cumberland county, Pennsylvania. plaintiff has resided at this
address sinoe 1962.
2. Defendant i. Robert M. Ansel, an adult individual who
currently resides at 902 West Trindle Road, Meohanicsburg,
cumberland county, Pennsylvania. Defendant has resided at this
address sinoe 1962.
3. plaintiff and Defendant have been bona fide resident(s)
of the commonwealth for at least six months immediately prlvious
to the filing of thie complaint.
4. plaintiff and Defendant were married on August 19, 1952
in Mobile, Mobile county, Alabama.
5. There have been no prior actions for divoroe or
annulment between the parties hereto in this or any other
jurisdiotion.

marital property, inClUding, but not limited to, the marital
r..idenoe, an apartment building and Defendant's pension, during
their marriage from August 19, 1952 to date of final separation.
WHEREFORE, Plaintiff requests that this Honorable Court
equitably divide all marital property pursuant to the Divorce
Code prior to entry of a final divoroe decree.

13. Plaintiff lacks suffioient assets, income and benefits
to provide for her reasonable means and support following the

carlisle, Pennsylvania as oertified mail, restricted delivery a
true and oorreot copy of Plaintiff'S Complaint under Seotion
3301(c) and 3301(d) of the Divorce Code in the above-oaptioned

raising grounde for divorce of irretrievable breakdown of the
marriage. counsel have advised that the parties will eign and

Domeetic Relatione Code.
The complaint also raised the economio olaime of
equitable distribution, alimony, alimony pendente lite, and
couneel fee. and oosts.

Wi,th respect to the alimony olaim, oounsel have
advieed that marital misoonduot will not be an issue.
The parties were married on August 19, 19152, and
separated on May 1, 1989. counsel have agreed to the date of
..paration.
The parties are the parents of 12 ohildren, all of
whom are emanoipated.
Wife is 63 years of age and reside8 at 902 !feet
Trir,dle Road, Mechanicsburg, pennsylvania, in the marital home.
Hueband a180 resides in the marital home but they live
separatelY 1n the home and lead eeparate lives with regard to
their pereonal and financial matters. Wite ie a high eohopl
graduate and may have eome oollege training. She worke for KCI
Technologiee, Ino., and reports a biweekly gro.e income of
$503.14. Her net inoome is $312.48. Added to that ehould be a
profit sharing deduotion of $715.47. Wife al.o reoeive. alimony
pendente lite in the amount of $1615.00 every two week. and
receive. a payment from Foster servioes for the oare of a ohild
that .he assist on weekend.. The payment for oarinq for the
ohild i. $70.00 gros. w~ekly. Wife h~s not raised any health

Hueband is 66 years ot age and a. indioated,
re.ides in the marital home with wire at 902 We.t Trindle Road,
Meohanio.burq, Pennsylvania. He is retired a. a sohool teaoher
and reoeive. a gro.s monthly pension of $1,153.24. Husband
aleo reoeive. sooial .eourity in the amount of $920.90 per
month. lnoident to husband's employment prior to retirement he
has a oollege eduoation. Husband has not raised any health
i.sues.
Both parties agree that the marital residenoe at
902 West Trindle Road, Meohaniosburg, Pennsylvania has a value
of $110,000.QO. There is a mortgage against the property in
favor of Meridian Bank in the approximate amount ot $15,400.00.
Counsel have indioated they believe, however, that that mortgage
was inourred for the purpose of renovating or purcha.inq the
property at 161 West North street, carlisle, Pennsylvania.
With respeot to the Carlisle Borough property, that
property is used as a rental and oounsel have indioated that the
rental inoome is used to pay taxes and expenses. Mr. Bangs has
indioated that he previously provided Mr. Lipson with a
statement as to the inoome and expenses for that property as Mr.
Lipson was oonoerned that the expenses did not ~qual the inoome
so that there may be some net inoome left over for distribution
and aocounting. Wite placed a valuo on the property at
$37,000.00 and husband plaoed a value on the property of
$35,000.00. Apparently, neither party wants to retain the
property and the Master is reoommending that immediately the
parties list the property for sale and share in the oosts of
sale and any oapital gain tax liability and until this matter is
re.olved, esorow the prooeeds it the sale ooours prior to
settlement on other issues. Counsel for husband has presented
today an amendment to his pre-trial statement showing that
aooording to his olient, the parties' sons, Ros., Bob, and Riok
An.el are owed $7,000.00 for renovation work on the property.
Mr. Lip.on stated that he is unaware ot any monie. owed to the
partie.' sons. Counsel tor wite is going to oheok with his
olient to .ee if she agrees that that money is owed to the .on.
for the renovation work as listed on the amended pre-trial

The parties owed two vehicles.

property, if any, his client would like to remove when he leaves
and then coun.el can attempt to place a value on the property of
eaoh of the parties that will be retained by that party.

