Fishel, by and through their attorney, Joseph J. Dixon, Esquire, who respectfully liIes the following Motion for a Rule to Show Cause as follows: I. The Plaintiffs/Petitioners are Carla D. Fishel and Ted L. Fishel adult individuals who reside at 612 Range End Road. Dillsburg, York County, Pennsylvania ]7019. 2. The DefendanURespondent is Carey C. Welsh an adult individual who resides at 202 Shugart Avenue. Boiling Springs. Cumberland County, Pennsylvania 17007. 3. On or about January 31. 1995. the Plaintiffs/Petitioners had a Praecipe for a Writ of Summons issued on this case concerning a motor vehicle accident, which occurred on February 6, 1993 in Cumberland County, Pennsylvania. 4. On February 16. 1995 the Cumberland County Sheriff servcd thc Dcfendant/Respondent on this matter. (See copy of Printout from the Prothonotary's Office attached hereto and marked Exhibit A). \ \ i 5. Subscquent to the service on the Complaint, negotiations between the Plaintiff/Petitioner and the Defendant/Respondent's insurance carrier occurrcd in an attcmpt to resolve this personal injury case resulting from n motor vehicle accident. 6. When negotiations failed, thc Plaintiffs/Petitioners tiled n formal Complaint on December 20, 1996. 7. When the formal Complaint for this motor vehicle accident case was tiled, the Complaint was inadvertently docketed at Docket Number 1996-06873. 8. Subsequent to tiling of the Complaint, substantial docket activity occurred, all of which were docketed in 1996 docket number. (See copy of printout from the Prothonotary's Office attached hereto and marked Exhibit B.) 9. In addition to the docket nctivity rcOccted in Exhibit B, on October 7, 1998, counsel to the parties argued in front of Thc Honorahle Judge Edgar Bailey and The Honorable Judge Kevin Hess, the disposition of an outstnnding motion by the Defendant for a summary Judgment. 10. The Plaintiffs/Petitioners believes and thercfore avers that the docket activity, docketed at 1995-00532 should be consolidated with the docket activity dockcted at number 1996- 06873. II. All activity under both dockets refer to thc same motor vehiclc accident and involve the same parties. \ \ ". WHEREFORE, the Plaintiffs/Petitioncrs pray this Honorablc Court, issue a Rule to Show Causc as to why the two (2) separate dockets on the same civil casc should not bc consolidated.
