following fact.. Hedwig Warden, the grandmother of pl.'nt,ff, owned. 1215 acre farm
In Cumberland County. Def.nd.nt, Donald Vemet, lived on that farm. Defend.nt
p.'d $100 rent, plu. he mowed the field. on the property and did other c.retaklng
chol'8l. He u.ed hi. own equipment to do the mowing. Beeaute of the hili. and
rough t.rraln, that equlpm.nt wore out. A. a r..ult, In October, 1989, def.ndant
purchued a M....y Fergu.on 180 tractor for $e,400, for which Hedwig Warden
contributed 12,700. She did not seek or obtain any ownership Int.r..t In the tractor.
Hedwig Warden died on Febru.ry 24, 1991. Plaintiff, Who WI' the primary beneficiary
of the W.rden ..t.t., Inherited the Cumberland County farm, although h. did not
move there until April 115, 19915. Th. ..t.te did not claim any own8l'lhlp In the
Mu.ey Fergu.on 180.
Aft.r purchaelng the Malley F.rguson 180 tractor In 1989, defendant
reconditioned .nd m.'nt.'ned It and u.ed It to mow the fielde on the f.rm. Until ehe
died In 1991, Hedwig Ward.n occ.,'onally helped pay for part. for the tractor. In the

tractor to mow the property. Plaintiff and defendant agreed to puroha.e a new
Kubota tractor from Peterman Power Equipment, Ino. In Carll.le. They negotiated the
purch..e together wl,th Larry Wert, a Peterman .alllman, who wa. familiar with the
MU'ey Ferguson 180 tractor being traded In. The .al..lnvoloe of October 15, 1883,
for a new Kubota traotor with a loader and buoket, totalled $34,2115.50. The u.lgned
tracl.ln for the Ma...y Fergullon 180 wa. $10,2115.50. Plaintiff paid Peterman POWlll'