Wife's oounsel has stated that his client has used the funds
that she has had control over and we will need to have an
accounting as to what monies will be oharged against wife that
she has utilized from the marital accounts from the values first
given to the present values. Otherwise, the increase in vftlues
of the accounts will be utilized for the benefit of both partie.

.upplement program which i. paid out of his retirement. Wife
will be entitled to Medioare within two years when she retire.

net amounts of husband'S retirement benefit which he is

monthly benefit gross was $1,1~3.24. Mr. Bangs believe. that
that amount has deoreased because of a larger tax dedUction. In
any event, counsel can get appropriate dooumentation between now
and the hearing to determine what is the appropriate gros. and
net amount on the fund. Further, counsel are essentially in
agreement that the distribution of this fund will be by way of a

1. Petitioner is Plaintiff Walda D. Ansel, an adult individual
who resides at 902 West Trindle Road, Mechanicsburg, Cumberland
county, Pennsylvania.
2. Respondent is Defendant Robert M. Ansel, an adult
individual who also resides at the 902 West Trindle Road address.
3. The above-captioned divorce proceeding was f Ued on January
26, 1995. Petitioner's counsel of reoord is stephen B. Lipson,
Esq., and Respondent is reprasented by Michael L. Bangs, Esq., who
has not formally entered an appearance in the proceeding.
4. Petitioner is employed by RCI Technologies, Inc. In 1994
she earned gross wages of $12912.90. After deductions for taxes,
etc., Petitioner's net income for 1994 was approximately $8~00.00
and presently "takes home" approximately $700.00 per month.
5. Respondent is retired with two basic sources of income,
namely a pension from the Penneylvania PUblic School Employees
Retirement system in an amount of $1120.89 per month and social
security of $867.00 per month. In addition, Respondent exercises
complete control over the partiQs' major liquid asset, a financial
management aocount with Smith Barney that had a balanoe of
$53983.67 a. of December 31, 1994.
6. Prior to April of 1995 Respondent paid Petitioner $200.00
every two weeks to enable her to meet her finanoial obligations as
well .. maintain the standard of living that the parties had
attained. However, Respondent has ceased paying this b1-weekly
amount to Petitioner, evidently because Petitioner no longer
desired to file joint tax returns with Respondent.
7. The farties have exchanged financial information and
presumably wi 1 negotiate in good faith in an attempt to resolve
the outstanding economic issues. However, in the interim
Petitioner needs alimony pendente lite from Respondent in order to
maintain her standard of living as well as pay her attorney's fees,
oosts of appraisals, eto.

(i) I do not possess presont values of the smith-Barney
account or husband's accounts with Dauphin Deposit, West

Notel If, as Plaintiff contends, the value of the homes shOUld be

reduced by selling costs (6% ~ommiasion plus 1\ transfer tax),
Plaintiff's tqtal is reduced by $7,700.00 and Defendant's total
is reduced by $2,590.00.
However, using gross values above plus the smith-Barney
securities account, we have total assets of $136,321.67 plus
$83,937.16 plus $58,844.76, or $279,103.59. Plaintiff's
testimony will reveal that her social Security payment upon
retirement will be 50\ ot Defendant's monthly amount. For this
(as well as other) reasons, Plaintiff is demanding 58.5% of the
above listed assets, or $163,275.60. To achieve this total she
would receive $26,953.93 of the Smith-Barney account, with the
remainder to Defendant.
Plaintiff also is demanding 55% of the gross pension

received by Defendant from the Public School Employee pension.
In addition, because the outstanding mortgage is on Plaintiff's'
real estate, she either shOUld receive alimony to pay for some or
all of the monthly cost gx receive more of the Smith-Barney
account to reflect the decreased value of her marital assets.

