner argues, however, that he wu oonfused because
Trooper Palmero offered to call an attorney of petitioner'S
choice. We find this argument to be without merit. Trooper
Palmero repeatedly told the petitioner that he did not have a
right to speak with an attorney, but that Trooper Palmero would
oall his attorney for him in Bpite of this fact: if petitioner
, gave him his name. Petitioner never supplied the n~e of his
attorney and continued to refuse to submit to the breath test.
It wa. at thia point that Trooper Palmero considered petitioner'S
actions to be a refuaal to submit to the requested chemical test.
Thus, baaed on the relevant facta, we believe it ia clear that
defendant did in fact refuae to take the breath teat. We muat,
ther.efore, deny petitioner'a appeal.
