the basement or crawl space, as set forth on "Seller's Property
Disclosure Statement." Defendant further added to that question that
there occurred "a little water with hard rains". Defendant Is unaware
of any "other structure".
7. Paragraph 7 is not a factual allegation to which an answer is required.
8. After reasonable investigation, Defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments
of paragraph 8 of the Complaint, and said averments are, therefore,
Denied. Defendant demands proof thereof at the trial of this case.
9. This Defendant is without knowledge or information sufficient to form
a belief as to the truth of the averments of paragraph 9 of the
Complaint. and all means of proof thereof are In the exclusive control
of the Plaintiffs. The said averments are. therefore. Denied.

10. It Is Admitted the Plaintiffs contacted Defendant approximately two
weeks following closing to advise of some leakage discovered during a
particularly severe storm, at which time Defendant recalled that some
moisture did seep into the west wall during hard, wind driven rain, It
is Denied that any tragic revelation occurred, or that Defendant
W""~':.:"~~~.I" admitted to "water leakage" problems of Which he was aware.
11. The Defendant is without knowledge or information sufficient to form
a belief as to the truth 01' the averments of paragraph 11 of the
Complaint, and all means of proof thereof are in the exclusive control
of the Plaintiffs. The said averments are, therefore, Denied,
Defendant demands proof thereof at the trial of this case.
12. The Defendant is without knowledge or information sufficient to form
a belief as to the truth of the averments of paragraph 12 of the
Complaint, and all means of proof thereof are in the exclusive control

B.1, Admitted only insofar as there occurred some seepage along the west
wall of the Defendant's property. In completion of Item 2 of Seller's
Property Disclosure Statement, Defendant Indicated that he last
occupied the subject premises on Decemb~r 30, 1993. The har.h
weather conditions during the winter/spring of 1994 certainly could
have resulted in a structural defect that permitted there to occur the
seepage of which the Plaintiffs complain.

AND NOW, comes the Plaintiffs, stephen E. Atkins and Wendy J.
Atkins, husband and wife, by and through their attorneys/ KATHERMAN
. HEIM/ P.C. by Kurt A. Blake, E~quire and aver the following:
1. Plaintiffs stephen E. Atkins and Wendy J. Atkins, husband
and Wife, are adult individuals residing at 479 North Mountain
Road/ Newville, Cumberland County/ Pennsylvania 17241.
2. Defendant Bradley K. McCurdy is an adult individual
residinq at 635 West Siddonsburg Road/ Dillsburg/ York County,
pennsylvania 17019.
3. On Qr about April 20/ 1994/ Plaintiffs purchased from the
Defendant a home and property looated at 479 North Mountain Road/
Newville, PA 17241/ which is more fully described in the Deed
attached hereto and marked as Exhibit" A" .
4. Prior to the sale, Defendant made statemonts and
representations regarding no water leakage problems to Plaintiffs,
includinq but not l1mi ted to/ a Seller's Property Disolosure
Statument/ signed by Bradley K. McCurdy. <A copy of SeUer'.
Property Disclosure statement is attached hereto as E)(hib1t "B")
5. Defendant in Seller's Property Disclosure Statement
clearly checked "no" when asked if the roof ever leaked du'rino
"
ownership.
6. Further / Defendant checked "no" whQn askllQ if aware of
any past or present water leakage in the house or other struoture.
7. Water leakage problems were a material conoern to the
Plaintiffs and they relied on Defendant'lI reprellentatlon in making
their determination to purchase the home.
8. Within two (2) weeks of the purchaso of the home, during
the first rainstorm since Plaintiffs purchaseQ the home, Plaintiffs
observed numerous water leakage problems.
9. The water leakage problems were and still are numerous
and consist of the followingl
(a) I(i tchen West wall leaking water. Water runs in from
window.
(b) Living room North wall leaking water where porch does not
oover.
(c) Stairway North wall leaking small amounts of water.
(d) Master bedroom North wall leaking water in var.1ous places
along entire wall. spots on East wall. Skylight drips water in
hard rain.
(e) Back room roof is leaking water into drywall. Windows
are also leaking.
(f) Front bedroom North and West walls are leaking. Allover
room windows have water leaks.
(g) Back bedroom windows have water leaking.
(h) There are marks in some spots of the basement on the
oeilinq of the floor above.
10. Plaintiffs CJontacted Defendant followinlj such tragic
revelation and Defendant or Defendant's agent admitted to
Plaintiffs that the disclosures regarding water leakage were wrong
and they were aware of the problem.
11. Such water leakage problems have and continue to affect
the appearance and aesthetic value of the home, both inside and
outside.
12. Plaint i fts in an et fort to remedy the water leakage
problem contacted a contractor / steve from Keystone contracting
Group/ 5300C Linglestown Road, Harrisburg, Pennsylvania 17112/ who
examined the premises and quoted an estimate of repair at

13. Plaintiffs continue to Buffer from the water leakage
(Attached hereto as Exhibi t "c" is a copy of the
problems in their home.
WHBRBrORB, Plaintiffs respectfully request that this Honorable
Court find in favor of the Plaintiffs and award them $18/000.00
plus interest, costs/ attorney's fees and such other and further
relief as the Court deems appropriate.