THE HASTERI Today is Thursday, April 11, 1996,
Present for a Master's hearing are the Plaintiff, Walda D.
Ansel, and her attorney stephen B. Lipson, and the Defendant,
Robert M. Ansel, and his attorney Michael L. Bangs.
A divorce complaint was filed on January 26, 1995,
raising grounds for divorce of irretrievable breakdown of the
marriage. The parties will sign and file affidavits of consent
so that the divoroe can be concluded under section 3301(c) of
the Domestic Relations Code. The Plaintiff previously filed an
affidavit under section 3301(d) but we will not need to utilize
that affidavit in view of the understanding that the divorce
will proceed under Section 3301(c). The affidavits of consent
and the waiver of the notice of intention to rile for. divoroe
docu~ents will be provided to the Master today and the Master
will see that those doouments are filed with tho prothonotary.
The divorce complaint also raised the eoonomic
olaims of equitable distribution, alimony, alimony pendente
lite, and counsel fees and expenses.
The parties were married on August 19, 19~2, and
separatsd on May 1, 1989. The partie. are the natural parsnts

of 10 ohildren and have adopted 2 children. All of the children
of the parties are emancipated.
Th. Master has be.n informed that after extensive
negotiations the parties have reached an agreement with respect
to the economio ia.ues, The agreement is going to be placed on
the reoord in the presenoe of the parties and the aqreement as
stated on the record will be considered the sub~tantive
agreement of the parties. The agroement will not be subject to
any modification or changes except for correction of
typographical errors which may be made during the tran.cription.
After the agreement has been stated on the record,
the parties will return later today to review the draft of the
agreement for typographical er.rors. After any typographical
error. have been corrected, the parties and counsel will sign
the agreement by way of affirmation of the term. that have been
.tated on the record. The agreement will then be made part of
the record and file. The Master will prepare an order vaoatirtg
hie appointment and counsel will then be in a position to
conclude the divorce by the filing of a praecipe to transmit the
record to the Court requesting the entry of a divorce decree.

such that wife will receive all of the personal property

Pennsylvania school Employee's Retirement system, such

School Employee's Retirement System. Until such time as
the QDRO is in effeot, husband shall pay directly to wife
beqinning on May 1, 1996, one half of the benefit
payable to him after reducing it by the applicable
federal taxes. currently that figure is $1,060.00 so
that wife will be entitled to receive $540.00 per month.
Husband agrees to be responsible to pay for aU of the
normal expenses for the house at 902 West Trindle Road,
Meohanicsburq, Pennsylvania, through April of 19961
those normal expense. being defined as the utilities
and will include the current outBtandinq county taxes.
Hu.band also will oontinue to pay the alimony pendente
lite until the end of April at whioh time that will
terminate and wife aqrees to take any and all steps
nec...ery to effeotuate the termination of that order as
of May 1, 1996.
Husband aqrees that he will pay all expen.es related to
the care and maintenance of the rental property until
such time as it is sold and further agrees that the home
equity loan that is a lien against the property at 902
West Trindle Road, Mechanicsburg, Pennsylvania, shall be
paid from the rental income reoeived from that investment
property.
HUsband agrees to cooperate with the signing of a deed
transferrinq the 902 West Trindle Road, Mechanic.burg,
penn.ylvania, residenoe to wife.
Both parti.s agree that they will sign any and all
document. neoes.ary to effeotuate the transfer of
vehicle. and aocount. to eaoh other. All of those

documents must be signed within thirty (30) days of
today's date.
9. Wife ag~ees to sign any and all documents neoessary to
etfectuate the sale of the rental property at 161 West
North street, Carlisle, Pennsylvania,
10. Both parties waive any olaim to alimony or counsel f~es,

tax return,
12. The parties will continue to co-own all seven oemetery
plots. Three of the lots are in the Holy Cross cemetery
in the Bo~ough of paxtang, Dauphin county and four lots
are in the Trindle spring cemetery in Silver spring
Township, Cumberland county.
13, Exoept as herein otherwise provided, each party may
dispose ot his or her property in any way and each
party hereby waives and relinquishes any and all rights
he or she may now have or hereafter acquire under the
p~esent or future laws of any jUrisdic~ion to share in
the property or the estate of the other as a result of
the marital relationship inoluding without limitation,
statutory allowance, widow'S allowance right of
intestacy, right to take against the will of the other"
and right to act as administrator or executor in the
