ANSWER TO PLAINTIFF'S PETITION OBJECTING TO
DISMISSAL PURSUANT TO PA. R,C.P. 1901 AND LOCAL RULEJl~
Defendant Mellon Bank N.A., ("Mellon Bank") by its
counsel, Joh~ MeN. Cramer, Reed Smith Shaw & McClay LLP, answers
plaintiff's petition objecting to dismissal pursuant to Pa,
R.J.A, 1901 and local rule 228 as followsl
1. It is admitted that the above captioned case was
placed on the Cumberland Count.y purge list pursuant to local
rule 228.
2. It is admitted that a writ of summon5 was filed on
or about January 24, 1995 and was served on January 25, 1995.
3. The averments of paragraph 3 of the petition are
denied as stated. On the contrary, because no complaint or even
claim for reimbursement has been filed by plaintiff, Mellon Bank
does not know the basis for an action against it. Mellon Bank
is aware that an employee of plaintiff was criminally prosecuted
and that in connection with that prosecution, records of Mellon
Bank concerning plaintiff's account with Mellon Bank relating to
the period from January 1990 to December 1993 were obtained
through the use of a search warrant,

4. Mellon Bank is without knowledge or information
sufficient to form a belief as to plaintiff's reasons for
failing to file a complaint or take any other action in this
matter.
5. The averments of paragraph 5 of the petition that
the criminal proce~ding was completed in May of 1998 are denied.
On the contrary, on information and belief, an employee of
plaintiff entered a plea of guilty to theft by deoeption in July
1997,
6. Mellon Bank is without knowledge or information
sufficient to form a belief as to the truth of the averments of
paragraph 6 of the petition concerning a plea bargain. On
information and belief, plaintiff's employee has been ordered to
pay plaintiff $85,000.
7, It is denied that it was prudent for plaintiff to
wait for the resolution of the criminal proceeding. On th~
contrary, prudence required plaintiff to plead its claim while
the memories of both plaintif.f's and defendant's employees were
fresh and witnesses were readily available.
8. It is denied that plaintiff's willingness to hold
its action in abeyance while the criminal action was proceeding
has narrowed the issues and thus promoted jUdicial economy. On
the contrary, plaintiff has not identified any particular
factual issue which has been eliminated as a result of its delay
and, if plaintiff is allowed to proceed, all issues relating to

the cond~ct ot plaintiff's employee, plaintiff's supervision at
its employees and management practices, and the knowledge of
defendant's employees over a period of several years in the
early 1990s may need to be addressed depending on the nature of
plaintiff's claims.
9, Mellon Bank is witho~t knowledge or information
sufficient to form a belief as to the truth of the averments of
paragraph 9 of the petition,
10. It is admitted that Mellon Bank could have
compelled plaintiff to file a complaJ.nt, That ability does not
absolve plaintiff of the r~sponsibility to prosecute its claim,
if any, with diligence.
11. It is denied that Mellon Bank has not been
prejudiced by plaintiff's delay, On the contrary, Mellon Bank
has been prejudiced in several respects, Several employees in
the Mechanicsburg office where plaintiff'R account was located
during the period from January 1990 thro~gh August 1993 have
left their employment with Mellon Bank. Mellon Bank employees
in other locations who supported the Mechanicsburg office have
also left their positions with Mellon Bank. In some cases, the
present locations of the former Mellon Bank employees are not
known to Mellon Bank. In addition, on information and belief,
George Lyter, the supervisor of plaintiff'E employees and the
second signature on the account of plaintiff with Mellon Bank,
is no longer an officer of plaintiff. In addition, Mellon

Bank's records regarding plaintiff's account are not readily
available and the memories of all potential witnesses have
faded.
WHEREFORE, defendant Mellon Bank, N,A. respectfully
requests that plaintiff's petition be denied and that the above
captioned matter be dismissed.

1. The above,captioned case was placed on the Cumberland County
purge list pursuant to Local Rule 228.
2. A Writ of Summons was med on or about January 24, 1995 and was

3, The action concerns unauthorized checks cashed at Defendant Mel10n
Bank by an employee of Plalntill's who was embezzling money,
4, Plaintiff has held this case In abeyance while pursuing through the
criminal system restitution from tl1e embezzler,
5, The criminal proceeding was completed In May of 1998.
6. AI a result of a plea bargain. the employee will pay back some but
not al1 of the embezzled money,
7. Plaintiff prudently waited for the resolution of the criminal
proceeding because there was a possibility that the resolution could have
eliminated the need for this litigation,
8, Plaintiffs wll1lngness to hold this action In abeyance while the
criminal action proceeded has narrowed the Issues, and thus promoted judicial

shortly,

placed on the Cumberland County purge list pur.uant to local
rule 228.
2. It is admitted that a writ of summon. was filed on
or about January 24, 1995 and wa, served on January 25, 1995,

denied as .tated. On the contrary, becau.e no complaint or even
claim for reimburs.ment ha. been filed by plaintiff, Mellon Bank
does not know the b..i. for an action against it. Mellon Bank

and that in connection with that prosecution, records of Mellon
Bank concerning plaintiff'. account with Mellon Bank relating to
the period from January 1990 to December 1993 Were obtained
