COMPLAINT
AND NOW, comes the plaintiff, Marilyn D. Army, by her
attorneys, Fowler, Addams, Shughart & Rundle, and maKes the
fOllowing complaint:
1. The Plaintiff is Marilyn D. Army, an adult individual,
residing at 103 Yates street, Mt. Holly springs, PA 17065.
2. The Defendant is Castles Lumber Company, Inc., d/b/a
Castles Lumber and Home Center, a corporation organized and
existing under the laws of the CommonWealth of Pennsylvania with
its offices and principal place of business at 290 East Pomfret
street, Carlisle, PA 17013.
3. The Defendant operates a retail store at the above
location.
4. During the early afternoon on February 17, 1993 the
plaintiff was an invitee in Defendant's store Shopping for salt
to melt ice.
5. The Plaintiff went to the far left corner of the store,
but found salt only for water systems. She turned to go to the
main desk. As she started walking she tripped over an empty
platform about six inches high, fell and was injured.
6. The Plaintiff's injuries were caused by the negligence
and carelessness of the Defendant in:
.....
a. Maintaining the platform out of the normal sight of
shoppers;
b. Maintaining the platform in a normal traffic area
for shoppers; and
c. Failing to warn the Plaintiff of the presence of
the platform.
7. As a result of the negligence and carelessness of the
Defendant, the Plaintiff fell and sustained fractures of the
sixth and seventh left ribs, a contusion of the chest and a
severe aggravation of her pre-existing fibrositis.
8. Plaintiff incurred medical expense in the amount of
$2,116.21 for the treatment of her injuries.
9. The Plaintiff was absent from her employment for 10 days
reSUlting in loss of earnings of $1,200.
10. As a result of her injuries the Plaintiff was undergo
great pain and SUffering, embarrassment and a loss of life's
pleasures.
WHEREFORE, the Plaintiff demands judgment against the
Defendant for an amount in excess of $25,000 plus damages for
delay and costs of suit.

AND NOW, comes the Defendant, Castles Lumber company,
Inc. d/b/a/ castles Lumber and Home Center, by its attorneys,
Goldberg, Katzman & Shipman, P.c., and files the following Answer
and New Matter in response to the Plaintiff's Complaint:
1. Denied. After reasonable investigation, Defendant is
without information sufficient to form a belief as to the truth
or falsity of the averments in this paragraph and, therefore,
denies the same and demands strict proof at time of trial if
deemed material.

or falsity of the averments in this paragraph and, therefore,

6. The averments in this paragraph constitute conclusions
of law to which no response is required'. In the event a response
is deemed to be required, it is denied that Defendant, Castles
Lumber Company was negligent or careless and denied that the
Plaintiff's injuries were caused by any negligence or
carelessness on the part of the Defendant. By way of further
answer, Castles Lumber company denies that it was negligent and
careless in:
a) maintaining a platform out of the normal sight of
shoppers;
b) maintaining a platform in a normal traffic area
for shoppers; and
c) failing to warn the Plaintiff of the presence of
the platform.
7. The averments in this paragraph constitute conclusions
of law to which no response is required. In the event a response
is deemed to be required, Defendant denies that it was negligent
and careless and denies that the Plaintiff fell and sustained any
injuries as a result of any negligence or carelessness on the
part of the Defendant.

13. Plaintiff, Marilyn A%~y was comparatively negligsnt and
failed to exercise reasonable care for her own safety in the
following:
a) walking and/or traversing through the Defendant's
premises without first ascertaining whether it was
safe to do so in the manner in which she was
proceeding;
b) failing to watch where she was walking;
c) walking and/or traversing through the premises in
a hurried and inappropriate manner;
d) failing to keep alert and observant.
14. The Plaintiff's failure to exercise reasonable care for
her own safety was a substantial factor in the happening of the
accident.
15. If a dangerous condition existed at the time of the
Plaintiff's accident, which is denied, the Defendant avers that
it did not have actual or constructive notice of the dangerous
condition prior to the happening of the Plaintiff's accident.

WHEREFORE, Defendant, Castles Lumber Company, Inc.,
